Appeal of Hrivnak Motor Company under the Storage Tank and Spill Prevention Act, Underground Storage Tank Indemnification Fund; Doc. No. UT99-07-006

   A hearing shall be held on October 19, 1999, at 12:30 p.m. and on October 20, 1999, at 10 a.m. Motions preliminary to those at hearing, if any, must be filed with the Docket Clerk, Administrative Hearings Office, Room 200, Capitol Associates Building, Harrisburg, PA 17102, on or before October 5, 1999. Answers to motions, if any, shall be filed on or before October 15, 1999.

   A written request for continuance of the scheduled hearing, for good cause, will be considered by the Presiding Officer. Prior to requesting a continuance, a party must contact the opposing party. Continuance requests must indicate whether the opposing party objects to a continuance.

   Each party may appear with or without counsel and offer relevant testimony and/or other relevant evidence. Each party must bring documents, photographs, drawings, claims files, witnesses, and the like, necessary to support the party's case. A party intending to offer documents or photographs into evidence shall bring enough copies for the record and for each opposing party.

   Following the hearing and receipt of the stenographic transcript, the Insurance Commissioner will issue a written order resolving the factual issues presented at the hearing and stating what remedial action, if any, is required. The Commissioner's Order will be sent to those persons participating in the hearing or their designated representatives. The Order of the Commissioner may be subject to judicial review by the Commonwealth Court.
