NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS

NPDES APPLICATIONS

PART I PERMITS

   Under the Federal Clean Water Act and The Clean Streams Law, the following parties have applied for an NPDES permit or to renew their current permit to discharge controlled wastewaters into the waters of this Commonwealth or to conduct other activities required by the NPDES permit. For renewal applications listed in Section I, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements. For new permit applications, renewal application with major changes or applications for permits not waived by the EPA, the Department, based upon preliminary reviews, also made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications listed in Section II. These determinations are published as proposed actions for comments prior to taking final actions.

   Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.24(d).

   Persons wishing to comment on the proposed permit are invited to submit a statement, to the office noted before the application, within 30 days from the date of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding this application. The comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant. Following the comment period, the Department's Water Management Program Manager will make a final determination regarding these applications. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

   The renewal application, including proposed effluent limitations and special conditions, is available on file. For new permit applications, information submitted with the applications is available on file. The information may be inspected and arrangements made for copying at the office indicated before the application.

   For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride, sulfates, chlorides and phenolics, the existing/proposed downstream potable water supply (stream and public water supplier) considered during the evaluation is the Hawthorn Water Authority on the Redbank Creek located at Hawthorn, approximately 36 miles below point of discharge.

   The receiving stream, unnamed tributary to Wolf Run, is in watershed 17C and classified for CWF, aquatic life, water supply and recreation.

   The proposed effluent limits for Outfall 001 are based on a design flow of 0.000450 MGD.

The nearest downstream public water supply intake for Keystone Water Supply is on the Delaware River, approximately 40 miles below the point of discharge.

   The proposed effluent limits for Outfall 001 based on a design flow of 20 MGD.

   Description of activity: The application is for issuance of an NPDES permit for an existing discharge of treated sewage.

   The receiving stream, Willoughby Run, is in Watershed 13-D and classified for WWF, water supply and recreation and fish consumption. The nearest downstream public water supply intake for the City of Frederick is located on the Monocacy River, approximately 42 miles downstream. The discharge is not expected to affect the water supply.

   PA0219401, Sewage, James and Phyllis Bandstra, 1570 Causeway Drive, Friedens, PA 15541. This application is for renewal of an NPDES permit to discharge treated sewage from Bandstra single residence STP in Stonycreek Township, Somerset County.

   The following effluent limitations are proposed for discharge to the receiving waters, known as unnamed tributary of Lake Stonycreek, which are classified as CWF with existing and/or potential uses for aquatic life, water supply and recreation. The first downstream potable water supply intake from this facility is the Hooversville Municipal Authority.

   Outfall 001:  new discharge, design flow of 0.0004 mgd.

   PA002666, Industrial Waste, Crompton Corporation, 100 Sonneborn Lane, Petrolia, PA 16050. This proposed facility is located in Fairview Township, Butler County.

   Description of Proposed discharge of treated industrial waste, treated stormwater and untreated stormwater from a producer of surface active agents is in watershed 17C and classified for WWF, aquatic life, water supply and recreation. For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing/proposed downstream potable water supply considered during the evaluation is Pennsylvania American Water Company, Butler District on the Allegheny River at East Brady, approximately 20.4 miles below point of discharge.

   The proposed effluent limits for Outfall 001 are based on a design flow of n/a MGD.
