Acceptance of Rulemaking Petitions for Study

   On February 17, 2004, the Environmental Quality Board (Board) accepted two rulemaking petitions for study under 25 Pa. Code Chapter 23 (relating to Environmental Quality Board policy for processing petitions--statement of policy).

   The first petition, submitted by the Green Valleys Association and 48 copetitioners, requests that the Board redesignate the Beaver Run and lower French Creek (Basin, from and including Beaver Run to the Junction of West Vincent, East Vicent and East Pikeland Townships) in Chester County from their present designation of High Quality (HQ)-Trout Stocking (TSF), Migratory Fishes (MF), as identified in 25 Pa. Code § 93.9f (relating to Drainage List F), to Exceptional Value (EV)-TSF, MF.

   The second petition, submitted by the Ken Sink Chapter of Trout Unlimited, requests that the Board redesignate a portion of Two Lick Creek in Indiana County from its present designation of Trout Stocking (TSF), as identified in 25 Pa. Code § 93.9t (relating to Drainage List T), to HQ-Cold Water Fishes.

   Under 25 Pa. Code § 93.4d(a) (relating to processing of petitions, evaluations and assessments to change a designated use), the Department of Environmental Protection (Department) is required to publish a notice of intent to assess candidate waters before performing survey work. The Department's assessment notices for the Beaver Run and lower French Creek, as well as for a portion of Two Lick Creek, will appear in a future issue of the Pennsylvania Bulletin.
