Appeal of Lawrence P. Wean, M.D. under the Medical Care Availability and Reduction of Error (MCARE) Act (40 P. S. §§ 1303.101--1303.910); Doc. No. MM03-12-015

   A hearing is scheduled in this case for April 20, 2004, at 10 a.m. in the Administrative Hearings Office, Capitol Associates Building, Room 200, 901 North Seventh Street, Harrisburg, PA 17102.

   On or before April 14, 2004, each party shall file with the Administrative Hearings Office a prehearing statement which shall contain:  (1) a statement of contended facts; (2) the names and address of witnesses along with the specialties of experts, if any, to be called; (3) a list of documents to be used at the hearing; and (4) a list of special evidentiary or other legal issues. Contemporaneously with service of the prehearing statement on the opposing party, each party shall supply the other with a copy of any report generated by an expert witness designated on the prehearing statement. A report subsequently received from a party's expert witness prior to the hearing shall be supplied to the other party within 2 business days. Copies of expert reports need not be filed with the Administrative Hearings Office. Failure to provide this information may result in preclusion of testimony or evidence.

   A jointly executed written stipulation of facts and documents must be prepared and presented on April 20, 2004, prior to the start of the hearing.
