PUBLIC WATER SUPPLY (PWS) PERMITS The Department of Environmental Protection has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1--721.17) for the construction, substantial modification or operation of a public water system.
Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, shall also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

A work plan for conducting a baseline remedial investigation is required by provisions of the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

MACTEC Engineering and Consulting, 700 North Bell Avenue, Pittsburgh, PA 15106, on behalf of York College of PA, 439 Country Club Road, York, PA 17403 and Readco Holdings, 460 Grim Lane, York, PA 17402, submitted a Final Report concerning the remediation of site soils and groundwater contaminated with chlorinated solvents and inorganics. The final report demonstrated attainment of a combination of the non-residential Statewide Health and Site-Specific Standards, and was approved by the Department on August 4, 2005.
Samuel Miller & Sons, Inc, City of Lancaster, Lancaster County. Alternative Environmental Solutions, 930 Pointview Avenue, Suite 3, Ephrata, PA 17522, on behalf of Samuel Miller & Son, Inc, 220 Centerville Road, Lancaster, PA 17601, submitted a Final Report concerning the remediation of site soils and groundwater contaminated with chlorinated and other solvents and petroleum hydrocarbons. The Final Report demonstrated attainment of the Site Specific standard and was approved by the Department on August 11, 2005.
Hofmann Industries Facility, Sinking Spring Borough, Berks County. Synergy Environmental Inc., Center City Executive Centre, 607 Washington Street, Reading, PA 19601, on behalf of Hofmann Industries, Inc., 3145 Shillington Road, Sinking Spring, PA 19608, submitted a Final Report concerning remediation of site soils contaminated with metals. The final report demonstrated attainment of the residential Statewide Health standard, and was approved by the Department on August 12, 2005.
Stutzman Farm, South Heidelberg Township, Berks County. Aquaterra Technologies, Inc., 122 South Church Street, West Chester, PA 19381, on behalf of Sunoco, Inc., (R & M), Post Road and Blue Ball Avenue, P. O. Box 1135, Marcus Hook, PA 19061, submitted a Final Report concerning the remediation of groundwater and surface water contaminated with No. 2 fuel oil, leaded and unleaded gasoline. The final report demonstrated attainment of the residential Statewide Health standard, and was approved by the Department on July 28, 2005. Site soils will be addressed in a separate report. This corrects a notice that was published August 13, 2005.

Box 358, Chester WV 26034 has submitted a Final Report for the Main Site concerning the remediation of site soil and groundwater contaminated with VOCs, semi-VOCs, diesel fuel, No. 2 fuel oil, inorganics, leaded and unleaded gasoline, PAHs and PCBs. The Report is intended to document remediation of the site to meet the Statewide Health Standards. This is a correction of submission published at 35 Pa.B. 4656 (August 13, 2005).

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).
Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

3. A 410-foot long, 3.5-foot diameter RCP stream enclosure in a UNT to Franklin Lake located at Station 435+75, SR 43 (New Salem PA Quadrangle N: 19.02 inches; W: 8.75 inches; Latitude: 39° 58` 47"; Longitude: 79° 48` 45").
4. A 430-foot long, 3.0 foot diameter RCP stream enclosure in a UNT to Fourmile Run (WWF) located at Station 460+65, SR 43 (New Salem PA Quadrangle N: 19.98 inches; W: 10.39 inches; Latitude: 39° 59` 06"; Longitude: 79° 49` 27").
5. The project will impact 0.717 acre PEM wetlands.
