THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS

   This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a general permit. The applications concern, but are not limited to, discharges related to industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFOs). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

   For NPDES renewal applications in Section I, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements.

   For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 individual permits and individual stormwater construction permits in Sections IV and VI, the Department, based upon preliminary reviews, has made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications. These determinations are published as proposed actions for comments prior to taking final actions.

   Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).

   Persons wishing to comment on an NPDES application are invited to submit a statement to the regional office noted before an application within 30 days from the date of this public notice. Persons wishing to comment on a WQM permit application are invited to submit a statement to the regional office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

   The Department will also accept requests for a public hearing on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

   The receiving streams, West Branch of Chester Creek, and UNT to West Branch of Chester Creek are in the State Water Plan watershed 3G and are classified for: TSF, aquatic life, water supply and recreation. The nearest downstream public water supply intake for Media Borough Auxiliary Intake is located on Chester Creek and is 5.5 miles below the point of discharge (001).

   WQM Permit No. 3904407, Sewerage, Upper Saucon Township Municipal Authority, 5500 Camp Meeting Road, Center Valley, PA 18034-9444. This proposed facility is located in Upper Saucon Township, Lehigh County, PA.

   Description of Proposed Action/Activity: This project involves the construction of a sewage pump station to serve 72 lots in the Curly Horse Subdivision. Sewage will be conveyed for treatment to the Upper Saucon Township Municipal facility.

   WQM Permit No. 4004406, Sewerage, Hanover Township, Hanover Township Municipal Building, 1267 Sans Souci Parkway, Hanover Township, PA 18706. This proposed facility is located in Hanover Township, Luzerne County, PA.

   Description of Proposed Action/Activity: This project involves construction of a sewer collection system with two pumping stations that will serve the Hanover Crossings Industrial Park, Phase II.

   WQM Permit No. 5405401, Sewerage, West Mahanoy Township, 190 Pennsylvania Avenue, Shenandoah, PA 17976. This proposed facility is located in west Mahanoy Township, Schuylkill County, PA.

   Description of Proposed Action/Activity: This project consists of installation of a sanitary sewage collection, conveyance, and .037 mgd sewage treatment plant to serve Shenandoah Heights, Weston Place, Upper and Lower Brownsville, East and West William Penn, Lost Creek No. 2 and Lost Creek in West Mahanoy Township, Schuylkill County, PA.

   WQM Permit No. 4804202, Industrial Waste, Newstech PA, LP, 6 Horwith Lane, Northampton, PA 18067. This proposed facility is located in Northampton Township, Northampton County, PA.

   Description of Proposed Action/Activity: This project is for modification of the existing wastewater treatment plant to increase the design capacity from .504 mgd to 1.32 mgd.

CAFO Notices of Intent Received

   PAG123587 CAFO, Nevin Rutt, 524 North Garfield Road, Bernville, PA 19506. This proposed facility is located in Penn Township, Berks County.

   Description of Size and Scope of Proposed Operation/Activity: The Nevin Rutt Farm is an existing swine and steer operation with a total AEUs of 754.38. This farm currently operates a swine farrowing operation and finishing barn along with 100 head of beef steer. The gestation / breeding barn and the farrowing barn will be replaced with a new finishing floor. The operation will then be 100% wean to finish housing 5,000 finishing swine. The current steer phase of the operation will remain unchanged. The existing clay lined manure storage will remain in use for the existing finishing floor. A new below house slotted floor manure storage facility will be constructed with the new finishing barn. The new barn will handle the manure as a liquid stored in a 80 ft × 275 ft × 6 ft below house concrete manure storage facility with a useable storage of 740,520 gallons assuming 6 inches of freeboard below a one foot pit fan opening. The existing barn will continue to use the existing clay lined manure storage facility with a surface area of 0.36 acre and storage volume of 750,000 gallons. Of the 1,190,667 gallons of liquid manure generated from house 1 all of the manure will be exported from the farm. Of the 1,612,536 gallons of liquid manure generated from house 2 117,900 will be used on the farm and 1,494,636 will be exported from the farm. Of the 1,241 tons of solid beef manure generated 1,082.4 tons will be used on the farm and 158.6 tons exported from the farm.

   The receiving stream, UNT to Blue Marsh Lake is in watershed 3-C and classified for: WWF.

   The proposed effluent limits for the operation/activity include: Except for the chronic or catastrophic rainfall events defined as over the 25-year/24-hour rain storms, the CAFO general permit is a non-discharge NPDES permit. Where applicable, compliance with 40 CFR Federal effluent limitation guidelines is required. The general permit requires no other numeric effluent limitations and compliance with the Pennsylvania Nutrient Management Act and the Clean Stream Law constitutes compliance with the state narrative water quality standards.
