Department of Labor and Industry--General Provisions; Regulation No. 12-67 (#2484)

   On June 27, 2005, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Department of Labor and Industry (Department). This rulemaking amends 34 Pa. Code Chapter 121. The proposed regulation was published in the July 9, 2005 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on May 21, 2007.

   This final-form rulemaking updates and clarifies administrative procedures followed by employees, employers and insurers in their transactions with the Bureau of Workers' Compensation.

   We have determined this regulation is consistent with the statutory authority of the Department (77 P. S. §§ 710 and 991(a)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Pennsylvania Gaming Control Board--Accounting and Internal Controls; Slot Computer Systems; Commencement of Slot Operations; Regulation No. 125-49 (#2581)

   On October 25, 2006, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Pennsylvania Gaming Control Board (Board). This rulemaking adds 58 Pa. Code Chapters 465a, 466a and 467a and amends Chapter 461a. The proposed regulation was published in the December 2, 2006 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on May 17, 2007.

   This final-form regulation establishes three chapters of the Board's regulations. The chapters relate to accounting controls and audits, slot machine computer systems and the commencement of slot operations. The rulemaking also adds definitions to an existing chapter of the Board's regulatios.

   We have determined this regulation is consistent with the statutory authority of the Board (4 Pa.C.S.A. §§ 1202(b)(30), 1207, 1322 and 1520) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Department of Revenue--Pennsylvania Gaming Cash Flow Management; Regulation No. 15-436 (#2596)

   On February 21, 2007, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Department of Revenue. This rulemaking adds 61 Pa. Code Chapter 1001. The proposed regulation was published in the March 3, 2007 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on May 25, 2007.

   This final-form rulemaking establishes the procedures for the administration and distribution of all net slot machine revenue, collection of tax and collection of other assessments under the Pennsylvania Race Horse Development and Gaming Act (4 Pa.C.S.A. §§ 1101--1904).

   We have determined this regulation is consistent with the statutory authority of the Department (4 Pa.C.S.A § 1501(a)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
