MILK MARKETING BOARD

Hearing and Prehearing Conference for All Milk Marketing Areas; Over-Order Premium

   Under the Milk Marketing Law (31 P. S. §§ 700j-101--700j-1302), the Milk Marketing Board (Board) will conduct a public hearing for Milk Marketing Areas 1--6 at a date, time and location to be determined, to consider the scope and expansion of the over-order premium.

   The purpose of the hearing will be to receive testimony and exhibits concerning the establishment of a Class I over-order price or pricing formula for milk produced in this Commonwealth, processed in this Commonwealth and that is utilized in this Commonwealth or in a contiguous state with a state-mandated over-order price.

   The staff of the Board is deemed to be a party to this hearing, and the attorney representing staff is deemed to have entered his appearance. Other persons who wish to present evidence may be included on the Board's list of parties by: (1) having their attorney file with the Board on or before 12 p.m. on September 17, 2007, a notice of appearance substantially in the form prescribed by 1 Pa.  Code § 31.25 (relating to form of notice of appearance); or (2) if unrepresented by counsel, filing with the Board on or before 12 p.m. on September 17, 2007, notification of their desire to be included as a party. Parties should indicate in their notices of appearance if alternate means of service, that is, e-mail or fax, are acceptable.

   The Board will hold a prehearing conference on September 18, 2007, at 1:15 p.m. in Room 202 of the Agriculture Building, 2301 North Cameron Street, Harrisburg, PA. The purpose of the prehearing conference will be to discuss a protective order regarding confidential or proprietary information that may be used to develop exhibits or testimony that will be presented at the hearing. The parties should also be prepared to discuss the meaning of the term ''utilized'' as in ''utilized in this Commonwealth or in a contiguous state with a state-mandated over-order price.''
