Application of Art Institutes International, LLC for Approval of an Internal Restructuring without Change to the Scope of Degree-Granting Authority

Notice of Opportunity for Hearing and Invitation
to Protest

   Under 24 Pa.C.S. § 6503(e) (relating to certification of institutions), the Department of Education (Department) will consider the application of The Art Institutes International, LLC (Aii, LLC) to have a Certificate of Authority approving its internal reorganization without changes to the scope of its degree-granting authority. By means of the authority under 24 Pa.C.S. § 6503(e), the Secretary may impose specific conditions on the approval of a certificate of authority, which in this case would mean that Aii, LLC would operate each of its Pennsylvania-based colleges as a limited liability company. Thus, action by the Secretary on this application would be to: approve the revised Certificate of Organization for Aii, LLC, approve the Certificate of Organization for the Art Institute of Pittsburgh, LLC (AiP, LLC) and approve the Certificate of Organization for the Art Institute of Philadelphia, LLC (AiPH, LLC). Because the Art Institute of Pittsburgh operates the company's online division, the Certificate of Organization for AiP, LLC includes operation of 'The Art Institute of Pittsburgh--Online Division' and its URL www.aionline.edu.

   In accordance with 24 Pa.C.S. § 6503(e), the Department will act upon these items without hearing, unless within 30 days after the publication of this notice in the Pennsylvania Bulletin a written request for public hearing is filed with the Department, along with a notice of intervention, a petition to intervene or protest in accordance with 1 Pa. Code §§ 35.23 and 35.24 (relating to protest) or 1 Pa. Code §§ 35.27--35.32 (relating to intervention).

   Petitions to intervene, protest and request for hearing shall be filed with Carol M. D. Gisselquist, Higher Education Specialist (717) 787-4448, 333 Market Street, Harrisburg, PA 17126-0333 on or before 4 p.m. on the due date prescribed by this notice. Persons wishing to review the application should phone or write to the aforementioned office to schedule a time for an in-office review. Duplicate copies of the application are not available.

   Persons with a disability who wish to attend the hearing, if held, and require an auxiliary aid, service or other accommodation to participate contact Carol Gisselquist at (717) 787-4448 to discuss how the Department may best accommodate their needs.
