Administrative Order

And Now, this 17th day of June, 2011, the Pennsylvania Commission on Crime and Delinquency having reviewed and certified that the Countywide Booking Center Plan developed by Philadelphia County complies with 42 Pa.C.S. § 1725.6, a Countywide Booking Center is adopted in Philadelphia County with ''LiveScan/CPIN'' sites located at:

 1. South Division CCTV (1st District)

 2. Central Division CCTV (9th District)

 3. Northeast Division CCTV (15th District)

 4. Southwest Division CCTV (18th District)

 5. East Division CCTV (25th District)

 6. North Division CCTV (35th District)

 7. 22nd District

 8. 8th & Race St. PDU ''A''

 9. 8th & Race St. PDU ''B''

 10. Records & Identification Unit

 11. Criminal Justice Center

and/or any other locations as may be provided from time to time.

It Is Further Ordered, Adjudged and Decreed as follows:

 a) the Clerk of Court shall assess, in accordance with 42 Pa.C.S. § 1725.5, a Booking Center Fee in the amount of $175.00 against any person processed through a Philadelphia County Booking Center who is:

 (1) placed on probation without verdict pursuant to Section 17 of the Act of April 14, 1972 (P. L. 223, No. 64), known as The Controlled Substance, Drug, Device, and Cosmetic Act; or

 (2) receives Accelerated Rehabilitative Disposition for, pleads guilty or nolo contendere to, or is convicted of a crime under the following:

 i. 18 Pa.C.S. § 106(a) (relating to classes of offenses);

 ii. 75 Pa.C.S. § 3735 (relating to homicide by vehicle while driving under the influence);

 iii. 75 Pa.C.S. § 3802 (relating to driving under the influence of alcohol or controlled substance); and

 iv. A violation of The Controlled Substance, Drug, Device, and Cosmetic Act.

 The Booking Center Fee, however, shall not be assessed against Defendants whose cases are dismissed, withdrawn or nolle prossed by the Commonwealth.

 (b) The Booking Center Fee shall be deposited into a designated central booking fee account established for Philadelphia County, shall be used solely for the implementation of Philadelphia County's Countywide Booking Center Plan, and funds within this special account shall be appropriated and distributed as specifically set forth in the Countywide Booking Center Plan.

 This Order shall be effective for defendants processed on or after December 16, 2010.

 The original Administrative Order shall be filed with the Prothonotary in a docket maintained for Administrative Orders issued by the President Judge of the Court of Common Plea. Two certified copies of this Administrative Order, and an electronic copy on a computer diskette, shall be distributed to the Legislative Reference Bureau for publication in the Pennsylvania Bulletin. One certified copy of this Administrative Order shall be filed with the Administrative Office of Pennsylvania Courts and posted on the First Judicial District's website at http://courts. phila.gov. Copies of this Administrative Order shall be published in The Legal Intelligencer and will be submitted to American Lawyer Media, Jenkins Memorial Law Library, and the Law Library for the First Judicial District of Pennsylvania.
