Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1—1396.31); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301—3326); the Clean Streams Law (35 P. S. §§ 691.1—691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51—30.66); the Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1—1406.21). The final action on each application also constitutes action on the NPDES permit application and, if noted, the request for a Section 401 Water Quality Certification. FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704.  This permit gives the permittee consent to construct, operate and maintain a pedestrian walkway along Sandy Lick and bridge across the same watercourse for public access and use. The public pedestrian walkway shall be constructed with a bituminous pavement wearing surface, maximum width of 5-feet and length of 805-feet. The prefabricated public pedestrian bridge shall be constructed with a minimum width of 6-feet, span of 118 and underclearance of 6.5-feet. No in-stream construction activities shall be performed for construction of the pedestrian walkway or bridge. The public walkway project is located along the western right-of-way of SR 0219, approximately 525-feet south of Montgomery Avenue and SR 0219 intersection. The public bridge project is located along the western right-of-way of Shaffer Road approximately 1390-feet south of SR 0255 and Shaffer Road intersection.

ENVIRONMENTAL ASSESSMENTS

Northcentral Region: Program Manager, Waterways & Wetlands Program, 208 West Third Street, Williamsport, PA 17701

EA17-012. Pike Township Supervisors, P. O. Box 219, Curwensville, PA 16833. Site Reclamation and Acid Mine Drainage Treatment Project in Bloom Township, Clearfield County, ACOE Baltimore District (Luthers-burg, PA Quadrangle Latitude: 41° 1` 33"; Longitude: -78° 38` 21").

 The applicant proposes to re-grade, neutralize and vegetate acidic mine spoil; backfill an abandoned coal mine high wall; and construct an active treatment system for acid mine drainage. This system will treat three existing acid mine drainage seeps currently discharging to an unnamed tributary to Anderson Creek. This project will permanently impact 0.01 acre of wetland and 845.8 linear feet of stream through construction activities involved with spoil removal and collecting/treating the drainage seeps. Mitigation for wetland and stream impacts will be achieved through water quality improvements to the Anderson Creek watershed. This approval under Chapter 105, Section 105.12(a)(16) also includes 401 Water Quality Certification.

Notice of Planning Grant Awards Under Section 901 of the Municipal Waste Planning Recycling and
Waste Reduction Act of 1988, Act 101

 The Department of Environmental Protection (DEP) hereby announces the following grants to counties pursuant to the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101, P. L. 556, Section 901 and Section 208 of the Waste Tire Recycling Act/Small Business and Household Pollution Prevention Act (Act 190 of 1996).

 Planning grants are awarded to counties for 80% of approved costs for preparing municipal waste management plans as required by Act 101, for carrying out related studies, surveys, investigations, inquiries, research and analysis, including those related to siting, environmental mediation, education programs on pollution prevention and household hazardous waste and providing technical assistance to small businesses for pollution prevention. Grants may be awarded for feasibility studies and project development for municipal waste processing or disposal facilities, except for facilities for the combustion of municipal waste that are not proposed to be operated for the recovery of energy. All grant awards are predicated on the receipt of recycling fees required by Sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.

Draft Hazardous Permit

Public Hearing Notice and Notice of Intent to Issue A Hazardous Waste Permit

 The Department of Environmental Protection intends to issue to Bethlehem Apparatus Company, Inc. a Solid Waste Management Act Permit. This draft permit is to expand the Hazardous Waste facility located in the City of Bethlehem to include the adjacent building at 945 Bethlehem Drive. The Bethlehem facility of Bethlehem Apparatus is primarily a treatment and storage facility for mercury. The new building which will be used primarily for storage and decanting will contain one storage area with the capacity to store up to two thousand 55-gallon drums.

 The public will be given 45 days to comment on the draft permit prepared under the Solid Waste Management Act. The comment period will begin on March 22, 2013, and will end on May 6, 2013. Any person interested in commenting on the application or draft permit must do so within this comment period. Copies of the application, draft permit and fact sheet for the Hazardous Waste Facility may be reviewed at the Department of Environmental Protection, Bethlehem District Office at 4530 Bath Pike (Route 512), Bethlehem, PA 18017.  When making a determination regarding the issuance of the hazardous waste permit modification to Bethlehem Apparatus Company, Inc., the Department of Environmental Protection will consider all written comments received during the comment period, the requirements of the hazardous waste regulations of 25 Pa. Code Chapters 260—270, and the Department of Environmental Protection's permitting policies.

Public Hearing Notice and Notice of Intent to Issue a Hazardous Waste Permit

 The Department of Environmental Protection intends to issue to Tobyhanna Army Depot (TYAD) a Solid Waste Management Act Permit. This permit is a renewal of the permit to operate a Hazardous Waste storage facility in Coolbaugh Township, Monroe County. The renewed permit will allow the existing Facility to remain in operation for another 10 years. This permit does not authorize any processing, treatment, or disposal of waste at this facility. The existing HW Storage Facility receives and temporarily stores approved hazardous and residual (non-hazardous) wastes prior to off-site disposal or other disposition. The storage takes place in Department of Transportation compliant containers within secondary containment at the Building H-56. The Facility receives wastes generated by the Tobyhanna Army Depot except as the Department may authorize emergency acceptance of off-site Department of Defense wastes. The approved site-generated waste types include hazardous waste streams, PCB-contaminated wastes, asbestos, and ''universal wastes'' including batteries, lamps and mercury-containing devices.

 The public will be given 45 days to comment on the draft permit, issued March 22, 2013 and prepared under the Solid Waste Management Act. The comment period will begin on March 22, 2013 and will end on May 6, 2013. Any person interested in commenting on the application or draft permit must do so within this comment period. Notice of Settlement of NPDES Permit Appeal under 25 Pa. Code § 92a.88

Jordan v. DEP; EHB Docket Nos. 2009-046 and 2010-138

NPDES Permit No. PAIO-11508070, Post-Construction Storm Water Management, West Pikeland Township, 1645 Art School Road, Chester Springs, PA 19425.

 On April 3, 2009, the Department issued NPDES Permit No. PAIO-11508070 to West Pikeland Township for post-construction storm water discharges associated with construction of an athletic field in Pine Creek Park, West Pikeland Township, Chester County, PA. Mr. Henry and Mrs. Barbara Jordan (''Appellants'') filed an appeal of this Permit with the Environmental Hearing Board. In addition, pursuant to the request of West Pikeland Township, the Department, through the Chester County Conservation District, approved a Notice of Termination of this Permit on August 25, 2010. Mrs. Barbara Jordan also appealed this Notice of Termination to the Environmental Hearing Board.

 The Parties have entered into a Settlement Agreement which includes withdrawal of the two appeals identified above. As part of the Settlement Agreement, West Pikeland Township has submitted, and the Department has approved, revisions to the NPDES Permit identified above.

 Description of Revisions: The Township will replace an existing infiltration basin located immediately down-gradient (south) of the athletic field with two smaller Bio-Retention Facilities intended to capture and infiltrate storm water runoff. In addition, infiltration trenches shall be installed under existing, vegetated swales in order to upgrade and improve storm water management around the athletic field.

 The receiving stream is Pine Creek in Chester County (State Water Plan watershed 3D) and is classified for HQ-CWF.

DRINKING WATER STATE REVOLVING FUND SPECIAL NOTICE

Description: The Pennsylvania Infrastructure Investment Authority, which administers the Commonwealth's State Revolving Fund, is intended to be the funding source for this project. Rural Valley Water Works proposes to replace approximately 4,600 feet of old, deteriorated asbestos-cement water line along South Water Street, Shannock Avenue, Pine Valley Drive and Washington Avenue (Bryan Road). Nine (9) new fire hydrants and new service taps will be provided. Additionally, a chlorine analyzer will be added at the plant and programming for the existing SCADA system will be upgraded.

 The Department's review of the project and the information received has not identified any significant, adverse environmental impact resulting from this proposal. The Department hereby categorically excludes this project from the State Environmental Review Process.
