Availability of Technical Guidance

 Technical guidance documents are available on the Department of Environmental Protection's (Department) web site at www.elibrary.dep.state.pa.us. The ''Technical Guidance Final Documents'' heading is the link to a menu of the various Department bureaus where each bureau's final technical guidance documents are posted. The ''Technical Guidance Draft Documents'' heading is the link to the Department's draft technical guidance documents.

Ordering Paper Copies of Department Technical Guidance

 The Department encourages the use of the Internet to view and download technical guidance documents. When this option is not available, persons can order a paper copy of any of the Department's draft or final technical guidance documents by contacting the Department at (717) 783-8727.

 In addition, bound copies of some of the Department's documents are available as Department publications. Check with the appropriate bureau for more information about the availability of a particular document as a publication.

 Following is the current list of recent changes. Persons who have questions or comments about a particular document should call the contact person whose name and phone number is listed with each document.

Final Technical Guidance—Substantive Revision

DEP ID: 563-2504-001. Title: Conventional Bonding for Land Reclamation—Coal. Description: The purpose of this document is to provide guidance to describe the regulatory and statutory requirements for determining bond amounts. It also establishes bond rates and the process for determining the bond for land reclamation. The document was revised to include the procedures for bonding sites where the operator wants to delay activation and to change the frequency of the bond liability review form annually to upon permit renewal, with an option to review the liability during the permit mid-term. The Department calculated the rate of inflation using the Consumer Price Index (Northeast Urban) from the United States Department of Labor, Bureau of Labor Statistics, averaged for the calendar years 2009-2013, resulting in a rate of 1.67%. This rate of inflation will be used in calculating bond amounts for permit renewal or permit mid-term bond liability reviews from April 5, 2014, through April 4, 2015. This guidance was published as draft in the Pennsylvania Bulletin for a 30-day comment period from November 10, 2012, through December 9, 2012. Nine comments were received from three commentators. Revisions to the draft technical guidance document resulting from the public comments are described in an accompanying Comment-Response Document.

Draft Technical Guidance—New Guidance

DEP ID: 385-2314-002. Title: Act 537 Guidance; Sewage Enforcement Officer Certification and Training. Description: The purpose of this document is to establish and provide guidance for a Sewage Enforcement Officer (SEO) certification and training program that will produce a knowledgeable and skilled SEO community.

Written Comments: The Department is seeking comments on this draft technical guidance document by Monday, May 5, 2014. Comments submitted by facsimile will not be accepted. The Department will accept comments submitted to jdiehl@pa.gov. A return name and address must be included in each e-mail transmission.
