Proposed State Implementation Plan Revision; Attainment Demonstration for the Warren Nonattainment Area for the 2010 Sulfur Dioxide National Ambient Air Quality Standard; Public Hearing

 The Department of Environmental Protection (Department) is seeking public comment on a proposed State Implementation Plan (SIP) revision which demonstrates how the Warren nonattainment area will attain the 2010 1-hour Federal National Ambient Air Quality Standard (NAAQS) for sulfur dioxide (SO2). Short-term exposure to SO2 has been linked to adverse respiratory conditions in humans.

 On June 22, 2010, the United States Environmental Protection Agency (EPA) promulgated a revised primary NAAQS for SO2 of 75 parts per billion, which went into effect on August 23, 2010. See 75 FR 35520 (June 22, 2010). On August 5, 2013, the EPA designated four areas in this Commonwealth as nonattainment for the 2010 1-hour SO2 NAAQS, including the Warren nonattainment area. See 78 FR 47191 (August 5, 2013). These nonattainment designation areas were effective on October 4, 2013. See 78 FR 47191, 47192. The political subdivisions encompassing the Warren nonattainment area include: Conewango Township, Glade Township, Pleasant Township and the City of Warren. Section 192(a) of the Clean Air Act (CAA) (42 U.S.C.A. § 7514a(a)) requires SO2 nonattainment areas to attain the 2010 NAAQS as expeditiously as practicable, but no later than 5 years from the effective date of the EPA's 2013 designations, which is October 4, 2018.

 The proposed SIP revision meets the requirements necessary for an approvable SIP revision as set forth in sections 110, 172 and 191 (42 U.S.C.A. §§ 7410, 7502 and 7514), section 192 of the CAA and 40 CFR 51.102 (relating to public hearings), including a base year emission inventory, reasonable further progress toward attainment, reasonably available control measures/technology, dispersion modeling demonstrating attainment in 2018, approved New Source Review Program and contingency measures. To this effect, the Department has drafted a Consent Order and Agreement (COA) with United Refining Company to incorporate control measures, emission limits and contingency measures applicable to the facility into a Federally enforceable vehicle. Provisions of the COA not included in the SIP revision for Federal approval have been redacted. After consideration of comments received from the public, the SIP revision will be finalized and submitted to the EPA for approval.

 The Department will hold a public hearing to receive comments on the proposal on August 2, 2017, at 10 a.m. at the Department's Warren District Office, 321 North State Street, North Warren, PA 16365. Persons wishing to present testimony should contact the Department no less than 24 hours in advance of the public hearing to reserve a time. Speakers will be limited to 10 minutes and should provide two written copies of their comments.
