Department of Transportation Publication 282—Review of Classification of Section 2.2

 Under section 7.1 of the Regulatory Review Act (71 P.S. § 745.7a) and 1 Pa. Code § 315.2 (relating to review of an unpublished document), the Joint Committee on Documents met on December 14, 2017, to review section 2.2 of Department of Transportation Publication 282 to determine if this section should be promulgated as a regulation.

 The following order was approved in a 7-3-1 (yes; no; abstain) vote.

Order

In Favor of Petitioner Independent Regulatory Review Commission

 Pursuant to section 7.1 of the Regulatory Review Act, as amended June 25, 1997 (P.L. 252, 273, No. 24), 71 P.S. § 745.7a (2012), the Joint Committee on Documents:

 1. Determines that the statement published by the Department of Transportation (Department) in section 2.2 of the Highway Occupancy Permit Operations Manual (Publication 282, July 2017) that declares the Department's practice to accept an application for a highway occupancy permit from the owner of the property or from another person with a legal or specified equitable interest in the property should be promulgated as a regulation.

 2. Orders the Department to either:

 within 180 days promulgate the statement declaring the Department's practice to accept an application for a highway occupancy permit from the owner of the property or from another person with a legal or specified equitable interest in the property as a regulation, with final publication in the Pennsylvania Bulletin by June 9, 2018; or

 desist from the Department's practice of accepting an application for a highway occupancy permit from a person other than the fee owner of the property or the tenant in a lease that will not terminate within 15 years of the permit issuance date.
