State Board of Social Workers, Marriage and Family Therapists and
Professional Counselors Regulation # 16A-6922 (IRRC # 3196)

Licensed Bachelor Social Worker; Fees

April 11, 2018

We submit for your consideration the following comments on the proposed rulemaking published in the February 10, 2018 Pennsylvania Bulletin. Our comments are based on criteria in Section 5.2 of the Regulatory Review Act (71 P.S. § 745.5b). Section 5.1(a) of the Regulatory Review Act (71 P.S. § 745.5a(a)) directs the State Board of Social Workers, Marriage and Family Therapists and Professional Counselors (Board) to respond to all comments received from us or any other source.

Miscellaneous.

Section 47.15 (a)(5) references ''a late fee required by § 47.4. . . .'' In reviewing the existing language and the Board's proposed amendments to Section 47.4, we could not identify a section pertaining to late fees. In the final-form regulation, the Board should clarify this reference by amending Section 47.4 to include late fees as authorized under 63 P.S. § 1401-225. We believe it is beneficial to the regulated community to have all fees associated with licensure, renewal and reactivation located in one place.
