FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483.  The Pennsylvania Department of Transportation (PennDOT) is proposing to perform the below listed water obstruction and encroachment activities associated with the SR 3095, Section BCR Brandywine Creek Road Slope Stabilization Project:

 1) To place and maintain riprap rock channels in three (3) locations along the West Branch of the Brandy Wine Creek (WWF) associated with the construction of three (3) roadway drainage outfalls resulting in a total of 433 square feet of permanent floodway impact and 448 square feet of temporary floodway impacts. Stream impacts associated with this activity also include 30.2 linear feet (286 square feet) of permanent stream impact and 16 linear feet (274 square feet) of temporary stream impact.

 2) To stabilize, protect and maintain rock slope stream bank protection and a series of rock vanes along and within the West Branch of the Brandy Wine Creek (WWF) resulting in 9,900 square feet of permanent floodway impacts and 16,053 square feet of temporary floodway impacts. Stream impacts associated with this activity include 345.35 linear feet (6,427 square feet) of permanent stream impacts and 471.15 linear feet (11,803 square feet) of temporary stream impacts.

 This project lies within the Lower Brandywine Creek Scenic River Corridor System and is located on Brandywine Creek Road south of Harvey Bridge Road in Newlin, Chester County (USGS PA Coatesville; Unionville Quadrangle—Latitude: 39.931968 N, Longitude: 75.747761 W).

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

E23-546. AG-RW Edgmont Parent, LLC, 25 A Hanover Road, Suite 310, Florham Park, NJ, 07932, Edgemont Township, Delaware County, ACOE Philadelphia District.

 To construct and maintain a residential development associated with the construction of 166 dwellings subdivision a.k.a. the Edgemont Preserve, impacting approximate 0.482 acre of the 100-year of the assumed floodway of Plumock Run, .03645 of permanent wetland impact, five utility line stream crossing and one outfall structure.

Notice of Proposed Revision to the State Implementation Plan for Oxides of Nitrogen, Volatile Organic Compounds, and Notice of Public Hearing for the Revised Air Quality Operating Permit 46-00011

 Approval of a Reasonably Available Control Technology (Alternate RACT II) plan for Arcelormittal Plate LLC Company located in Plymouth Township, Montgomery County.

 In accordance with 25 Pa. Code §§ 129.96—129.100, the Pennsylvania Department of Environmental Protection has made a determination for an alternate RACT II plan and seeks approval of the amendment to the State Implementation Plan (SIP) for the Steel manufacturing facility/blast furnaces owned and operated by Arcelormittal Plate LLC Company located in Plymouth Township, Montgomery County.

 The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT II approval for the facility, which are intended to satisfy the requirements for the 1997 National Ambient Air Quality Standard (NAAQS) and the 2008 NAAQS for ozone.

 The proposed amendments to the RACT II determination have been incorporated into this revised operating permit 46-00011 for the facility. After the public participation requirements of 40 CFR 51.102 are met, including that public hearings to be held on the dates and at the location advertised below, the relevant RACT II requirements will be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded and/or redacted from the SIP submittal.

It incorporates the provisions and requirements contained in the amended RACT II approval for the facility, which are intended to satisfy the requirements for the 1997 National Ambient Air Quality Standard (NAAQS) and the 2008 NAAQS for ozone.

 The proposed amendments to the RACT II determination, have been incorporated into this revised operating permit 09-00016 for the facility. After the public participation requirements of 40 CFR 51.102 are met, including that public hearings to be held on the dates and at the location advertised below, the relevant RACT II requirements will be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded and/or redacted from the SIP submittal.

(a). The capacity factor for this turbine shall not exceed 20% in any consecutive 12-month rolling period. The capacity factor is defined as the ratio of net electrical power generation, in megawatt hours (MWH), for the last twelve (12) months to the maximum capacity of the unit (MW) times the number of hours
in the same twelve (12) months.

(b). The rolling 12-month capacity factor is expressed in the following formula:

(5). Monthly NOx emissions calculated using the emission factors from the most recent stack test result;

Notice of Proposed Revision to the State Implementation Plan for Oxides of Nitrogen, Volatile Organic Compounds, and Notice of Public Hearing for the Revised Air Quality Operating Permit 23-00003

 Approval of a Reasonably Available Control Technology (Alternate RACT II) plan for Monroe Energy, LLC located in Trainer Borough, Delaware County.

 In accordance with 25 Pa. Code §§ 129.96—129.100, the Pennsylvania Department of Environmental Protection has made a determination for an alternate RACT II plan and seeks approval of the amendment to the State Implementation Plan (SIP) for the petroleum refinery owned and operated by Monroe Energy, LLC in Trainer Borough, Delaware County.
