Federal Consistency under the Coastal Zone Management Act; Maintenance Dredging at Fort Mifflin Terminal

 This notice is published under section 306(d)(14) of the Federal Coastal Zone Management Act of 1972 (16 U.S.C.A. § 1455(d)(14)), regarding public participation during consistency determinations. The Department of Environmental Protection (Department), Coastal Resources Management Program has received notice that Sunoco Partners Marketing and Terminals (applicant) is proposing to conduct maintenance dredging activities at the Fort Mifflin Terminal in Tinicum Township.

 The applicant is proposing to conduct maintenance dredging at the Fort Mifflin Terminal under the authorization of a United States Army Corps of Engineers (USACE) 10-Year Maintenance Dredging Permit (CENAP-OP-R-2017-00207-75). The berthing areas of Docks A and B will be mechanically dredged with a closed clamshell bucket to a depth of no greater than 42 feet (40 feet plus 2 feet of allowable overdredge) below mean low water. Approximately 47,000 cubic yards of material will be removed per dredge event and a total of up to 235,000 cubic yards will be removed over the duration of the 10-year USACE permit. Dredged material will be placed at either White's Basin or Biles Islands disposal facilities.

 This project is subject to Department review for Federal consistency because it is a Federal license and permit activity and will have reasonably foreseeable effects on the Commonwealth's coastal resources or uses.

 In accordance with National Oceanic and Atmospheric Administration (NOAA) regulations in 15 CFR Part 930, Subpart D (relating to consistency for activities requiring a Federal license or permit), the applicant has certified that the proposed activity will be conducted in a manner consistent with the applicable enforceable policies of the Commonwealth's NOAA-approved Coastal Resources Management Program. Interested parties may request a copy of the Federal Consistency Certification from the Department contact listed as follows.

 The Department will consider all comments received on or before November 26, 2018, before issuing a final Federal consistency concurrence or objection.
