Findings

 Under section 2002(b) of The Administrative Code of 1929 (71 P.S. § 512(b)) establishing the Department of Transportation (Department), the Acting Director of the Bureau of Project Delivery, as delegated by the Secretary of Transportation, makes the following written findings:

 The Department is planning the following listed projects. Environmental and Section 4(f) Documentation have been developed for the following identified projects to evaluate the potential environmental impacts caused by these projects. The Section 4(f) documents also serve as the Section 2002 Evaluation. The approved documents are available in the CE/EA Expert System at http://www.dotdom2.state.pa.us/ceea/ceeamain.nsf. The environmental, economic, social and other effects of the proposed projects have been considered. Based upon studies, there is no feasible and prudent alternative to the use of the Section 2002 resources for the proposed identified projects, and all reasonable steps have been taken to minimize such effects.

• SR 7214, Section BR—East Hempfield Township, Lancaster County.

Project Description: The project is the removal of the bridge that formerly carried Holland Street (T-373) over the Amtrak Keystone Corridor.

Environmental Documents: CE 2 Evaluation approved on April 5, 2019, and a Nationwide/Programmatic Section 4(f) Evaluation for Projects that Necessitate the Use of Historic Bridges approved on March 8, 2019.

Proposed Use of Section 4(f)/2002 Resource: The Amtrak line is the former Pennsylvania Railroad Main Line, which was determined to be eligible for listing on the National Register of Historic Places (NRHP). The Holland Street Bridge is considered a contributing element to the Pennsylvania Railroad Main Line.

• SR 0220, Section 122—Woodward and Piatt Townships, Lycoming County.

Project Description: The project involves safety improvements along a 6.1-mile stretch of SR 0220, the rehabilitation of the bridge that carries SR 0220 over Larrys Creek, and the construction of stormwater retention basins.

Environmental Documents: CE 1b Reevaluation approved on April 22, 2019, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on April 16, 2019.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.38-acre of right-of-way (ROW) will be required from the Woodward Township Elementary School, which was determined to be eligible for listing on the NRHP.

• SR 7015, Section 021—Upper Oxford Township, Chester County.

Project Description: The project is the replacement of Chester County Bridge No. 21 that carries Watermark Road over Muddy Run. Minor approach work and guide rail updates will also be completed.

Environmental Documents: CE 1b Evaluation approved on May 14, 2019, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on April 30, 2019.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.011-acre of ROW will be required from the 13.5-acre Coates Farm Property, which was determined to be eligible for listing on the NRHP.

• SR 4011, Section A16—Town of McCandless, Allegheny County.

Project Description: The project is the remediation of two separate landslide locations along SR 4011.

Environmental Documents: CE 1b Evaluation approved on May 21, 2019, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Public Parks, Recreation Areas, Wildlife and/or Waterfowl Refuges, State Forest Land and State Game Land approved on May 3, 2019.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.446-acre of ROW will be required from Wall Park, which qualifies as a Section 4(f)/2002 resource.

• SR 7410, Section BRG—Parkesburg Borough, Chester County.

Project Description: The project is the replacement of the West Bridge Street Bridge (SR 7410) over Amtrak and Norfolk Southern Railroad.

Environmental Documents: CE 1b Reevaluation approved on May 24, 2019, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on April 25, 2019.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.0309-acre of ROW will be required from the Pennsylvania Railroad Main Line (Philadelphia to Harrisburg), which was determined to be eligible for listing on the NRHP.

• SR 0501, Section 029—Myerstown Borough, Lebanon County.

Project Description: The project is the replacement of the bridge carrying South College Street (SR 0501) over Tulpehocken Creek.

Environmental Documents: ED 1b Evaluation approved on June 6, 2019, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Public Parks, Recreation Areas, Wildlife and/or Waterfowl Refuges, State Forest Land and State Game Land approved on April 15, 2019.

Proposed Use of Section 4(f)/2002 Resource: Approximately 0.034-acre of ROW will be required from the 14.28-acre Myerstown Borough Park property, which qualifies as a Section 4(f)/2002 resource.

• SR 0322, Section DOW—Downingtown Borough, Chester County.

Project Description: The project is the rehabilitation of the Lancaster Avenue Bridge carrying SR 0322 over the East Branch of the Brandywine Creek.

Environmental Documents: CE BRPA Evaluation approved on June 19, 2019, a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Public Parks, Recreation Areas, Wildlife and/or Waterfowl Refuges, State Forest Land and State Game Land approved on February 11, 2019, a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on May 15, 2019, and a Section 4(f) Non-Applicability/No-Use approved on March 19, 2019.

Proposed Use of Section 4(f)/2002 Resource: An aerial easement of 0.003-acre will be required from the 45-acre Kerr Park. Approximately 15.2-linear feet will be required for an aerial easement from the 38-mile Brandywine Trail. Both Kerr Park and the Brandywine Trail qualify as Section 4(f)/2002 resources. An aerial easement of approximately 0.0148-acre will be required from the Downingtown Log House, which is listed on the NRHP. Approximately 0.0148-acre will be required for an aerial easement from the East Lancaster Avenue Historic District, which is listed on the NRHP.

• SR 2030, Section 006—Lower Paxton and West Hanover Townships, Dauphin County.

Project Description: The project is the replacement of the bridge carrying Blue Ridge Avenue (SR 2030) over Beaver Creek.

Environmental Documents: ED BRPA Evaluation approved on June 19, 2019, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on May 30, 2019.

Proposed Use of Section 4(f)/2002 Resource: Approximately 0.089-acre of ROW will be required from the Backenstos-Reist Farm, which was determined to be eligible for listing on the NRHP. A permanent channel easement of 0.018-acre and a permanent slope easement of 0.009-acre will also be required.
