STATE CONSERVATION COMMISSION

PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed (National Pollutant Discharge Elimination System) NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described. These NMPs are published as proposed plans for comment prior to taking final actions. The NMPs are available for review at the CCD office for the county where the agricultural operation is located. A list of CCD office locations is available at http://www.nacdnet.org/about/districts/directory/pa.phtml or can be obtained from the SCC at the office address listed or by calling (717) 787-8821.

 Persons wishing to comment on an NMP are invited to submit a statement outlining their comments on the plan to the CCD, with a copy to the SCC for each NMP, within 30-days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the NMPs. Comments should include the name, address and telephone number of the writer and a concise statement to inform the SCC of the exact basis of the comments and the relevant facts upon which they are based. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 1


Acknowledgment of Notices of Intent to Remediate Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

 Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent (NOI) to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a (NOI) to Remediate with the Department. A NOI to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

 Under Sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the NOI to Remediate is published in a newspaper of general circulation in the area of the site. For the following identified site(s), proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30-days of the following specified date. During this comment period the municipality may request that the following identified person, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

 For further information concerning the content of a NOI to Remediate, please contact the Environmental Cleanup Program Manager in the Department of Environmental Protection Regional Office under which the notice appears. If information concerning this acknowledgment is required in an alternative form, contact the Community Relations Coordinator at the appropriate Regional Office listed. Parkwood Fill Site, Dunks Ferry Road and Mechanicsville Road, City of Philadelphia, Philadelphia County. Jennifer L. Gresh, P.G., Duffield Associates, Inc., 211 North 13th Street, Suite 702, Philadelphia, PA 19107 on behalf of Daniel Harkins, Philadelphia Department of Public Property, City Hall-Room 784, Philadelphia, PA 19107 submitted a Notice of Intent to Remediate. Soil at the site has been contaminated with inorganics, VOCs, SVOCs, PCBs, and pesticides. The proposed future use of the property will be residential. The proposed cleanup standard for the site is the Statewide Health Standard. The Notice of Intent to Remediate was published in The Philadelphia Tribune on May 5, 2020.

Sylvania Tree & Pool Service Building Site, 565 N. West End Boulevard (Route 309), Richland Township, Bucks County. Scott R. Campbell, P.G., Earthres Group, Inc., 6912 Old Easton Road, Pipersville, PA 18947 on behalf of Stacee Hogan, Lehigh Valley Health Network, 2100 Mack Boulevard, Allentown, PA 18105 submitted a Notice of Intent to Remediate. Soil at the site was impacted by petroleum-related constituents, VOCs and lead. The site is currently vacant. The planned future use of the site is mixed use; however, based upon required township setbacks and the proximity of the site to Route 309, development of the remediated area is not expected to occur. The proposed cleanup standard for the site is the Statewide Health Standard. The Notice of Intent to Remediate was published in The Intelligencer on May 27, 2020.

SMJ Trucking LLC Diesel Fuel & Motor Oil Cleanup, Interstate 80 at MM 204.2 E, New Columbia, White Deer Township, Union County. Northridge Group, Inc., P.O. Box 231, Northumberland, PA 17857, on behalf of SMJ Trucking, LLC, 33 Pamparo Avenue, FL 2, Jersey City, NJ 07305, has submitted a Notice of Intent to Remediate concerning site soil contaminated with diesel fuel and motor oil. The applicant proposes to remediate the site to meet the Non-Residential Statewide Health Standard for soil. General Permit Application No. WMGR081SE009. People Advancing Reintegration, Inc., 342 East Walnut Lane, Philadelphia, PA 19144. This permit application is for the determination of applicability (DOA) under General Permit No. WMGR081 to process computers and electronic waste to beneficial reuse or recycle. The proposed facility's name is PAR Recycle Works Facility and it is located at 324 E. Walnut Lane in the City of Philadelphia, Philadelphia County. The application for determination of applicability was accepted as administratively complete by the Southeast Regional Office on June 1, 2020.

AIR QUALITY

PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS

 The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.

 The Department received applications for Plan Approvals or Operating Permits from the following facilities. Copies of the application, the Department's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate Department Regional Office. Appointments for scheduling a review must be made by calling the appropriate Department Regional Office. The address and phone number of the Regional Office is listed before the application notices.

 Persons wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the Department's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval/Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the permit.

 A person wishing to request a hearing may do so during the 30-day comment period. A public hearing may be held, if the Department, in its discretion, decides that a hearing is warranted based on the information received. Persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper, the Pennsylvania Bulletin or by telephone, when the Department determines this type of notification is sufficient.  Permits issued to the owners or operators of sources subject to 25 Pa. Code Chapter 127, Subchapter D or E, or located within a Title V facility or subject to 25 Pa. Code § 129.51(a) or permits issued for sources with limitations on their potential to emit used to avoid otherwise applicable Federal requirements may be submitted to the United States Environmental Protection Agency for review and approval as a revision to the State Implementation Plan. Final Plan Approvals and Operating Permits will contain terms and conditions to ensure that the sources are constructed and operating in compliance with applicable requirements in the Air Pollution Control Act (35 P.S. §§ 4001—4015), 25 Pa. Code Chapters 121—145, the Federal Clean Air Act (42 U.S.C.A. §§ 7401—7671q) and regulations adopted under the Federal Clean Air Act.

Intent to Issue Plan Approvals and Intent to Issue or Amend Operating Permits under the Air Pollution Control Act (35 P.S. §§ 4001—4015) and 25 Pa. Code Chapter 127, Subchapter B. These actions may include the administrative amendments of an associated operating permit.

35-00077A: Eastern PA Land Investment Holding, LLC (1835 Market Street, Philadelphia, PA 19103) for the installation and operation of four aluminum can manufacturing lines with four baghouses and four regenerative thermal oxidizers (RTOs) to control emissions from the facility to be located in Olyphant Borough, Lackawanna County.

 The Department of Environmental Protection's (Department) review of the information submitted by the Eastern PA Land Investment Holding, LLC indicates that the air contamination sources to be constructed will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including 40 CFR Part 60, Subpart WW and 25 Pa. Code § 129.52 requirements of emission limits from sheet basecoat, can exterior and interior body spray coatings and the best available technology requirement (BAT) of 25 Pa. Code §§ 127.1 and 127.12. Based on this finding, the Department proposes to issue a plan approval for the proposed construction.

 The VOC emissions from the facility will not equal or exceed 50 TPY, based on a 12-month rolling sum. The NOx, Total PM, SOx, and CO emissions from the facility will not equal or exceed 100 TPY, based on a 12-month rolling sum. The HAPs from the facility must never equal or exceed 10 TPY of any single HAP and must never equal or exceed 25 TPY of all aggregated HAPs, based on a 12-month rolling sum.

 The Plan approval and Operating Permit will include testing, monitoring, recordkeeping, and reporting requirements designed to keep the sources operating within all applicable air quality requirements.

 The facility will be a minor facility. If the Department determines that the sources are constructed and operated in compliance with the plan approval conditions and specification of the application for Plan Approval No. 35-00077A, the Department will issue a State Only Operating Permit No. 35-00077 to the facility pursuant to the provisions of 25 Pa. Code § 127.

 Copies of the application, DEP's analysis and other documents used in the evaluation of the application are available for public review during normal business hours at PA DEP, Air Quality Program, 2 Public Square, Wilkes-Barre, PA 18701. 21-03054A: Hollinger Funeral Home & Cremation, Inc. (501 North Baltimore Avenue, Mount Holly Springs, PA 17065) for the operation of a human crematory and pet crematory located in Mount Holly Springs Borough and South Middletown Township respectively in Cumberland County. The human crematory is a Matthews Environmental IE43-Power-Pak II and the pet crematory is a Matthews Environmental IE43-Power-Pak Jr.; both units are multiple-chamber crematories. The combined emissions from both proposed crematories will not exceed the following limits: 2.78 tpy CO, 3.34 tpy NOx, 2.42 tpy PM-10, 1.08 tpy SOx, and less than 1 tpy of VOC and HAPs. The Department of Environmental Protection's (DEP's) review of the information submitted by the company indicates that the air contamination sources will comply with all regulatory requirements, including monitoring, recordkeeping, and reporting requirements, and pertaining to air contamination sources and the emission of air contaminants including the best available technology requirement (BAT) of 25 Pa. Code §§ 127.1 and 127.12. Based on this finding, DEP proposes to issue a plan approval for the proposed crematories. The units currently operate under General Permit 14. If DEP determines the sources are constructed and operated in compliance with the plan approval, the applicant will subsequently apply for a State-Only Operating Permit in accordance with 25 Pa. Code Subchapter F.

65-00881B: Innovative Carbide, LLC (11040 Parker Drive, Irwin, PA 15642). Notice is hereby given in accordance with 25 Pa. Code §§ 127.44—127.46 that the Department of Environmental Protection (Department) intends to issue Air Quality Plan Approval 65-00881B to allow the construction and initial temporary operation of the following air contamination sources and air cleaning devices: Four (4) vertical mixing mills; Eight (8) vacuum dryers; Eight (8) Chilled Water Condensers; One (1) Torit/Donaldson DFO 2-4 3,600 cfm Cartridge Dust Collector; the authorization for operation of the following air contamination sources: One (1) cold cleaning machine (degreaser); Industrial Cleaning Solvent Activities; and the authorization for modification for the following air contamination sources and air cleaning devices: One (1) existing <= 3,600 cfm modified Cartridge Dust Collector; Four (4) existing vacuum dryers; four (4) existing chilled water condensers; One (1) existing insignificant heptane UST with vent; One (1) Powder Room Floor Scoop. An increase in the facility-wide VOC emission limit from 37 tpy to 49.9 tpy proposed and includes all existing and proposed sources. This Plan Approval is for the Irwin Plant located in North Huntingdon Township, Westmoreland County.

 Potential to emit from the project is estimated to be approximately 4.0 tons of nitrogen oxides (NOx), 3.0 tons of carbon monoxide (CO), 6.0 tons of particulate matter less than 10 microns in diameter (PM10), 6.0 tons of particulate matter less than 2.5 microns in diameter (PM2.5), 0.5 ton of sulfur dioxide (SO2), 49.9 tons of volatile organic compounds (VOC), and 6.0 tons of total metal hazardous air pollutants (Metal-HAPs). Best available technology (BAT) is a 3,600-cfm cartridge dust collector to control particulate matter emissions as well as chilled water condensers to control VOC emissions as well as proper maintenance and operation of both control technologies.

 The authorization is subject to State regulations including 25 Pa. Code §§ 121.7, 123.1, 123.2, 123.13, 123.21, 123.31, 123.41—123.43, 127.1, 127.11, 127.12b, 129.14, 129.63, 129.63a, 135.3—135.5 and 139.11, as well as the conditions from the State Only Operating Permit SOOP-65-00881. This plan Approval has been conditioned to ensure compliance with all applicable rules. This includes emissions restrictions, operational restrictions, testing, monitoring, recordkeeping, reporting, and work practice requirements. Once compliance with the Plan Approval is demonstrated, the applicant will be required to revise or submit a State Only Operating Permit in accordance with 25 Pa. Code Subchapter F.

 The Plan Approval Application, the Department's Air Quality Review Memorandum, and the proposed Air Quality Plan Approval for this project are available for review by any interested party at the Department's Southwest Regional Office, 400 Waterfront Drive, Pittsburgh, PA 15222. 24-083AA: Mersen USA (215 Stackpole St., St. Marys, PA 15857) for the installation of a wet scrubber at their facility in the City of St. Marys, Elk County. This is a Title V facility.

 Notice is hereby given pursuant to 25 Pa. Code §§ 127.44(b) and 127.424(b), that the Pennsylvania Department of Environmental Protection (DEP) intends to issue Plan Approval 24-083AA to Mersen USA for the installation of a wet scrubber at their facility in the City of St. Marys, Elk County. The Plan Approval will subsequently be incorporated into the facility's Operating Permit through an administrative amendment in accordance with 25 Pa. Code § 127.450.

 Plan Approval No. 24-083AA is for the installation of a wet scrubber as a replacement two existing wet scrubbers (Source IDs C501 and C1003), for control of SOx emissions from nine (9) existing carbon baking kilns (Source IDs 145, 146, 147, 148, 402, 403, 403A, 1003, and 1004). Based on the information provided by the applicant and DEP's own analysis, emissions from the subject source(s) will not exceed 41.5 tons of sulfur oxides (SOx) per year.

 The Plan Approval will contain testing, monitoring, recordkeeping and work practice requirements designed to keep the facility operating within all applicable air quality requirements. 53-00004: Dominion Energy Transmission Inc. (120 Tredegar Street, Richmond, VA 23192) to issue a renewal Title V Operating Permit for their Harrison Transmission Station located in Harrison Township, Potter County. The facility is currently operating under Title V Operating Permit 53-00004. The facility's main sources include multiple natural-gas-fired heaters/boilers ranging from 0.10 MMBtu/hr to 25 MMBtu/hr, five 2,000 brake-horsepower natural-gas-fired compressor engines, one 770 brake-horsepower natural-gas-fired engine, one 1,100 brake-horsepower natural-gas-fired engine, and various storage tanks. The facility has potential annual emissions of 424.41 tons of carbon monoxide, 1,168.94 tons of nitrogen oxides, 27.97 tons of sulfur oxides, 21.71 tons of particulate matter including particulate matter less than 10 microns in size, 21.71 tons of particulate matter less than 2.5 microns in size, 135.2 tons of volatile organic compounds, 4.91 tons of hazardous air pollutants, and 46,289 tons of greenhouse gases. The emission limits, throughput limitations and work practice standards along with testing, monitoring, recordkeeping and reporting requirements have been included in the operating permit to ensure the facility complies with all applicable Federal and State air quality regulations. 46-00144: US Department of Agriculture—Eastern Regional Research Center (''USDA'') (600 East Mermaid Lane, Wyndmoor, PA 19038) for the renewal of a Synthetic Minor Operating Permit in Springfield Township, Montgomery County. The initial operating permit was issued on March 18, 2004, and it was effective May 1, 2004. USDA's primary focus at this facility is the preservation of produce for longer periods of time before it becomes inedible. The primary sources of air emissions from the facility are boilers (Source IDs 032, 034, 035, and 036) and emergency generators (Source IDs 106 and 107). Previous Source 101 (Boilers 1 and 2), were replaced by Source IDs 035 (Boiler 5) and 036 (Boiler 6). The two new boilers are dual fuel-fired, each rated 9.0 MMBtu/hr, each. Source 102 was renamed Source ID 032, to reflect that it is a combustion source. It is also a dual fuel-fired boiler. Source 034 is an existing dual fuel-fired boiler. Source IDs 032, 034, 035, and 036 will use natural gas as the primary fuel and No. 2 fuel oil only as backup. These units shall not be subject to 40 CFR Part 63, Subpart JJJJJJ, based on 40 CFR 63.11195(e) and 63.11237. Sources 103 (HAZOP Boiler), 105 [Emergency Gen (2,000 kW)], and 200 (Cold Cleaning Parts Washers) were removed from the site. Applicable requirements from 40 CFR Part 60, Subpart JJJJ, have been incorporated for Source ID 106. The Department intends to issue a Natural Minor State Only Operating Permit for the operation of a natural gas incinerator located in Kiskiminetas Township, Armstrong County. The subject facility consists of one 100 lb/hr human crematory incinerator, Power-Pak II natural gas-fired rated at 700 MBtu/hr primary chamber and 1.4 MMBtu/hr secondary chamber. The potential emissions are 1.5 tpy NOx and less than 0.5 tpy for all other criteria pollutants. The facility is subject to State Regulations. 25-00337: Custom Engineering Co. (2800 McClelland Avenue, Erie, PA 16510-2544). The Department intends to issue the renewal of the State-Only Operating Permit of a metal fabrication and machining facility located in Erie City, Erie County. Permitted air contamination sources at the facility are two paint booths, burntables for torch cutting, dry abrasive blasting operations, machining operations, welding operations, a spray gun cleaning system, rust inhibitor application, and natural gas-fired combustion sources. The facility is subject to a VOC restriction of 8.2 TPY, on a 12-month rolling basis, established through a plan approval. In this renewal, major permit change is the incorporation of 25 Pa. Code § 129.52d, which may potentially replace 25 Pa. Code § 129.52, for the facility's metal parts surface coating operations. For permitting purposes, the facility is Natural Minor.

32-00182: Peoples Gas Company LLC Fisher Station (375 N. Shore Drive, Suite 600, Pittsburgh, PA 15212). The Department intends to issue a State Only Operating Permit for compression and transfer of natural gas located in Redbank Township, Armstrong County. The subject facility consists of two natural gas compressor engines (1-600 hp and 1-66 hp). The reported 2019 Annual Emission Summary (TPY) for the Fisher Station is: 4.84 CO, 7.23 NOx, 6.69 VOC, 1.05 HAPs, 0.12 PM, 0.007 SOx, 182.8 Methane, and 1,461.38 Carbon Dioxide. The facility is a natural minor and is subject to State Regulations and Federal Regulations (40 CFR Part 63 ZZZZ). The permit includes additional operation requirements, monitoring requirements, and recordkeeping requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

43-00273: DBA Select Metal Litho Greenville (242 Reynolds Industrial Park Dr., Greenville, PA 16125-8216). The Department is providing notice that they intend to issue a renewal State Only Operating Permit for the manufacturing facility located in Pymatuning Township, Mercer County. The facility conducts surface coating of metal sheets that are eventually used to form metal cans and decorative tins. The facility has two print lines and one coater line. The potential emissions of the primary pollutants from the facility are as follows: PM-10 and PM-2.5: 0.28 TPY, NOx: 9.22 TPY, SOx: 0.06 TPY, CO: 7.75 TPY, and VOC: 49.50 TPY; thus, the facility is a natural minor. The facility is also operating under Plan Approval 43-273A for the construction of a new coating line and a regenerative thermal oxidizer that controls emissions from this new coating line, the existing coating line, and both print lines. This plan approval also established VOC limits for each individual source as well as the entire facility (49.5 tons per year). Upon completion of plan approval terms, the requirements will be incorporated into the operating permit via amendment. The operating permit will contain emission restrictions, recordkeeping, work practices, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

 Assai Energy LLC is proposing a high BTU RNG processing facility designed to process up to 20,000 SCFM of landfill gas. The plant is being designed and controlled by a high efficient thermal oxidizer (TOx) unit that will be used to process the tail gas to destroy VOCs and HAPs. The landfills current flares will be utilized if needed.

 The Department's review of the information submitted by Assai Energy LLC indicates that the proposed operation will meet all applicable air quality requirements pertaining to air contamination sources and the emission of air contaminants, including the BAT requirements. The company shall comply with 123.31 for malodorous emissions. The company shall comply with 123.13 for particulate emissions. The company shall comply with 123.41 for visible emissions. VOC emissions from the plant will remain under 50 TPY threshold limit, 12-month rolling sum. Total HAP emissions from the facility will be under 25 TPY, 12-month rolling sum. Single HAP emissions will be under 10 TPY, 12-month rolling sum.

 Plan Approval No. 35-00042A is for the replacement of odor scrubber operating at the facility to control hydrogen sulfide emissions from the existing sludge processing equipment. This facility is a Non-Title V facility. Hydrogen Sulfide (H2S) emissions generated during operations will be controlled by a packed tower scrubber capable of removing 99% of hydrogen sulfide before discharging into atmosphere. Estimated hydrogen sulfide emissions will be less than 0.09 ton/year. The use of wet packed tower scrubber capable of removing 99% of emissions meets Department's BAT criteria for this type of process. The company will operate the sources and maintain the system in accordance with the good engineering practices to assure proper operation of the system. The Plan Approval and Operating permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

 Applications under the Surface Mining Conservation and Reclamation Act (52 P.S. §§ 1396.1—1396.31); the Noncoal Surface Mining Conservation and Reclamation Act (52 P.S. §§ 3301—3326); the Clean Streams Law (35 P.S. §§ 691.1—691.1001); the Coal Refuse Disposal Control Act (52 P.S. §§ 30.51—30.66); the Bituminous Mine Subsidence and Land Conservation Act (52 P.S. §§ 1406.1—1406.21). MINING ACTIVITY NPDES DRAFT PERMITS

This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.

Effluent Limits for Coal Mining Activities

 For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).

 The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

 A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

 Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

Effluent Limits for Noncoal Mining Activities

 The limits for noncoal mining activities as provided in 25 Pa. Code Chapter 77 are pH 6 to 9 and other parameters the Department may require.

 Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

 In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.

 More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).

 The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 563-2112-115, Developing National Pollutant Discharge Elimination System (NPDES) Permits for Mining Activities. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.

 Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.

 Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30-days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

 The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30-days of this public notice and contain the name, address, telephone number and the interest of the party filing the request and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341), requires the State to certify that the involved projects will not violate the applicable provisions of Sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317), as well as relevant State requirements. Persons objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30-days of the date of this notice, as well as any questions to the office noted above the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed, and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary.  To perform the following listed water obstruction and encroachment activities associated with the Fischer's Park Proposed Pedestrian Bridge. The proposed project involves the installation of a pedestrian bridge over Towamencin Creek (TSF). The project proposes 256 sq. feet permanent stream impacts and 256 sq. feet temporary stream impacts and 2,400 SF of temporary floodway impact. There are no impacts in wetlands.

 The site is approximately located at the intersection of Skippack Pike and Bustard Road in Cedars (Lansdale, PA Lat. 40° 13` 46"; Long. -75° 21` 28") in Towamencin Township, Montgomery County.

 Cheltenham Township is proposing to construct and maintain a new 130-foot long, 10-foot wide weathered steel, prefabricated pedestrian bridge on concrete abutments associated with the Tookany Creek Trail, Phase III Project. The proposed bridge low chord will be situated above the 100-year flood elevation and will result in 10 linear feet (400 square feet, 0.01 acre) of permanent stream impact. Also included with this project are permanent floodway and floodplain impact.

 This project is located west of the New 2nd Street and Tookany Creek Drive intersection within a previously cleared area of the sewer improvement project in Cheltenham Township, Montgomery County (USGS PA Frankford Quadrangle—Latitude 40.068247 N, Longitude 75.117822 W).
