FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of Sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317), and that the construction will not violate applicable Federal and State Water Quality Standards.

 Any person aggrieved by these actions may appeal, pursuant to Section 4 of the Environmental Hearing Board Act, 35 P.S. Section 7514, and the Administrative Agency Law, 2 Pa.C.S. Chapter 5A, to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483.  The site is located at 847 Burrows Run Road (Kennett Square, PA, USGS Quadrangle, Latitude: 39.849954; Longitude: -75.645744) in Kennett Township, Chester County. Permit issued October 5, 2020.

EA1501220-021/WL1501220-002, Natural Lands Trust, 640 South Swedesford Road, Ambler, PA 19002, West Vincent Township, Chester County, ACOE Philadelphia District.

 To daylight and restore an intermittent unnamed tributary to Pickering Creek (HQ-TSF) by removing 238-foot long, 24-inch RCP culvert associated with the Bryn Coed Farm Preserve—Pickering Creek Headwaters Restoration Design Project. Construction activities will result in 278 linear feet (929 square feet, 0.002 acre) of stream restoration, 696 square feet (0.02 acre) of permanent floodway impact, and 665 square feet (0.02 acre) of temporary floodway impact due to removal of the 24-inch culvert, to perform grading and temporary workspace. Additional impacts include impact to a wetland area which includes 16,890 square feet (0.39 acre) of permanent indirect wetland impact due to dewatering operations and 333 square feet (0.01 acre) of temporary wetland impact due to the placement of timber matting and dewatering operations. All activities are to be covered under the Waiver 16.

 This project is located within the Bryn Coed Farm Preserve in West Vincent Township, Chester County (USGS PA Pottstown Quadrangle—Latitude 40.127217 N, Longitude 75.629371 W). Permit issued October 6, 2020.

Permit No. E2301220-028, Springbrooke Industrial, LLC, 300 Conshohocken State Road, West Conshohocken, PA 19428, Aston Township, Delaware County, ACOE Philadelphia District.

 To place fill within two isolated (2) palustrine forested wetland areas and an ephemeral watercourse associated with the construction of two industrial warehouses, access/parking areas, and stormwater management facilities. This activity will result in 0.17 acre of permanent wetland impact and 379.3 linear feet of permanent watercourse impact. A previously constructed 0.28 acre of wetland mitigation site was completed in association with an issued PADEP Water Obstruction and Encroachment Permit (E23-456) within the same project area and is considered compensation for the impacts stated above.

 This project is located near Springbrooke Boulevard and Pennell Road in Aston Township, Chester County (USGS PA Aston; Upper Chichester Quadrangle—Latitude: 39.854219 N, Longitude: 75.430787 W). Permit issued October 7, 2020.

Permit No. E4601220-030, Cheltenham Township, 8230 Old York Road, Elkins Park, PA 19027, Cheltenham Township, Montgomery County, ACOE Philadelphia District.

 To construct and maintain a new 130-foot long, 10-foot wide weathered steel, prefabricated pedestrian bridge on concrete abutments associated with the Tookany Creek Trail, Phase III Project. The proposed bridge low chord will be situated above the 100-year flood elevation and will result in 10 linear feet (400 square feet, 0.01 acre) of permanent watercourse impact and 984 square feet (0.02 acre) of permanent floodway impact due to the pedestrian bridge construction and the placement of riprap rock protection for the abutments. Floodplain impacts include the removal of existing asphalt, mill and overlay at existing grade, trail construction, and approaches to pedestrian bridge which will result in 0.11 acre of temporary floodplain impact and 0.03 acre of permanent floodway impact with the placement of 421 cubic yards of fill.

 This project is located west of the New 2nd Street and Tookany Creek Drive intersection within a previously cleared area of the sewer improvement project in Cheltenham Township, Montgomery County (USGS PA Frankford Quadrangle—Latitude: 40.068247 N, Longitude: 75.117822 W). Permit issued October 6, 2020.

E2203220-021. Susquehanna Area Regional Airport Authority, One Terminal Drive, Suite 300, Middletown, PA 17057. Lower Swatara Township, Dauphin County, U.S. Army Corps of Engineers, Baltimore District.

 To 1.) place and maintain fill in a palustrine emergent wetland, impacting 0.20 acre of wetland; and 2.) install and maintain a 60.0-inch high by 84.0-inch wide concrete box culvert outfall with concrete wingwalls and R-7 rip rap apron, permanently impacting 44 linear feet of the Susquehanna River (WWF, MF) all for the purposes of expanding the existing cargo apron and providing additional parking for aircraft. The project is located along Airport Drive (Latitude: 40° 11` 36" N; Longitude: 76° 45` 6" W) in Lower Swatara Township, Dauphin County. To compensate for the wetland impacts, the applicant will provide funds to acquire 0.20 acre of wetland credits from the Codorus Creek Mitigation Bank (PADEP Permit #MB990367-001).  Project proposes to remove the Water Power Dam to eliminate a threat to public safety and to restore approximately 1,700 feet of stream channel to a free-flowing condition. The proposed restoration project includes the installation of habitat enhancement structures in the stream channel through the former reservoir. The project is located across Bushkill Creek (HQ-CWF, MF) (Easton, PA Quadrangle, Latitude: 40.7000; Longitude: -75.2425).

PREAMBLE 2


The Following Plans and Reports Were Submitted Under The Storage Tank and Spill Prevention Act (35 P.S. §§ 6021.101—6021.2104).

 Provisions of 25 Pa. Code Chapter 245, Subchapter D, Administration of the Storage Tank and Spill Prevention Program, require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A remedial action plan is submitted to summarize the site characterization, document the design and construction details for the remedial action, and describe how the remedial action will attain the selected remediation standard. The remedial action plan also provides results of studies performed and data collected to support the remedial action and a description of postremediation care requirements.
