Increase of Fees for Court-Appointed Guardians of Medical Assistance Long-Term Care Recipient Incapacitated Persons

Administrative Order

And Now, this 12th day of December, 2022, upon consideration of the increase by the Pennsylvania Department of Human Services in the maximum monthly guardian's fee allowable in cases in which the incapacitated person receives a medical assistance long-term grant, which raised the maximum allowable monthly guardian's fee in such matters from $100.00 per month to $300.00 per month, effective January 1, 2023, it is hereby Ordered and Decreed as follows:

 Effective January 1, 2023, all currently serving court-appointed professional guardians in guardianship matters in which this Court has previously authorized by Final Decree or Order monthly monetary compensation for guardian services to an incapacitated individual who receives a medical assistance long-term care grant, are now authorized to receive $300.00 per month in each such case, effective January 1, 2023, without the need to file a petition seeking that increase.

 The Clerk of the Orphans' Court of Montgomery County, Pennsylvania, shall post a notice of this Order on its website.

 A copy of this Order, accompanying a copy of any prior Order and the Final Decree appointing any professional guardian in such cases to serve as Guardian of the Estate of an incapacitated person, shall be conclusive proof of this Court's directive to modify the fee payable to that Guardian to $300.00 per month, or the highest amount authorized by the Department of Human Services.
