The provisions of this Chapter 962 adopted October 29, 1992, effective and will apply to all projects unless the project’s application was submitted and eligible for consideration at an Authority Board meeting prior to or on November 12, 1992. Eligibility for consideration means that all necessary permits from the Department of Environmental Resources have been obtained and any Federal requirements needed to be eligible to receive funds from the Water Pollution Control Revolving Fund have been met by November 12, 1992. If an application which was eligible to be considered at a Board meeting prior to or on November 12, 1992, subsequently changes the scope of the project submitted in that application, the new project must comply with §  962.1, 22 Pa.B. 5328; reserved November 21, 1997, effective November 22, 1997, 27 Pa.B. 6080.
