Notes of Decisions

   This chapter does not violate the separation of powers doctrine of the Pennsylvania Constitution because the Unfair Trade Practices and Consumer Protection Law contains a legislative expression of a basic policy choice and provides sufficient standards for rulemaking. Pennsylvania Retailers’ Associations, Reliable, Inc. v. Lazin, 426 A.2d 712 (Pa. Cmwlth. 1981).

   Section 3.1 of the Unfair Trade Practices and Consumer Protection Law (73 P. S. §  201-3.1) extends to the regulation of debt collection activities and authorizes the Bureau of Consumer Protection, as the delegatee of the Attorney General, to promulgate 37 Pa. Code §  303.1 et seq. Pennsylvania Retailers’ Associations, Reliable, Inc. v. Lazin, 426 A.2d 712 (Pa. Cmwlth. 1981).

   The Commonwealth Documents Law (45 P. S. §  1205) review as to legality, which is to be performed by the Justice Department, is not invalid merely because it is carried out by the Director of the Bureau acting under Justice Department authorization. Pennsylvania Retailers’ Associations, Reliable, Inc. v. Lazin, 426 A.2d 712 (Pa. Cmwlth. 1981).
