Notes of Decisions

   Ownership of property which meets the definition of ‘‘nonresident real property’’ which the owner does not take steps to sell will make the owner ineligible for General Assistance regardless of whether the property has substantial liens and encumbrances. Simms v. Department of Public Welfare, 481 A.2d 997, 998 (1984).

Notes of Decisions

   A referee’s finding that there is some likelihood the client will return home requires the conclusion, under 55 Pa. Code §  179.82, that the client’s house is residential property, and is therefore exempted as a resource for medical assistance purposes. Anderson v. Department of Public Welfare, 468 A.2d 1167, 1169 (Pa. Commw. 1983).

Notes of Decisions

   The property of a patient will be valued in excess of $1500 despite the fact that DPW produced two differing market value figures, since both values exceeded $1500 and there was no countervailing evidence of a value less than $1500. Skinner v. Department of Public Welfare, 399 A.2d 811, 812 (Pa. Cmwlth. 1979).
