803.11.    Powers and duties.

§ 803.11. Powers and duties.

 The Secretary shall have the power and duty to operate and administer the lottery, including the promulgation of rules and regulations governing its establishment and operation, including but not limited to the following:

   (1)  The type of lottery to be conducted.

   (2)  The price, or prices, of tickets or shares in the lottery.

   (3)  The numbers and sizes of the prizes on the winning tickets or shares. The Secretary may, from time to time, as the circumstances warrant, alter the prize structure set forth herein and advertise such changes through such media available to him consistent with law.

   (4)  The manner of selecting the winning tickets or shares.

   (5)  The manner of payment of prizes to the holders of winning tickets or shares.

   (6)  The frequency of the drawings or selections of winning tickets or shares, without limitation.

   (7)  The type or types of locations at which tickets or shares may be sold, without limit as to the number.

   (8)  The method to be used in selling tickets or shares.

   (9)  The licensing of agents to sell tickets or shares but no person under the age of 21 shall be licensed as an agent.

   (10)  The manner and amount of compensation, if any, to be paid licensed sales agents necessary to provide for the adequate availability of tickets or shares to prospective buyers and for the convenience of the public.

   (11)  The apportionment of the total revenues accruing from the sale of lottery tickets or shares and from all other sources among the following:

     (i)   The payment of prizes to the holders of winning tickets or shares.

     (ii)   The payment of costs incurred in the operation and administration of the lottery, including the expenses of the division and the costs resulting from any contract or contracts entered into for promotional, advertising or operational services or for the purchase or lease of lottery equipment and materials.

     (iii)   The repayment of the moneys appropriated to the State Lottery Fund pursuant to section 16 of the act (72 P. S. §  3761.16).

     (iv)   For property tax relief for the elderly as provided in section 12 of the act (72 P. S. §  3761.12). However, no less than 30% of the total revenues accruing from the sale of lottery tickets or shares shall be dedicated to tax relief for the elderly.

   (12)  Such other matters necessary or desirable for the efficient operation and administration of the lottery and for the convenience of the purchasers of tickets or shares and the holders of winning tickets or shares.

   (13)  To report monthly to the Governor and the State Legislature the total lottery revenues, prize disbursements, and other expenses for the preceding month, and to make an annual report, which shall include a full and complete statement of lottery revenues, prize disbursements, and other expenses, to the Governor and the Legislature, and including such recommendations for changes in the act as the Secretary deems necessary or desirable.

§ 803.21. Appointment.

 The Secretary will appoint a director of the Bureau who shall be a resident of this Commonwealth at the time of, and during the full term of, his employment.

§ 803.22. Powers and duties.

 The Director of the Bureau shall have the power and the responsibility to perform following duties:

   (1)  Administer and coordinate the administrative functions of the Bureau.

   (2)  Have overall supervisory authority and responsibility over the Bureau.

   (3)  Have the authority which the Secretary delegates to him as he deems proper and appropriate for the efficient administration of the provisions of the act.

   (4)  Maintain full and complete records of the operation of the Bureau, which shall include, but not be limited to, a statement of revenue, prize disbursements and administration expenses of the Bureau. These records shall be open to the public as provided by law.

   (5)  Report on a regular basis to the Secretary on the status of the lottery.
