(15) Statements in Documents That Affect an Interest in Property. A statement contained in a document, other than a will, that purports to establish or affect an interest in property if the matter stated was relevant to the documents purposeunless later dealings with the property are inconsistent with the truth of the statement or the purport of the document.
Pa.R.E. 803(15) differs from F.R.E. 803(15) in that Pennsylvania does not include a statement made in a will.
Pennsylvanias variation from the federal rule with respect to wills is consistent with case law. See In Re Estate of Kostik, 514 Pa. 591, 526 A.2d 746 (1987).
The provisions of this Rule 803(15) adopted January 17, 2013, effective in sixty days, 43 Pa.B. 620.
