FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

   The Department of Environmental Protection has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)).

   Except as otherwise noted, the Department of Environmental Protection certifies that the construction and operation herein described will comply with the applicable provisions of Sections 301-303, 306 and 307 of the FWPCA 33 U.S.C.A. §§ 1311--1313, 1316 and 1317, and that the construction will not violate applicable Federal and State Water Quality Standards.

   Any person aggrieved by this action may appeal, pursuant to Section 4 of the Environmental Hearing Board Act, (35 P. S. § 7514), and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. Copies of appeal form and the Board's rules of practice and procedure may be obtained from the Board.    Southeast Region: Water Management Program Manager, Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428, (610) 832-6000.

   E15-651.  To maintain an existing fill which impacted approximately 0.34 acres of wetland in and along the 100-year floodplain of French Creek (TSF-MF). The site is located approximately 2,000 feet southeast of the intersection of Township Road and Mowhere Road (Phoenixville, PA Quadrangle; N:2.25 inches; W:4.25 inches) in Phoenixville Borough, Chester County. The permittee has made a contribution to the wetland replacement fund to compensate for the 0.34 acres of wetland impact.

   E23-408.  To remove an existing single span, pony truss bridge across Ridley Creek (WWF-MF). The demolition will include the removal of the existing abutments, wingwalls and the roadway and the roadway approaches. The Bridge is located along East 25th Street (AKA Irvington Lane) approximately 1,300 feet west of its intersection with Ridley Mill Lane, (Bridgeport, NJ-PA Quadrangle, N:22.3 inches; W:15.00 inches) in the City of Chester and Nether Providence Township, Delaware County.

   E46-858.  To realign and enclose approximately 250linear feet of Arrowmink Creek (WWF) to accommodate the construction of the Four Falls Corporate Development Center, which will consist of a 275,000 square-foot commercial building and associated parking garage over the proposed enclosure. The activities include:

   1.  To construct and maintain an approximately 188 linear-foot long reinforced concrete box stream enclosure, consisting of a 14-foot wide by 8-foot high waterway opening, along a new stream alignment of Arrowmink Creek and associated retaining walls at the downstream and upstream ends. Work will also include construction of an approximately 54-foot long reinforced concrete flume. The flume will drop the stream to meet the proposed enclosure invert at the upstream end.

   2.  To remove Bliss Street Bridge and to relocate water and sanitary sewer utilities across Arrowmink Creek. The proposed enclosure will accommodate the relocated Bliss Street Crossing.

   This site is located immediately north from the intersection of Crawford Avenue (S.R. 0023) and Woodmont Road in (Norristown, PA USGS Quadrangle N: 12.30 inches; W: 8.0 inches) in Lower Merion Township and West Conshohocken Borough, Montgomery County.

   E54-243.  Robert A. and Florence E. Arner, R. D. 2, Box 216, New Ringgold, PA 17960. Wetland Fill for Garage Construction, in West Penn Township, Schuylkill County, ACOE Philadelphia District (New Tripoli, PA Quadrangle N: 20.7 inches; W: 15.3 inches).

   To maintain fill placed in 0.2 acre of wetlands, for the purpose of constructing a garage. The project is located along the north side of Pine Hill Road (T-995), approximately one mile east of the intersection of T-995 and S.R. 0309.

   E45-392.  Judy Cherepko, 7 Sylvan Lane, East Stroudsburg, PA 18301. Cherepko Channel Change, in Pocono Township, Monroe County, ACOE Philadelphia District (Mt. Pocono, PA Quadrangle N: 10.5 inches; W: 3.8 inches).

   To maintain a channel change consisting of a trapezoidal channel having a depth of 1.5 feet and bottom width of 3.5 feet and a road crossing consisting of a 30-inch x 18-inch CMP arch culvert in Bulgers Run. The project is located 800 feet west of the intersection of Township Roads T537 and T509.

   E06-534. F.R.S. Incorporated, 727 Red Lane Road, Birdsboro, PA 19058 in Exeter Township, Berks County, ACOE Philadelphia, (Birdsboro, PA Quadrangle N:4.2 inches; W:8.5 inches).

   To impact 0.68 acre of wetlands adjacent to a tributary to the Schuylkill River (WWF) at a point upstream of Route 82 at the Pioneer Crossing Landfill for the purpose of creating a borrow area. The permittee agrees to provide 1.33 acres of replacement wetlands.

   E32-425. Pennsylvania Department of Transportation, Engineering District 10.0, 2550 Oakland Avenue, P. O. Box 429, Indiana, PA 15701-0429. Indiana County Bridge 3035 Over Yellow Creek, in Homer City Borough, Indiana County, ACOE Pittsburgh District (Indiana, PA Quadrangle N: 7.9 inches; W: 5.1 inches).

   To remove the existing bridge and to construct and maintain a bridge having a normal clear span of 75.0 feet and an underclearance of 18.0 feet across Yellow Creek (TSF) on S.R. 3035, Section 450 for the purpose of realignment of the roadway. Also, to construct and maintain streambank protection, just upstream and downstream of the structure. The project is located approximately 200 feet south of Station Street.

   E65-742. The Pennsylvania Turnpike Commission, P. O. Box 67676, Harrisburg, PA 17106-7676. Pennsylvania Turnpike Mainline Road Reconstruction Project, in Mt. Pleasant and Hempfield Townships, Westmoreland County, ACOE Pittsburgh District (Mt. Pleasant, PA Quadrangle N: 16.0 inches; W: 12.7 inches) and (Mammoth, PA, Quadrangle N: 4.55 inches; W: 11.5 inches).

   To extend, operate and maintain an existing 71.58-meter long, 1.830-meter × 1.525-meter concrete pipe arch culvert in an unnamed tributary to Jacobs Creek (CWF) 6.096 meters downstream located at Turnpike Milepost 83.64, Station 134+600, to relocate and maintain 100 meters of an unnamed tributary to Wilson Run (WWF) between Stations 128+200 and 128+300 and 235 meters of an unnamed tributary to Wilson Run (WWF) between Stations 128+740 and 128+970, to place and maintain R-8 rock rip rap along approximately 100 feet of Jacobs Creek (CWF) between Stations 136+080 and 136+180 for stabilization, to place and maintain fill in 0.442 acre of wetlands (0.131 acre PEM, 0.027 acre PEM/PSS; 0.17 acre PEM/PSS/PFO; 0.114 acre PFO/PEM/PSS) and to place and maintain temporary fill in 0.339 acre of wetlands (0.062 acre PEM; 0.042 acre PEM/PSS; 0.119 acre PEM/PSS/PFO; 0.116 acre PFO/PEM/PSS) as part of the Turnpike Mainline Reconstruction Project between Milepost 76 and Milepost 85. To compensate for the wetland loss, the applicant will contribute to the Pennsylvania Wetland Replacement Fund.

   E65-767.  Pennsylvania Department of Transportation, Engineering District 12-0, P. O. Box 459, Uniontown, PA 15401. Pennsylvania Department of Transportation Bridge Over Brush Creek, in Hempfield Township and Penn Borough, Westmoreland County, ACOE Pittsburgh District (Irwin, PA Quadrangle N: 14.2 inches; W: 1.8 inches).

   To remove existing structure and to construct and maintain a single span bridge having a normal span of 18.29 meters and a minimum underclearance of 3.96 meters across Brush Creek (TSF) for the purpose of improving transportation safety and roadway standards. This permit also authorized the construction and maintenance of two outfall structures consisting of a 0.52-meter RCP along Brush Creek and a 0.61-meter RCP along an unnamed tributary to Brush Creek. The project is located on S.R. 3077, Section E10, Segment 0080, Offset 0000.

   To remove the existing Miller Hays Bridge (County Bridge No. 73) and to construct and maintain a composite steel beam bridge having a clear, normal span of 46.5 feet and an underclearance of 5 feet across Little Buffalo Run on Hays Road (T-626) approximately 450 feet south of Fenelton Road (T-595).

   E24-213, PA Department of Conservation and Natural Resources, Bureau of Forestry, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8451, Harrisburg, PA 17105-8451. Porcupine Road Across Dents Run, in Benezette Township, Elk County, ACOE Pittsburgh District (Dents Run, PA Quadrangle N: 20.3 inches; W: 13.8 inches).

   To conduct the following activities associated with the replacement of the bridge across Dents Run on Porcupine Road immediately south of Dents Run Road in Elk State Forest:

   1.  Remove the existing bridge and a gravel bar adjacent to the left abutment measuring approximately 100 feet in length.

   2.  Construct and maintain a rock riprap stream deflector along the right side of the channel approximately 50 feet upstream of the bridge.

   3.  Construct and maintain a prestressed concrete spread box beam bridge having a clear, normal span of 35.8 feet and an underclearance of approximately 8 feet.

   4.  Construct and maintain a stabilized parking area along the left bank upstream of the roadway and adjacent to the intersection of Porcupine Road and Dents Run Road.

   This project includes a permanent impact to a de minimus area (0.012 acre) of wetlands adjoining Dents Run associated with construction of the stream deflector and approach roadway.

   E25-619, PA Department of Transportation, District 1-0, 255 Elm Street, Oil City, PA 16301-1499. S.R 0005, Section B00, Segment 0940, Offset 1218 Across Sixteen Mile Creek, in North East Township, Erie County, ACOE Pittsburgh District (North East, PA Quadrangle N: 20.2 inches; W: 11.2 inches).

   To remove the existing bridge and to construct and maintain a prestressed concrete spread box beam bridge having a normal span of 32.8 feet and an average underclearance of 13.6 feet on a 45 degree skew across Sixteen Mile Creek on S.R 0005, Section B00, Segment 0940, Offset 1218 approximately 100 feet east of S.R. 89.

SPECIAL NOTICES

CERTIFIED EMISSION REDUCTION CREDITS IN PENNSYLVANIA'S ERC REGISTRY

   Emission reduction credits (ERCs) are surplus, permanent, quantified and federally enforceable emission reductions used to offset emission increases of oxides of nitrogen (NOx), volatile organic compounds (VOCs) and the following criteria pollutants: carbon monoxide (CO), lead (Pb), oxides of sulfur (SOx), particulate matter (PM), PM-10 and PM-10 precursors.

   The Pennsylvania Department of Environmental Protection (PADEP) maintains an ERC registry in accordance with the requirements of 25 Pa. Code § 127.209. The ERC registry system provides for the tracking of the creation, transfer and use of ERCs. Prior to registration of the credits, ERC Registry Applications are reviewed and approved by the Department to confirm that the ERCs meet the requirements of 25 Pa. Code §§ 127.206-208. Registration of the credits in the ERC registry system constitutes certification that the ERCs satisfy applicable requirements and that the credits are available for use. The following registered, and certified ERCs in the ERC Registry are currently available for use as follows:

   (1)  To satisfy new source review (NSR) emission offset ratio requirements;

   (2)  To ''net-out'' of NSR at ERC-generating facilities;

   (3)  To sell or trade the ERCs for use as emission offsets at new or modified facilities.

   The certified ERCs shown below, expressed in tons per year (tpy), satisfy the applicable ERC requirements contained in 25 Pa. Code §§ 127.206--208. ERCs created from the curtailment or shutdown of a source or facility expire for use as offsets 10 years after the emission reduction occurs. ERCs generated by the overcontrol of emissions by an existing facility do not expire for use as offsets. However, credits in the registry which are not used in a plan approval will be discounted if new air quality requirements are adopted by the Department or U.S. Environmental Protection Agency (EPA).

BUREAU OF DEEP MINE SAFETY
REQUEST FOR VARIANCE

   The Department of Environmental Protection (Department), Bureau of Deep Mine Safety, has received a request for variance from Rosebud Mining Company. The following notification contains a summary of this request. A complete copy of the variance request may be obtained from Allison Gaida by calling (724) 439-7469 or from the BDMS web site at http://www.dep.state.pa.us/dep/deputate/minres/dms/dms.htm.

   The Department is publishing a summary of the request in order to solicit comments from affected parties on the proposed variance request. Comments may be used by the Bureau to assist in its investigation of the variance request. Comments will be accepted for thirty (30) days following the publication of this notice. All comments should be addressed to: Richard E. Stickler, Director, Bureau of Deep Mine Safety, Fayette County Health Center, 100 New Salem Road, Room 167, Uniontown, PA 15401

   Section 702 of the Bituminous Coal Mine Act, 52 P. S. § 701(702, provides a mechanism for operators to obtain variances from specific requirements of the Act to accommodate the adoption of new machinery, equipment, tools, supplies, methods, or processes.

   Section 242(c) states that where belt conveyors are installed, main stoppings and regulators shall be so arranged as to reduce the quantity of air traveling in the belt conveyor entry to a minimum for effective ventilation and to provide an intake air split as an escapeway from the face area to the main air current.

   Summary of the Request:  Rosebud Mining Company requests a variance to use point carbon monoxide early warning fire detection system and entries in common with the belt conveyor entry in short term panels at the Twin Rocks Mine.
