STATE CONSERVATION COMMISSION
PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.
Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described. These NMPs are published as proposed plans for comment prior to taking final actions. The NMPs are available for review at the CCD office for the county where the agricultural operation is located. A list of CCD office locations is available at http://www.nacdnet.org/about/districts/directory/pa.phtml or can be obtained from the SCC at the office address listed or by calling (717) 787-8821.
Persons wishing to comment on an NMP are invited to submit a statement outlining their comments on the plan to the CCD, with a copy to the SCC for each NMP, within 30 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the NMPs. Comments should include the name, address and telephone number of the writer and a concise statement to inform the SCC of the exact basis of the comments and the relevant facts upon which they are based. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION
UNDER ACT 2, 1995
PREAMBLE 1
Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907)
Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.302—6026.305) require the Department to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. A person intending to use the background standard, Statewide health standard, the site-specific standard or intend to remediate a site as a special industrial area shall file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of cleanup standards or receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the following site, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified as follows. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.
For further information concerning the content of a Notice of Intent to Remediate, contact the environmental cleanup program manager in the Department regional office listed before the notice. If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Metal Powder Products (Fmr. Carbon City Products), City of St. Marys, Elk County. The Notice of Intent to Remediate was published in The Daily Press on November 12, 2012. The Site-Specific Standard has been selected for remediation of the site.
AIR QUALITY
PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS NEW SOURCES AND MODIFICATIONS The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.
The Department received applications for Plan Approvals or Operating Permits from the following facilities.
Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the regional office listed before the applications. Persons interested in reviewing the application files should contact the appropriate regional office to schedule appointments.
Persons wishing to receive a copy of a proposed Plan Approval or Operating Permit shall indicate interests to the Department regional office within 30 days of the date of this notice and shall file protests or comments on a proposed Plan Approval or Operating Permit within 30 days of the Department providing a copy of the proposed documents to persons or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that hearings be held concerning a proposed Plan Approval or Operating Permit. A comment or protest filed with the Department regional office shall include a concise statement of the objections to the issuance of the Plan Approval or Operating Permit and relevant facts which serve as the basis for the objections. If the Department schedules a hearing, a notice will be published in the Pennsylvania Bulletin at least 30 days prior the date of the hearing.

09-0024J: Waste Management of Pennsylvania, Inc. (1000 New Ford Mill Rd, Morrisville, PA 19067) for a landfill expansion known as the Valley Fill, at the Tullytown Resource and Recovery Facility (TRRF) in Tullytown Borough, Bucks County. TRRF is a major facility. The Valley Fill will ''piggyback'' an area of approximately six acres of the existing TRRF. Emissions of volatile organic compounds (VOC) and hazardous air pollutants (HAPs) shall be controlled by both an interim and final landfill gas collection and control system (GCCS). Landfill gas collected by the GCCS will be routed to an off-site user with a portion used in an on-site engine to generate power for on-site use. Two existing flares at the TRRF have sufficient capacity to serve as back-up control devices in the event the landfill gas cannot be transmitted to the end users. The final GCCS shall be designed and operated according to the specifications and operational standards of the New Source Standards of Performance (NSPS) for Municipal Solid Waste Landfills 40 CFR Part 60, Subpart WWW. The interim and final GCCS comprise Best Available Technology (BAT) for the source. The Valley Fill shall be limited to controlled emissions increases of 10.5 tons/yr of volatile organic compounds (VOC) and 1.0 tons/yr of hazardous air pollutants (HAPs), calculated after closure. Emissions of particulate matter (PM10/PM2.5) from landfill operations will remain below 100 tons/yr, as currently permitted. Emissions from the flares will remain below existing permitted levels. The facility is also subject to the requirements of National Emissions Standard for Hazardous Air Pollutants for Source Categories (Maximum Achievable Control Technology), Subpart AAAA: Municipal Solid Waste Landfills and will comply with all applicable requirements. The Plan Approval contains conditions for monitoring and recordkeeping designed to keep the facility operating within all applicable air quality requirements.

58-399-037: William Field Service Company, LLC (1605 Coraopolis Heights Road, Moon Township, PA 15108) for construction and operation of the Zick Compressor Station, which will consist of the following; two (2) (CAT G3612LE) Caterpillar natural gas fired compressor engines and two (2) (CAT G3608LE) Caterpillar natural gas fired compressor engines. Additionally the following equipment permitted by Permit 58-399-020GP5 will be incorporated into permit 58-399-037; three (3) (CAT G3516B) Caterpillar natural gas fired compressor engines, three (3) dehydration unit with reboiler, one (1) emergency generator (CAT 3516B), six (6) produced water tanks, and Enclosed Flare. The VOC emissions from the facility will not equal or exceed 50 TPY, based on a 12-month rolling sum. The NOx emissions from the facility will not equal or exceed 100 TPY, based on a 12-month rolling sum. Total PM, SOx, and CO emissions from the facility will not equal or exceed 100 TPY, based on a 12-month rolling sum. The HAPs from the facility must never equal or exceed 10 TPY of any single HAP and must never equal or exceed 25 TPY of all aggregated HAPs, based on a 12-month rolling sum at its Zick Compressor Station facility in Lenox Township, Susquehanna County. The plan approval will include all appropriate testing, monitoring, recordkeeping and reporting requirements designed to keep the operations within all applicable air quality requirements.

17-00067A: EOG Resources, Inc. (400 Southpointe Blvd, Plaza 1 Suite 300, Canonsburg, PA 15317) for a plan approval to construct two new Caterpillar G3608LE four-stroke lean-burn natural-gas fired compressor engines each rated 2370 bhp each equipped with an oxidation catalyst and a 100 MMscf/day J.W. Williams glycol dehydrator at the Tyler Road compressor station located in Lawrence Township, Clearfield County. This application is subject to the Best Available Technology (BAT) requirements of 25 Pa. Code §§ 127.1 and 127.12. The facility's total particulate matter (PM) including total PM10 and total PM2.5 emissions are 3.23 tons in any 12 consecutive month period, nitrogen oxides emissions are 23.31 tons in any 12 consecutive month period, carbon monoxide emissions are 7.72 tons in any 12 consecutive month period, volatile organic compounds emissions are 13.21 tons in any 12 consecutive month period, total hazardous air pollutants emissions are 1.85 tons in any 12 consecutive month period, sulfur oxides emissions are 0.08 ton in any 12 consecutive month period, and greenhouse gas emissions are 29,416 tons in any 12 consecutive month period. The Department has determined that the proposed levels of the air contaminants emissions satisfy the Department's BAT requirements.
The facility is also subject to the following federal standards: Subpart JJJJ of the Standards of Performance for New Stationary Sources, 40 CFR 60.4230 through 60.4248 (Standards of Performance for Stationary Spark Ignition Internal Combustion Engines), Subpart OOOO of the Standards of Performance for New Stationary Sources, 40 CFR 60.5360 through 60.5430 (Standards of Performance for Crude Oil and Natural Gas Production, Transmission, and Distribution), Subpart ZZZZ of the National Emission Standards for Hazardous Air Pollutants for Source Categories, 40 CFR 63.6580 through 63.6675 (National Emission Standards for Hazardous Air Pollutants for Stationary Reciprocating Internal Combustion Engines), and Subpart HH of the National Emission Standards for Hazardous Air Pollutants for Source Categories, 40 CFR 63.760—63.777 (National Emission Standards for Hazardous Air Pollutants from Oil and Natural Gas Production Facilities). The Department has determined that this facility satisfies all applicable requirements of these subparts.
Based on the findings presented above, the Department intends to issue a plan approval for the proposed project. The following is a summary of the conditions that the Department proposes to place in the plan approval to be issued to ensure compliance with all applicable air quality regulatory requirements:
1. Pursuant to the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12, the two 2370 brake horsepower, natural-gas fired reciprocating internal combustion engines shall incorporate a ''clean burn'' electronic control system to control NOx emissions. Additionally, the carbon monoxide, volatile organic compounds, and formaldehyde emissions from each engine shall be controlled by an Emit Technologies model ELX-6200H-2022F-63CEE-362 oxidation catalyst unit. The permittee shall not operate any of the engines without the simultaneous operation of each respective oxidation catalyst at any time.
2. Pursuant to the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12, the permittee shall only use natural gas as fuel for each engine in this plan approval.
1. Pursuant to the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12, the following air contaminant emissions from the exhaust of the respective oxidation catalyst associated with its respective engine (Source IDs P101 and P102) shall not exceed the limitations listed below:
(a) nitrogen oxides (NOx, expressed as NO2)—0.50 gm/bhp-hr, 2.61 lb/hr, and 11.44 tons in any 12 consecutive month period,
(b) carbon monoxide (CO)—0.16 gm/bhp-hr, 0.84 lb/hr and 3.68 tons in any 12 consecutive month period,
(c) volatile organic compounds (VOC)—0.22 gm/bhp-hr, 1.15 lb/hr, and 5.04 tons in any 12 consecutive month period,
(d) particulate matter (PM/PM10)—0.07 gm/bhp-hr, 0.34 lb/hr and 1.60 tons in any 12 consecutive month period,
(e) formaldehyde—0.03 gm/bhp-hr, 0.16 lb/hr and 0.70 tons in any 12 consecutive month period.
(f) sulfur oxides (SOx, expressed as SO2) emissions to not exceed 2 parts per million, by volume, dry basis.
(g) Total hazardous air pollutants (HAPs)—0.04 gm/bhp-hr, 0.21 lb/hr and 0.92 tons in any 12 consecutive month period.
2. Pursuant to the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12, each oxidation catalyst shall reduce the carbon monoxide emissions by at least 94% from its respective engine.
3. Pursuant to the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12, the permittee shall equip each oxidation catalyst with instrumentation to monitor and record pressure drop across each oxidation catalyst and the inlet gas temperature of each oxidation catalyst and shall monitor these parameters on a continuous basis.
4. The permittee shall comply with all applicable requirements of Subpart ZZZZ of the National Emission Standards for Hazardous Air Pollutants for each engine in this plan approval as specified in 40 CFR Sections 63.6580—63.6675.
5. The permittee shall comply with 40 CFR Sections 60.4233(e); 60.4234; 60.4243(b)(2)(ii); 60.4244; and 60.4245(a), (c), and (d) of Subpart JJJJ of the Standards of Performance for New Stationary Sources for each engine in this plan approval as specified in 40 CFR Sections 60.4230—60.4248.
6. The permittee shall comply with 40 CFR Sections 60.5370(a), 60.5385; 60.5420(a), (b)(1), (b)(4), (b)(7), (c), and (c)(3) of Subpart OOOO of the Standards of Performance for New Stationary Sources for each engine/reciprocator in this plan approval as specified in 40 CFR Sections 60.5360—60.5430.
7. The permittee shall perform nitrogen oxide (NOx, expressed as NO2), carbon monoxide, volatile organic compound, and formaldehyde stack tests upon each engine within 120 days from the commencement of operation of each engine to demonstrate compliance with the emission limitations and the carbon monoxide destruction efficiency requirement for each oxidation catalyst associated with each engine.
(a) The performance test shall consist of three (3) separate test runs and each run shall last at least in one (1) hour in duration.
(b) The testing of the inlet and outlet of each oxidation catalyst shall be running simultaneously.
(c) The inlet gas temperature and pressure drop of each oxidation catalyst shall be recorded on a continuous basis during the test. The requirement for the temperature range and pressure drop will be established based upon the recorded data and stack test report.
(d) All testing is to be done using reference method test procedures acceptable to the Department and all testing is to be performed while each engine is operating at +/- 10% of full load.
8. (a) In addition to the stack testing required by this plan approval every 2500 hours of operation and no sooner than forty-five (45) days from the previous test, the owner or operator shall perform periodic monitoring for NOx and CO emissions to verify continued compliance upon each of the engines in this plan approval which has a rated capacity greater than 500 brake horsepower and subjected to the BAT as stated in Section B, Conditions 1 and 2, herein. A portable gas analyzer may be used to satisfy the requirements of this condition utilizing three test runs of twenty (20) minutes for each test run. The Department may alter the frequency of portable analyzer tests based on the test results. The frequency of portable gas analyzer tests may be altered with written Departmental approval. The portable gas analyzer shall be used and maintained according to the manufacturer's specifications and the procedures specified in ASTM D 6522 or equivalent as approved by the Department.
(b) The Department reserves the right to require stack tests in accordance with EPA reference methods should the data from the portable analyzer warrant such tests.
9. The permittee shall keep records of the following information:
(a) The supporting calculations on a monthly basis used to demonstrate compliance with the nitrogen oxide, carbon monoxide, volatile organic compound, particulate matter, sulfur oxides, and formaldehyde emission limitations for each engine in any 12 consecutive month period.
(b) The number of hours each engine operates and the amount of fuel used by each engine each calendar year.
(c) The test reports and supporting calculations used to demonstrate compliance with the nitrogen oxide, carbon monoxide, volatile organic compound, and formaldehyde emission limitations and carbon monoxide destruction efficiency for each oxidation catalyst associated with each engine.
(d) The pressure drop across each oxidation catalyst and the inlet gas temperature of each oxidation catalyst on a continuous basis via a data acquisition system.
These records shall be kept for a minimum of five years and shall be made available to the Department upon request.
10. The permittee shall only use natural gas as fuel for the reboiler in the glycol dehy unit.
11. The permittee shall not permit the following air contaminant emissions from the exhaust of the glycol regenerator to exceed the limitations listed below:
(a) Particulate matter—0.04 gr/dscf and
(b) Sulfur oxides—500 ppmdv
(c) Volatile organic compounds—2.07 tpy
12. (a) The permittee shall keep comprehensive and accurate records of the following for the glycol dehy unit:
(a) The hours of operation per calendar year
(b) The amount of fuel used per calendar year
(c) The supporting calculations, including accurate up-to-date Gly-Calc reports and sample analyses of the gas being dehydrated on a monthly basis used to verify compliance with the particulate matter, sulfur oxides, nitrogen oxides, carbon monoxide, and volatile organic compound emission limitations in any 12 consecutive month period for Source ID P201.
(d) The actual throughput and glycol circulation rate.
(b) These records shall be kept for a minimum of five years and shall be made available to the Department upon request.
13. The permittee shall comply with 40 CFR Sections 63.760(f)(6), 63.764(e)(1); 63.772(b); 63.774(d)(1), (d)(2), (f), and (g); and 63.775(c), (d), and (f) of Subpart HH of the National Emission Standards for Hazardous Air Pollutants for Source Categories, 40 CFR 63.760—63.777 (National Emission Standards for Hazardous Air Pollutants from Oil and Natural Gas Production Facilities).

The facility processes cocoa beans and cocoa nibs to create cocoa powder, cocoa butter, and chocolate liquor for utilization in the food industry. As a result of potential emissions of volatile organic compounds (VOCs), the facility is a major stationary source as defined in Title I, Part D of the Clean Air Act Amendments, and is therefore subject to the Title V permitting requirements adopted in 25 Pa. Code Chapter 127, Subchapter G. As shown in a recent stack test, the inlet gases to the regenerative thermal oxidizer may at contain low concentrations of VOCs, so the efficiency of the thermal oxidizer may not reach 98 percent as permitted. The regenerative thermal oxidizer does reduce VOC emissions to less than 20 ppmdv, as methane (6 ppmdv, as propane), which corresponds to a mass emission rate of 0.09 pound VOC per hour (0.39 ton VOC per year). Language was added to the Title V Operating Permit reflecting the reduction of VOC emissions below these levels. Frequency of monitoring and recording pressure drops across baghouses were changed from daily to weekly due to data provided by the facility showing little or no changes in pressure drop across each baghouse from week to week. The changes to condition in the permit does not reflect any change in air emissions from this facility.
23-00084: FPL Energy MH50, L.P. (100 Green Street, Marcus Hook, PA 19061-0426) for a renewal of the Title V Operating Permit in the Borough of Marcus Hook, Delaware County. The facility is primarily used for providing steam to processes at the Sunoco Refinery and electrical energy to the grid. 46-00134: The Hill School (717 East High St, Pottstown, PA 19464) for a renewal Non-Title V Facility, State-Only, Synthetic Minor Permit in Pottstown Township, Montgomery County. The Hill School has several combustion sources for heat, hot water and food preparation. The school has taken fuel throughput restrictions and a 24.9 tpy NOx and VOC emission limit, calculated on a 12-month rolling sum. Monitoring, record keeping and reporting requirements have been added to the permit to address applicable limitations.
09-00047: Warminster Fiberglass Co. (725 County Line Road, Southampton, PA 18966) for renewal of a State Only Operation Permit for a fiberglass products plant in Upper Southampton Township, Bucks County. This Synthetic Minor Operating Permit (SMOP) has emission limits for hazardous air pollutants (HAP). There have been no new sources constructed and no modifications of existing sources since the last issuance of this SMOP. Code §§ 127.44(a) and 127.45(a), that the Department of Environmental Protection (DEP) has received and intends to issue a Plan Approval to Waste Management & Processing, Inc. Plan Approval No. 54-305-024 is for the re-activation of a thermal dryer at the facility. The VOC emissions from the facility will not equal or exceed 50 TPY, based on a 12-month rolling sum. The NOx emissions from the facility will not equal or exceed 100 TPY, based on a 12-month rolling sum. Total PM, SOx, and CO emissions from the facility will not equal or exceed 100 TPY, based on a 12-month rolling sum. The HAPs from the facility must never equal or exceed 10 TPY of any single HAP and must never equal or exceed 25 TPY of all aggregated HAPs, based on a 12-month rolling sum. The Plan approval and Operating Permit will include testing, monitoring, record keeping and reporting requirements designed to keep the sources operating within all applicable air quality requirements.
The facility is subject to 25 Pa. Code § 127.12(a)(5) Best Available Technology (BAT) requirements. The visible emission opacity shall not be equal to or greater than 20% at any time. The company shall be subject to and comply with 25 Pa. Code § 123.31 for malodorous emissions.
The Plan Approval and Operating permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

MINING ACTIVITY NPDES DRAFT PERMITS This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).
The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.
Effluent Limits for Coal Mining Activities
For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).
The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

In addition, the Department imposes a technology-based aluminum limit of 2.0 mg/l (30 day average) to protect stream uses.
A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Effluent Limits for Noncoal Mining Activities
The BAT limits for noncoal mining activities as provided in 40 CFR Part 436 and 25 Pa. Code Chapter 77 are as follows:

Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.
In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.
More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).
The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 362-0600-001, NPDES Program Implementation—Memorandum of Understanding (MOU) Concerning Water Quality Management, NPDES Program Implementation, and Related Matters. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.
Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.
Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30 days of this public notice and contain the name, address, telephone number and the interest of the party filing the request, and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.
