Final Actions

   The Department of Environmental Protection has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

   These actions of the Department may be appealed to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483, by any aggrieved person under The Environmental Hearing Board Act (35 P. S. § 7514); 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law). Appeals must be filed with the Environmental Hearing Board within 30 days from the date of this issue of the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Final Reports

   The following final reports were submitted to the Department of Environmental Protection under the Land Recycling and Environmental Remediation Standards Act, the act of May 19, 1995 (P. L. 4, No. 2).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (the act) require the Department of Environmental Protection to publish in the Pennsylvania Bulletin a notice of submission of any final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

   For further information concerning the final report, please contact the Environmental Cleanup Program in the Department of Environmental Protection Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate Regional Office listed.    A.  100933.  Empire Sanitary Landfill, Inc., P. O. Box 28, Taylor, PA 18517. A permit modification authorizing changes to the construction and operation of the landfill, which includes the expansion of the landfill by three pads known as the Area II expansion area, removing groundwater monitoring well no. 8 in Pad 10, and incorporating all previous relevant permit modification(s) by reference for this municipal waste landfill, located in Taylor and Old Forge Boroughs and Ransom Township, Lackawanna County. Although this action expands the landfill, the boundaries of the permit area have not changed. The number of acres used for disposal has increased from 150 acres to 203 acres. The permit modification was issued in the Regional Office on July 3, 1996.

   60-318-007A.  On June 14, 1996, plan approval was issued to the Federal Bureau of Prisons (P. O. Box 1500, White Deer, PA 17887) for the modification of a wood furniture finishing operation (increase in the amount of volatile organic compound emissions allowed) at FCI Allenwood in Gregg Township, Union County.

   49-301-018A.  On June 18, 1996, plan approval was issued to Merck & Company, Inc. (P. O. Box 600, Danville, PA 17821) for the construction of a waste solvent storage vessel (TA-862) and associated air cleaning devices (condensers and an existing thermal fume incinerator) in Riverside Borough, Northumberland County. TA-862 is subject to Subpart Kb of the Federal Standards of Performance for New Stationary Sources.

   OP-55-0001B.  On June 18, 1996, plan approval was issued to Pennsylvania Power & Light Company (Two North Ninth Street, Allentown, PA 18101-1179) for the construction of a dry fly ash handling system and associated air cleaning devices (fabric collectors, paddle mixers and enclosures) at the Sunbury SES in Shamokin Dam Borough, Snyder County.

   19-317-023A.  On June 28, 1996, plan approval was issued to Heinz Pet Products (6670 Low Street, Bloomsburg, PA 17815) for the installation of an air cleaning device (a packed bed scrubber) on various wastewater treatment operations in South Centre Township, Columbia County.

   41-310-010C.  On June 28, 1996, plan approval was issued to Lycoming County Solid Waste Department (R. D. 2, Box 587, Montgomery, PA 17752) for the construction of various pieces of stone crushing equipment and four associated diesel engines at the Lycoming County Landfill in Brady Township, Lycoming County. Some of the crushing equipment is subject to Subpart 000 of the Federal Standards of Performance for New Stationary Sources.

   59-399-012.  On June 28, 1996, plan approval was issued to Westfield Tanning Company (360 Church Street, Westfield, PA 16950) for the construction of a spent tanning solutions box dryer and associated air cleaning device (a fabric filter) in Westfield Borough, Tioga County.

MINING ACTIVITY ACTIONS

   Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). The final action on each application also constitutes action on the request for 401 water quality certification. This project begins at the south bank of the Delaware River, just upstream of Rotary Island, and extends southwesterly to a point near the intersection of Edgewood Road and Sandy Run Road, (Trenton West, NJ-PA Quadrangle N: 20.75 inches; W: 10.25 inches and N: 18 inches; W: 13.75 inches respectively) in Yardley Borough and Lower Makefield Township, Bucks County. Temporary cofferdam will be installed as required by site condition.

   E09-691.  Encroachment. Toll Brothers, Inc., 3103 Philmont Avenue, Huntington Valley, PA 19006. To construct and maintain two roadway culverts located in and along unnamed tributaries to Jericho Creek in conjunction with the construction of a proposed land development known as the Kauffman Tract. These crossings will utilize three 24-inch diameter R.C.P. culverts, 100-foot long, that will be located along the tributary in the central part of this site and associated with construction of the proposed Woodside Lane, and a 54-inch R.C.P. twin culvert, 75-foot long, to be located in the southern portion of the site to convey flow beneath the proposed Fieldstone Way which will be used to provide future access between this project and an adjacent proposed subdivision. The proposed roadways will require placement of fill material in 0.89 acre of wetlands (PFO). The subdivision is situated along the western side of River Road (S. R. 32), near its intersection with Brownsburg Road (Lambertville, PA-NJ Quadrangle N: 12 inches; W: 8 inches) in Upper Makefield Township, Bucks County. The permittee is providing 1.62 acres of replacement wetlands onsite.

   E23-338.  Encroachment. Radnor Township, 301 Iven Avenue, Wayne, PA 19087-5297. To construct and maintain a concrete headwall adjoined to the outlet of an existing 7.0-foot by 4.67-foot arched brick culvert and to reconstruct and maintain approximately 85 linear feet of partially collapsed stone masonry retaining wall along both banks of Ithan Creek (CWF-MF). The site is situated approximately 700 feet north from the intersection of U. S. Route 30 and Aberdeen Avenue (Valley Forge USGS Quadrangle N: 7.6 inches; W: 0.9 inch) in Radnor Township, Delaware County. Requests for Certification under section 401 of the Federal Water Pollution Control Act

   The following requests have been made to the Department of Environmental Protection for certification under § 401(a) of the 1972 amendments to the Federal Water Pollution Control Act, 33 U.S.C.A § 1341(a), that there is reasonable assurance that the construction herein described will not violate applicable Federal and State water quality standards.

   Prior to final approval of the proposed certification, consideration will be given to any comments, suggestions or objections which are submitted in writing 30 days of the date of this notice.
