   The Department of Environmental Protection has taken the following actions on previously received Dam Safety and Encroachment permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, 400 Market Street Floor 2, P. O.    E17-303.  Water obstruction and encroachment. Pennsylvania Electric Co., 1001 Broad St., Johnstown, PA 15907. Remove an existing structure and to construct and maintain a parking area that requires the emplacement of 5,909.2 cubic yards of fill in the floodway of the west branch Susquehanna River at an existing power generation facility. The proposed work shall consist of (1) the removal of 58.0 feet wide x 338.0 feet long mechanical cooling tower, (2) the emplacement of 5,909.2 cubic yards of fill that shall not exceed a National Geodetic Datum based elevation of 1,058.0 feet, (3) the maximum emplacement of 338.0 linear feet of concrete rubble for slope protection and (4) the installation of a bituminous parking area over the fill. The project is located along the southern right-of-way of S. R. 0829 approximately 100.0 feet west of the intersection of S. R. 1008 and S. R. 0879 (Lecontes Mills, PA Quadrangle N: 12.4 inches; W: 16.0 inches) in Bradford Township, Clearfield County. This permit was issued under section 105.13(e) ''Small Projects.''

   E19-156.  Water obstruction and encroachment. Dept. of Transportation, 715 Jordan Ave., Montoursville, PA 17754. Repair the existing structure by paving aprons, cutoff walls, concrete jacket applications and general patching of the abutments over an unnamed tributary to Coles Creek on S. R. 487 about 1 mile northeast of the village of Tri Mills (Red Rock, PA Quadrangle N: 3.8 inches; W: 11.9 inches) in Sugarloaf Township, Columbia County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

To construct and maintain two reinforced concrete box culverts with a span of 16 feet, a rise of 8 feet and a length of 35 to 40 feet to be used to connect three existing stream enclosures in an unnamed tributary to Penns Creek located in the northeast intersection of S. R. 0011/0015 and S. R. 8005 (Susquehanna Mall Drive) (Sunbury, PA Quadrangle N: 12.9 inches; W: 13.7 inches) in the Borough of Shamokin Dam, Snyder County.

   E40-444.  Encroachment. Bear Creek Village Borough, Box 332, Bear Creek, PA 18602. To construct and maintain a roadway crossing of a tributary to Bear Creek (locally known as Sand Spring Run), consisting of an 8-foot by 4-foot precast concrete box culvert. The crossing is located on East Lake Drive, approximately 300 feet east of the eastern shoreline of Bear Creek Lake (Wilkes-Barre East, PA Quadrangle N: 11.0 inches; W: 0.1 inch), in Bear Creek Village Borough, Luzerne County.

   E52-134.  Encroachment. Department of Transportation, Engineering District 4-0, P. O. Box 111, Scranton, PA 18501-0111. To construct and maintain four 18-inch stormwater outfall pipes at each of the I-84 bridges across York Creek, McConnell Creek and Raymondskill Creek to prevent erosion at the abutments, and to widen the existing bridge across McConnell Creek by 12 feet to accommodate a proposed acceleration lane. To remove the existing structure and to construct and maintain a roadway crossing of Billings Creek, consisting of three side-by-side 71-inch by 47-inch elliptical corrugated metal pipes. The project is located on S. R. 4004, Segment 0210, Offset 2200, approximately 0.2 mile west of the intersection of S. R. 0739 and S. R. 4004 (Pecks Pond, PA Quadrangle N: 21.2 inches; W: 9.2 inches), in Blooming Grove Township, Pike County.

   E54-215A.  Encroachment. Fanelli Development Company, 529 North Coal Street, Pottsville, PA 17901. To amend Permit No. E54-215 to place fill in an additional 0.13 acre of wetlands on building lot No. 40 and to utilize the Pennsylvania Wetlands Replacement Project in lieu of creating 0.24 acre of replacement wetlands. Permit No. E54-215 authorized the placement of fill in 0.11 acre of wetlands on three building lots in the Ridgeview Estates Subdivision for the purpose of constructing single family homes. This project is located at the intersection of Woodview Road and East Ridgeview Drive approximately 2,300 feet east of Liberty Street (S. R. 2013) (Orwigsburg, PA Quadrangle N: 3.8 inches; W: 13.3 inches) in Orwigsburg Borough, Schuylkill County.

   EA66-001NE.  Encroachment. Tunkhannock Township Supervisors, R. R. 2, Box 943, Tunkhannock, PA 18657. To remove all water obstructions and encroachments associated with the flood damaged Lazy Brook Acres residential subdivision situated within the 100-year floodway of Tunkhannock Creek and to regrade and restore the entire property to eliminate future flooding threats to life, property or the environment. The project consists of the following beginning approximately 20 feet downstream of Grant Avenue and extending downstream: A 91-foot long section of 16-foot wide by 6.4-foot high waterway opening concrete arch-box culvert, approximately 126 feet of vertical concrete wall channelization 16 feet wide, and an additional approximately 248-feet long section of 16-foot wide by 6.4-foot wide arch-box stream enclosure.

To fill a total of 0.43 acre of four wetland areas for the construction of a community park along the south side of North Boundary Road approximately 1 mile east of S. R. 0019 (Mars, PA Quadrangle N: 18.0 inches; W: 5.0 inches) located in Cranberry Township, Butler County. The requirement for replacement of impacted wetlands is being made by participation in the Pennsylvania Wetland Replacement Project.

   E10-240.  Encroachment. INDSPEC Chemical Corporation, 411 Seventh Avenue, Suite 300, Pittsburgh, PA 15219. To construct and maintain approximately 400 feet of retaining wall along the east bank of South Branch Bear Creek in front of the existing retaining wall varying in height from 4 feet to 14 feet in the INDSPEC facility approximately 700 feet northeast of the intersection of S. R. 0268 and S. R. 1006 (Parker, PA Quadrangle N: 3.6 inches; W: 12.65 inches) located in Petrolia Borough, Butler County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E16-095.  Encroachment. Department of Transportation, District 10-0, P. O. Box 429, Route 286 South, Indiana, PA 15701. To remove the existing Gravel Lick Bridge and to construct and maintain a three span steel grinder bridge having two 90.75-foot clear end spans and a 125.5-foot clear center span with a minimum underclearance of 25.4 feet across the Clarion River on S. R. 1001 approximately 1 mile south of S. R. 0036 (Cooksburg, PA Quadrangle N: 12.0 inches; W: 16.0 inches) located in Farmington and Millcreek Townships, Clarion County.

Request for Variance

   The Bureau of Deep Mine Safety has received a request for variance from the CONSOL Pennsylvania Coal Company. The following notification contains a summary of this request. Complete copies of the variance request may be obtained from Glen Ziegler by calling (717) 787-1376.

   The Department is publishing a summary of the request in order to solicit comments from affected parties on the proposed variance request. Comments may be used by the Bureau to assist in its investigation of the variance request. Comments will be accepted for 30 days following the publication of this notice. All comments should be addressed to James J. Brahosky, Acting Director, Bureau of Deep Mine Safety, P. O. Box 8463, Harrisburg, PA 17105-8463.

   Section 702 of The Bituminous Coal Mine Act (52 P. S. §§ 701--702) provides a mechanism for operators to obtain variances from specific requirements of the act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.

   Section 242(c) of The Bituminous Coal Mine Act requires that where belt conveyors are installed, main stoppings and regulators shall be so arranged as to reduce the quantity of air traveling in the belt conveyor entry to a minimum for effective ventilation and to provide an intake air split as an escapeway from the face area to the main air current.

   Summary of the request: CONSOL Pennsylvania Coal Company requests permission to use a three entry gate road system for development of all future longwall panels at the Bailey Mine. The three entry system's ventilation plan calls for a belt entry with an intake air split traveling outby (away from the face).
