SEWAGE FACILITIES ACT

PLAN APPROVAL

   The Department of Environmental Protection has taken the following actions on previously received permit applications and requests for plan approval and has issued the following significant orders.

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514), and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, 400 Market Street Floor 2, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure are also available in Braille or on audio tape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decisional law.

   The Department has received the following submissions, as submitted by Alfred Benesch and Company on behalf of the Greater Pottsville Area Sewer Authority (Authority), the City of Pottsville, and the Boroughs of Port Carbon and Palo Alto:

   --Corrective Plan and Schedule for the Authority's Main Wastewater Treatment Facility, Revised and Dated October 27, 1993

   --Resolution No. 145, Adopted July 18, 1994 by the Council of the City of Pottsville

   All of the previously-referenced submissions proposed a revision of the Authority's existing Corrective Plan and Schedule (CP&S) for its Main and West End Wastewater Treatment Facilities. The existing CP&S documents will be replaced by the revised CP&S documents, previously listed in this correspondence, for both the Main and West End Wastewater Treatment Facilities. The revised CP&S documents set forth systematic plans to reduce and eliminate the hydraulic and organic overload conditions which currently exist in the authority's wastewater collection, conveyance and treatment facilities. The CP&S documents also contain time schedules for the implementation of the activities listed in each CP&S.

   A substantial period of time has elapsed since the CP&S documents were submitted to the Department. Since the Department was unable to act on each CP&S in a timely manner, the schedules, in the CP&S documents for both the Main and West End Wastewater Treatment Facilities are quickly becoming outdated. The Department still considers the activities listed in the CP&S documents valid. However, the Department will expect a completely updated CP&S for both the Main and West End Wastewater Treatment Facilities to be included in the Official Sewage Facilities Plan Update Revision currently being prepared by Alfred Benesch and Company on behalf of the municipalities and the Authority.

   With this in mind, the Department hereby approves both CP&S document submissions. These documents are now to be considered an integral part of each municipality's Official Sewage Facilities Plan.

   In accordance with the provisions of the Pennsylvania Sewage Facilities Act, 35 P. S. §§ 750.1--750.20(a) (Act 537), and Chapter 71 of the Department's regulations (25 Pa. Code Ch. 71), the Department will hold the municipalities and the Greater Pottsville Area Sewer Authority responsible for the complete and timely implementation of the activities listed in the CP&S documents previously described. Noncompliance with any of the provisions of the approved CP&S documents may result in Departmental action against each municipality and/or the Greater Pottsville Area Sewer Authority.

   Additional wastewater-related improvements, additions, deletions or changes outside those explicitly described in the CP&S documents must be in compliance with the Department's Regulations and be submitted to and approved by the Department in writing.

   The Department's review of the sewage facilities update revision has not identified any significant negative environmental impacts resulting from this proposal.

This proposal involves the construction of the Rice Street Booster Pump Station to deliver water from the Hillside Filter Plant distribution system via the Rice Street tank to customers in Shavertown currently served by the Wood Street, Goeringer Avenue and Summit Street wells. This is located in Kingston Township, Luzerne County. Permit issued:  April 1, 1997.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

Under Act 2, 1995

Preamble 3

   The following final reports were submitted to the Department of Environmental Protection under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection to publish in the Pennsylvania Bulletin a notice of submission of any final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediations standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

   For further information concerning the final report, please contact the Environmental Cleanup Program in the Department of Environmental Protection Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate Regional Office listed. The report is intended to document remediation of the site to meet site-specific standards.

   Ingersoll-Rand Company Facility, City of Scranton, Lackawanna County. Barrett Group Environmental Services, 595 Bennett Street, Luzerne, PA has submitted a Final Report (on behalf of its client, Ingersoll-Rand Company, 605 Davis Street, Scranton, PA) site soils which were found to be contaminated with petroleum hydrocarbons. The report is intended to document remediation of the site to meet the Statewide health standard.

The Department granted a hazardous waste permit by rule determination of applicability to J&L Briquettes for a recycling operation involving the reuse of electric arc furnace dust from steel making operations by forming the dust, mill scale and binder materials into briquettes to be returned to the steel manufacturing plant. To remove the existing structure and to construct and maintain a five span bridge having a total normal clear span of 344.6 feet and a minimum underclearance of 34.5 feet across South Fork Branch of Little Conemaugh River. This permit also authorizes the placement and maintenance of fill in a de minimus area of wetlands less than or equal to 0.05 acre and the construction and maintenance of a temporary stream crossing consisting of ten 48-inch diameter CM pipes in South Fork Branch of Little Conemaugh River for the purpose of constructing the new proposed bridge. The project is located on SR 3024, Section 003, Segment 0190 Offset 0241 (Geistown, PA Quadrangle N:  18.0 inches; W:  4.8 inches in Adams and Croyle Townships, Cambria County.

   E65-660. Encroachment. Municipality of Murrysville, 4100 Sardis Road, Murrysville, PA 15668-1120. To remove the existing structure and to construct and maintain a 515-foot long enclosure consisting of a 78-foot long, 60-inch diameter pipe culvert; a transition chamber; and a 437-foot long, 48-inch diameter pipe culvert in an unnamed tributary to Haymakers Run (HQ-CWF) for the purpose of constructing a public service facility. The project is located approximately 200 feet south of the intersection of Sardis Road and Crowfoot Road (Murrysville, PA Quadrangle N:  15.0 inches; W:  5.7 inches) in the Municipality of Murrysville, Westmoreland County.

To remove a vegetated gravel bar, 175 feet by 30 feet, and to restore, protect with riprap, and maintain an eroded stream bank 250 feet long in Laning Creek. This project is located next to the eighteenth hole of the golf course about 1,500 feet west of Laning Creek Road (Towanda, PA Quadrangle N:  3.75 inches; W:  6.75 inches) in Wysox Township, Bradford County. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E18-229. Encroachment. Pa. Dept. of Transportation, 1924-30 Daisy St., Clearfield, PA 16830. To remove the existing structure and to construct and maintain a six span steel girder bridge with a total clear span of 1,157 feet and minimum underclearance of 39.9 feet across the west branch Susquehanna River. This project is located on Route 150 about 1 mile east of Jay Street (Lock Haven, PA Quadrangle N:  2.5 inches; W:  10.1 inches) in the City of Lock Haven, Castenea and Woodward Townships, Clinton County.

   E19-159. Encroachment. Fishing Creek Township Spvr., R. R. 2, Box 174, Orangeville, PA 17859. To remove the existing structure and to construct and maintain a corrugated aluminum box culvert with a 14 foot 5 inch span and 3 feet 3 inch rise, depressed 6 inches in Yost Run. This project is located on T-603 about 0.4 mile east of SR 1022 (Stillwater, PA Quadrangle N:  4.28 inches; W:  10.15 inches) in Fishing Creek Township, Columbia County. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E55-142. Encroachment. Snyder County Commissioners, c/o Robert H. Reigle, Snyder County Courthouse, P. O. Box 217, Middleburg, PA 17842. To remove the existing structure and to construct and maintain a two span prestressed adjacent concrete box beam bridge that will carry T-344 across the North Branch of Mahantango Creek. The proposed two span bridge shall be constructed with a total clear span of 117.0 feet, an average underclearance of 8.0 feet and a clear roadway width of 22.0 feet. The project is located along the western right-of-way of SR 0104 approximately 1,000.0 feet west of the intersection of T-344 and SR 0104 (Dalmatia, PA Quadrangle N:  7.9 inches; W:  15.9 inches) in Chapman Township, Snyder County.

To repair and maintain:  (1)  Golf Cart Bridge $10, having a span of 31.0 feet with an approximate underclearance of 4.0 feet across a Tributary to Saucon Creek with work consisting of the removal of the existing abutments, the construction and maintenance of new concrete abutments and the placement of R6 riprap for scour protection located at Grace Course Hole #4 (Allentown East, PA Quadrangle N:  9.1 inches; W:  2.0 inches); and (2)  Golf Cart Bridge #31, having a span of 43.8 feet with an approximate underclearance of 6.0 feet across Saucon Creek with work consisting of the repair of scour damaged abutments and the placement of R6 riprap for scour protection located at Grace Course Hole #14 (Allentown East, PA Quadrangle N:  10.2 inches; W:  0.1 inch). To construct and maintain a 6 foot by 12 foot cantilevered boat dock along the west bank of Mill Rift Pond. This project is located on the west side of S. R. 1017 (Delaware Drive) approximately 200 feet north of Township Road T-400 (Port Jervis North, PA Quadrangle N:  6.7 inches; W:  16.6 inches) in Westfall Township, Pike County.

To remove the existing superstructure and to construct and maintain a steel I-beam bridge with steel grating having a span of 38 feet and an underclearance of approximately 8 feet across Big Brook.    E31-134. Encroachment. Ralph Weiler, Jackson Township Supervisors, R. D. 1, Box 389A, Petersburg, PA 16669. To construct and maintain a single span bridge having a span of 43.53 feet and a minimum underclearance of about 5.64 feet across Standing Stone Creek and place fill in a deminimus area of wetlands to replace a structure destroyed during the January 19, 1996 flood event located on Township Road T-525 about 0.5 mile east of its intersection with Township Road T-543 (McAlevy's Fort, Quadrangle N:  7.3 inches; W:  8.4 inches) in Jackson Township, Huntingdon County. This permit also includes 401 Water Quality Certification.

   E34-086. Encroachment. Leslie J. Stottle, R. R. 1, Box 51, Honey Grove, PA 17035-9701. To repair the abutments and to maintain an existing bridge and to remove the concrete abutments at an abandoned railroad embankment across the channel at Willow Creek at a point just upstream of Route 850 (McCoysville, PA Quadrangle N:  5.3 inches; W:  7.8 inches) in Tuscarora Township, Juniata County. This permit also includes 401 Water Quality Certification.

   E36-628. Encroachment. PA Dept. of Transportation, Engineering District 8-0, John Rautzahn, 2140 Herr Street, Harrisburg, PA 17103. To remove the existing structure, construct and maintain a precast reinforced concrete box culvert with bottom baffles, having a normal span of 15.0 feet with an underclearance of 4.0 feet on an 85 degree skew in Boyers Run on SR 4032-001 (Mountain Road), Segment 0130, Offset 2120 (Manheim, PA Quadrangle N:  18.08 inches; W:  1.98 inches) in Penn Township, Lancaster County. The placement of R-5 rock riprap will impact a deminimus area of wetlands less than or equal to .05 acre. This permit also includes 401 Water Quality Certification.

   E44-083. Encroachment. Borough of Burnham, Bobbe McCalips, 200 First Avenue, Burnham, PA 17009. To construct and maintain a 48-inch outfall pipe with type D concrete endwall in Hungry Run as part of approved project to upgrade the existing storm sewer system located at the intersection of Walnut Street and Freedom Avenue (Burnham, PA Quadrangle N:  2.0 inches; W:  9.5 inches) in Burnham Borough, Mifflin County. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E67-579. Encroachment. William Carter, 421 Mundis Mill Road, York, PA 17402. To permit three previously constructed stone walls measuring 320 feet, 140 feet and 200 feet in the floodway of Codorus Creek north of Emig Road and Mundis Mill Road (York Haven, PA Quadrangle N:  2.8 inches; W:  12.6 inches) in Springettsbury Township, York County.    Project Description/Location:  This project involves the maintenance dredging of Lower Crum Reservoir on Crum Creek in Springfield Township, Delaware County. Approximately 30,000 cubic yards (average of less than 2 feet of sediment) of material will be removed from the bottom of the reservoir over the 10 acre area of open water from the dam to a point about 600 feet upstream. This proposed dredging activity follows emergency weed removal and dredging performed in June 1996 to remove sediments related to waste and odor problems in finished drinking water at the Crum Creek water treatment plant.

   Final Action on Request:  Certification Granted.
