ENCROACHMENTS The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).
Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, P. O. E15-540. Encroachment Permit. Violet L. Featherman, c/o John A. Featherman, III, 17 West Miner Street, P. O. Box 660, West Chester, PA 19381-0660. To encroach on approximately 360 linear feet of an unnamed tributary to Tweed Creek (TSF, MF) and to impact a deminimus amount of wetlands (0.03 acre) associated with the construction of the stormwater management facility (a nonjurisdictional dam) for the proposed residential subdivision owned by Violet Featherman. Issuance of this permit constitutes approval of the Environmental Assessment for this nonjurisdictional dam. The site is located along Forge Road (S. R. 3001) immediately north of its intersection with Shady Side Road (T-309) (Kirkwood, PA Quadrangle N: 1.5 inches; W: 2.0 inches), in East Nottingham Township, Chester County.
E46-755. Encroachment Permit. Limekiln Partners, L. P., 2421 Bristol Road, Warrington, PA 18975. To perform and maintain the following water obstructions and encroachments associated with the proposed Chestnut Creek Subdivision, located 3,700 feet southwest of the junction of Lower State Road and Limekiln Pike (SR 0152); (Ambler, PA Quadrangle N: 18.7 inches; W: 10.1 inches), in Horsham Township, Montgomery County.
1. To install 70 linear feet of a 15-foot by 3.25-foot roadway box culvert in and along a tributary to Little Neshaminy Creek and 0.24 acre of adjacent wetlands (PFO) for the proposed Stony River Drive stream crossing. Associated work includes: an 8-inch sanitary sewer line crossing of wetlands; a 12-inch utility line stream crossing: and an 18-inch stormwater outfall.
2. To install 145 linear feet of twin 15-inch RCP roadway culverts on 0.13 acre of wetland (PEM) for the proposed Stoney River Drive. Associated work includes: an 8-inch sanitary sewer line crossing and a 12-inch water line.
3. To install a dual 30-inch storm sewer utility line crossing of a wetland situated between lot Nos. 50 and 51.
4. Install approximately 1,405 linear feet of sanitary sewer line, crossing an estimated 0.64 acre of wetlands (PFO) along with one stream crossing between manhole Nos. D-5400 and 5434.
Issuance of this permit constitutes approval of the Environmental Assessment for three nonjurisdictional dams (Basin Nos. 2B, 4 and 5) which are proposed at the project site which will impact approximately 0.62 acre of wetlands.
The applicant proposes to construct 1 acre of replacement wetlands at the project site.
E51-160. Encroachment Permit. Fairmount Park Commission, Memorial Hall, West Park, Philadelphia, PA 19131. To excavate, place and maintain fill adjacent to the west side of the Schuylkill River (WWF-MF) and adjacent floodplain. This work is associated with the construction of a wetland restoration area and softball field which are part of the Bartram's Garden Wetland Restoration Project. The site is located just north of the point where 56th Street terminates at the Schuylkill River (Philadelphia, PA USGS Quadrangle N: 10.0 inches; W: 12.3 inches), in the City and County of Philadelphia. This permit was issued under section 105.13(e) ''small projects.'' This permit also includes 401 Water Quality Certification.
E09-713. Encroachment Permit. Wolfson-Verrichia Group, Inc., 621 East Germantown Pike, Suite 305, Norristown, PA 19401. To relocate and maintain 1,425 linear feet of Licking Run Creek (TSF), a tributary to Tohickon Creek and to impact 3.65 acres of an adjacent wetland (PF01A) associated with proposed Richland Crossing Retail Center. The project also includes installation and maintenance of a 108-foot long stream enclosure, and a 45-foot long and a 60-foot long culvert, each consisting of a 14-foot wide by 5-foot high reinforced concrete box, in and along the newly constructed stream channel. A low flow channel will be incorporated into the reconstructed channel. These stream crossings are associated with the construction of roadways in the proposed retail center. The site is situated between West End Boulevard (S. R. 0309) and California Road (S. R. 0405) at a point approximately 1,600 feet north from the intersection with John Fries Highway (S. R. 0663) (Quakertown, PA Quadrangle N: 13.5 inches; W: 14.75 inches), in Richland Township and Quakertown Borough, Bucks County. The permittee will provide 5.8 acres of replacement wetland.
E09-738. Encroachment Permit. Pennsylvania Department of Transportation, 200 Radnor-Chester Road, St. Davids, PA 19087. To modify, operate and maintain an existing 48-inch diameter C.M.P. stream enclosure in and along an unnamed tributary to Licking Run Creek (TSF) beneath West End Boulevard (S. R. 0309). The stream enclosure modification is associated with roadway improvements to facilitate access into the proposed Richland Crossing Retail Center. The work consists of removing 16 linear feet of the enclosure at the downstream end, and replacing it with a 25-foot long, 48-inch diameter reinforced concrete culvert pipe with concrete endwall and an 80-foot long rip-rap energy dissipater. The site is situated on West End Boulevard (S. R. 0309) approximately 1,300 feet north of its intersection with John Fries Highway (S. R. 0663) (Quakertown, PA Quadrangle N: 13.5 inches; W: 15.5 inches) in Richland Township and Quakertown Borough, Bucks County. This permit was issued under Section 105.13(e) ''small projects.'' This permit also includes 401 Water Quality Certification.

To remove an existing bridge and to construct and maintain a single span prestressed concrete box beam bridge having a clear span of 45.92 feet and an underclearance of about 3.83 feet across Globe Run located on SR 0305, Section 002, about 5 miles N. E. of Petersburg Borough (Donation, PA Quadrangle N: 22.1 inches; W: 14.8 inches) in West Township, Huntingdon County. This permit also includes 401 Water Quality Certification.
E67-505. Encroachment. Chanceford Township, Donald Heffner, P. O. Box 115, Brogue, PA 17309. To reissue Permit No: E67-505 which authorized the removal of an existing structure and the construction and maintenance of Kline Road Bridge No. 365 having a clear span of 42 feet with a minimum underclearance of 5 feet across Otter Creek on T-616 (Safe Harbor, PA Quadrangle N: 2.6 inches; W: 3.9 inches) in Chanceford Township, York County. This permit also includes 401 Water Quality Certification.
Northcentral Region: Water Management--Soils and Waterways, F. Alan Sever, Chief, 208 West Third St., Williamsport, PA 17701.
Permit No. E08-317. Encroachment. Ronald Kline, R. R. 2, Box 341, Troy, PA 16927. To excavate an area approx. 1 acre by 5 feet deep for the purpose of removing clay underburden to be used to line a remote animal manure storage facility. The remaining material is to be placed back into the excavated areas. The project is located 1/4 of a mile east of SR 4017 in the floodway of a trib. to Leonard Creek approx. 3 miles north of East Troy (East Troy, PA Quadrangle N: 10.4 inches; W: 15.0 inches) in Springfield Township, Bradford County. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.
Permit No. E12-101. Encroachment. Patrick A. Reever, 3225 Biglerville Rd., Biglerville, PA 17307. To construct, operate and maintain a private, seasonal dwelling in the floodway of First Fork Sinnemahoning Creek. The structure shall be constructed with a length of 18 feet, width of 16 feet and height of 12 feet that is located along the eastern right-of-way of SR 8072 approx. 3.4 miles north of the intersection of SR 0120 and SR 0872 (Sinnemahoning, PA Quadrangle N: 20.8 inches; W: 7.8 inches) in Grove Township, Cameron County. This permit was issued under Section 105.13(e) ''Small Projects.''
Permit No. 14-298. Encroachment. Thomas L. Stine, 161 Stine Lane, Port Matilda, PA 16879. To maintain two 6 foot diameter 20-foot long culverts in an unnamed trib. to Bald Eagle Creek located approx. 250 feet north of the SR 3023 (Reese Hollow Road) and T-303-3 (Laurel Run Road) intersection (Port Matilda, PA Quadrangle N: 7.20 inches; W: 11.30 inches) in Worth Township, Centre County. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.
Permit No. E19-166. Encroachment. Developers Realty Corp., P. O. Box 17335, West Hartford, CT 06117. To place and maintain fill in a 0.5 acre isolated palustrine emergent wetland for the purpose of constructing a retail business. The applicant proposes to construct 0.5 acre of onsite replacement wetlands. The project is located along the north side of Rt. 11, approx. 0.5 mile WSW of the Central Rd/Rt. 11 intersection (Bloomsburg, PA Quadrangle N: 1.6 inches; W: 6.9 inches) in Scott Township, Columbia County.
Permit No. E14-307. Encroachment. Timothy Hassinger, P. O. Box 55, Aaronsburg, PA 16820. To construct and maintain a concrete water supply intake 18 inches in diameter with a 4-inch diameter PVC pipeline and control valve for the purpose of directing water to three fish ponds from an unnamed trib. to a sinkhole which eventually resurfaces and empties into Elk Creek. Also to construct and maintain a 2-inch diameter PVC pipeline with a control valve to maintain existing water flow to an exceptional value wetland (Millheim, PA Quadrangle N: 7.9 inches; W: 12.4 inches) in Haines Township, Centre County. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

To stabilize and maintain the left bank of Troops Creek and the Cowanesque River at their confluence, with onsite material from an existing gravel dike for a length of approx. 836 feet (Knoxville, PA Quadrangle N: 14.15 inches; W: 9.0 inches) in Knoxville Borough, Tioga County.
