Acknowledgment of Notices of Intent to Remediate submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Sections 302 and 303 of the Land Recycling and Environmental Remediation Standards Act require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate identifies a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background or Statewide health standard to remediate a site must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department must provide a brief description of the location of the site, a list of known contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of the cleanup standards identified under the act will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department and shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

   Hart Metals, Inc., Tamaqua Boro, Schuylkill County. Douglas J. Shenk, Project Manager, ERM, 855 Springdale Drive, Exton, PA 19341 has submitted a Notice of Intent to Remediate (on behalf of his client, Reade Manufacturing Company, 100 Ridgeway Boulevard, Lakehurst, NJ 08733) concerning the remediation of site soils suspected to be contaminated with metals, petroleum hydrocarbons and polyaromatic hydrocarbons. In addition to those constituents, groundwater is also suspected to be contaminated with solvents and BTEX (benzene, toluene, ethylbenzene and xylenes). The applicant proposes to remediate the site to meet the Statewide human health standard.

   Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific cleanup standard, in whole or in part, and for sites determined to be located in Special Industrial Areas. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area by the person conducting remediation. For the sites identified, a municipality may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period a municipality may request that the person identified, as the remediator of a site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of a site. The applicant proposes to remediate the site to meet the site-specific standard. A summary of the Notice of Intent to Remediate was reported to have been published in the Lancaster Intelligencer Journal on April 30, 1998.

   Harrisburg International Airport, Lower Swatara Township and Middletown Borough, Dauphin County. Paul J. Bruder, Jr., Esq. has submitted a Notice of Intent to Remediate site soils contaminated with PCBs, heavy metals, solvents and PAHs and groundwater contaminated with solvents. The applicant proposes to remediate the site to meet the site-specific standard. A summary of the Notice of Intent to Remediate was reported to have been published in the Harrisburg Patriot News on May 1, 1998.

SOLID AND HAZARDOUS WASTE

RESIDUAL WASTE PROCESSING FACILITIES


Permit modification request under the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003); the Municipal Waste Planning, Recycling and Waste Reduction Act (53 P. S. §§ 4000.101--4000.1904); and the residual waste regulations for a general permit to operate residual waste processing facilities.

   General Permit No. WMGR053. Private Recycling Services, Inc., R. D. 2, Box 250A-1, Cochranton, PA 16314. A permit modification has been requested for the processing of off-specification or out-of-date consumer commodity-type materials in recyclable containers prior to beneficial use of the container materials. The requested revision would allow the use of mixed batch waste from PPG Industries as a solidification/stabilization agent. Mixed batch waste is composed primarily of sand, soda ash, dolomite, limestone and cullet dust. The modification request was received in this office on May 12, 1998.

AIR POLLUTION

Notice of Plan Approval and Operating Permit Applications

Nonmajor Sources and Modifications

   The Pennsylvania Department of Environmental Protection (Department) has developed an integrated plan approval, State operating permit and Title V operating permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

   The Department has received applications for plan approvals and/or operating permits from the following facilities. Although the sources covered by these applications may be located at a major facility, the sources being installed or modified do not trigger major new source review or prevention of significant deterioration requirements.

   Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the Regional Offices identified in this notice. Persons interested in reviewing the application files should contact the appropriate regional office.

   Persons wishing to file protests or comments on the proposed plan approval and/or operating permits must submit the protest or comment within 30 days from the date of this notice. Interested persons may also request that a hearing be held concerning the proposed plan approval and operating permit. Any comments or protests filed with Department Regional Offices must include a concise statement of the objections to the issuance of the plan approval or operating permit and relevant facts which serve as the basis for the objections. If the Department schedules a hearing, a notice will be published in the Pennsylvania Bulletin at least 30 days prior to the date of the hearing.

Notice of Intent to Issue Title V Operating Permits

   Under 25 Pa. Code § 127.521, notice is given that the Department of Environmental Protection (Department) intends to issue a Title V Operating Permit to the following facilities. These facilities are major facilities subject to the operating permit requirements under Title V of the Federal Clean Air Act and 25 Pa. Code Chapter 127, Subchapters F and G (relating to operating permit requirements; and title V operating permits).

   Copies of the Title V application, proposed permit and other relevant information are available for public inspection and additional information may be obtained by contacting the regional office noted.

   Interested persons may submit written comments, suggestions or objections concerning the proposed Title V permit to the regional office within 30 days of publication of this notice. Written comments submitted to the Department during the 30-day public comment period shall include the name, address and telephone number of the persons submitting the comments, along with the reference number of the proposed permit. The commentator should also include a concise statement of any objections to the permit issuance and the relevant facts upon which the objections are based.

   The Department reserves the right to hold a public hearing on the proposed action based upon the information received during the public comment period and will provide notice of any scheduled public hearing at least 30 days in advance of the hearing. OPERATING PERMITS


Notice of Intent to Issue Synthetic Minor State-Only Operating Permits for Certain Gasoline Distribution Facilities

   Under 25 Pa. Code § 127.424, the Department of Environmental Protection (Department) is providing notice of its intent to issue synthetic minor State-only operating permits to the gasoline distribution facilities shown below. These facilities have the physical and operation capacity to emit major source amounts of regulated pollutants, but are not considered major sources because the owners or operators of these facilities have taken Federally enforceable emission limits below major source thresholds to avoid requirements of Title III and/or Title V of the Clean Air Act. The Federally enforceable emission restrictions apply to the gasoline throughput for each facility.

   To qualify as an area source for Title III purposes or a nonmajor source under Title V in moderate ozone nonattainment areas, the maximum allowable emissions (after controls) shall be less than 50 tons per year of volatile organic compounds (VOCs) and 10 tons of a single hazardous air pollutant (HAP) or 25 tons per year of any combination of HAPs. The HAP emissions from these facilities include benzene, hexane, toluene, xylene and methyl-tertiary butyl-ether (MTBE). For purposes of Title V, other pollutants including carbon monoxide, sulfur dioxide, nitrogen oxides and PM-10 must also be emitted below the major source thresholds (see ''Title V facility'' definition in 25 Pa. Code § 121.1).

   The Department will issue the synthetic minor permits no later than June 15, 1998. As a result the gasoline distribution maximum achievable control technology (MACT) standard in 40 CFR Part 63, Subpart R will not apply to the gasoline bulk terminals and/or pipeline breakout stations listed in this notice. Title V operating permits will not be issued to these facilities. Copies of the ''synthetic minor'' application, the proposed permit and other relevant documents are available for public inspection during normal business hours in the Department's regional offices identified in this notice.

   Any person wishing to provide the Department with additional information which they believe should be considered prior to the issuance of these synthetic minor permits may submit the information to the appropriate Department's Regional Office. A 30-day comment period, from the date of this publication, will exist for the submission of protests or comments on the proposed permits. Each written protest or comment must include the name, address and telephone number of the commentator, the proposed permit number and a concise statement of the objections to the issuance of the permit and relevant facts which serve as the basis for the objections. If the Department schedules a public hearing, a notice of the date, time and location of the hearing will be published in the Pennsylvania Bulletin at least 30 days prior to the hearing.

   The final synthetic minor State-only operating permits will contain terms and conditions to ensure that these facilities comply with applicable requirements including monitoring, recordkeeping and reporting requirements.

   15-00043:  Sun Company, Inc. (R&M)--Malvern Terminal (41 Malin Road, Malvern, PA 19355) located in East Whiteland Township, Chester County. This is a Bulk Gasoline Terminal consisting of five Gasoline Storage Tanks and one Loading Rack. This is a major facility for volatile organic compounds (VOC) emissions and Synthetic Minor for hazardous air pollutants (HAP). The VOC emissions occur mainly during the gasoline loading operation.


Notice of Intent to Issue Synthetic Minor Operating Permit
Philadelphia County

   No later than June 15, 1998, the City of Philadelphia Air Management Services (AMS) intends to issue a synthetic minor operating permit (Permit Number M98-101) for hazardous air pollutants (HAPS) to Amoco Oil Company for the gasoline terminal located at 6310 West Passyunk Avenue, Philadelphia, PA 19153.

   The facility is a bulk gasoline terminal subject to the operating permit requirements under 25 Pa. Code Chapter 127, Subchapter F (relating to operating permit requirements). It applied for a synthetic minor operating permit for HAPS and accepted emission limitations to avoid being a major HAP facility subject to the Gasoline Terminal MACT requirements of 40 CFR 63.420. It's major sources of emissions include five gasoline storage tanks and a gasoline loading rack which without emission limitations would have the potential to emit major source levels of HAPS.

   Copies of the application, proposed permit and other relevant information are available for public inspection at Air Management Services, Spelman Building, 321 University Avenue, 2nd Floor, Philadelphia, PA 19104. An appointment to review the documents may be scheduled by contacting Brenda Bonner at (215) 685-7572 between 8 a.m. and 4:30 p.m., Monday through Friday, except holidays.

   Interested persons may submit written comments, suggestions or objection concerning the proposed Synthetic Minor permit to Thomas Huynh, Chief of Source Registration, Air Management Services, 321 University Avenue, Philadelphia, PA 19404 within 30 days of publication of this notice. Written comments submitted to AMS during the 30 day public comment period shall include the name, address and telephone number of the persons submitting the comments.

   AMS reserves the right to hold a public hearing on the proposed action based upon the information received during the public comment period and will provide notice of any scheduled public hearing at least 30 days in advance of the hearing. The hearing notice will be published in the Pennsylvania Bulletin and a newspaper of general circulation where the facility is located.

   No later than June 15, 1998, the City of Philadelphia Air Management Services (AMS) intends to issue a synthetic minor operating permit (Permit Number M98-103) for HAPS to Bayway Refining Company for the gasoline terminal located at G Street and Hunting Park Avenue, Philadelphia, PA 19124.

   The facility is a bulk gasoline terminal subject to the operating permit requirements under 25 Pa. Code Chapter 127, Subchapter F (relating to operating permit requirements). It applied for a synthetic minor operating permit for HAPS and accepted emission limitations in order to avoid being a major HAP facility subject to the Gasoline Terminal MACT requirements of 40 CFR 63.420. It's major sources of emissions include five gasoline storage tanks and a gasoline loading rack which without emission limitations would have the potential to emit major source levels of HAPS.

   No later than June 15, 1998, the City of Philadelphia Air Management Services (AMS) intends to issue a synthetic minor operating permit (Permit Number M98-102) for Hazardous Air Pollutants (HAPS) to Exxon Company, USA for the gasoline terminal located at 6850 Essington Avenue, Philadelphia, PA 19153.

   The facility is a bulk gasoline terminal subject to the operating permit requirements under 25 Pa. Code Chapter 127, Subchapter F (relating to operating permit requirements). It applied for a synthetic minor operating permit for HAPS and accepted emission limitations in order to avoid being a major HAP facility subject to the Gasoline Terminal MACT requirements of 40 CFR 63.420. It's major sources of emissions include five gasoline storage tanks and a gasoline loading rack which without emission limitations would have the potential to emit major source levels of HAPS.

   The Department reviewed the Reasonably Available Control Technology (RACT) plans and Emission Reduction Credits (ERC) application and made a preliminary determination to approve these plans and amendments to the State Implementation Plan (SIP) for the listed facilities.

   The proposed SIP revisions do not adopt any new regulations. They incorporate the provisions and requirements contained in the RACT approval for these facilities to comply with current regulations.

   The preliminary RACT determinations, if finally approved, will be incorporated into Plan Approvals and/or Operating Permits for the facilities and will be submitted to the United States Environmental Protection Agency (EPA) as revisions to Pennsylvania's State Implementation Plan.

   Cyprus chose a case-by-case approach to meeting the requirements of 25 Pa. Code § 129.92 for the thermal dryer, the frothing operations, solvent cleaning operation, storage tanks and fuel dispensing. Cyprus proposed low NOx burners as add-on controls for the thermal dryers as they were determined to be cost effective through a top-down analysis. Cyprus proposes there are no additional control technologies available for the frothing and degreasing operations. Cyprus proposes to meet the presumptive RACT requirements of 25 Pa. Code § 129.93 for all other sources at this facility.

   Cyprus has applied for ERC's for the reduction of 64 tons/year of NOx and 15 tons/year of VOC emissions generated through the shutdown of the thermal dryer at the Cumberland Mine as provided for in 25 Pa. Code § 127.207(5)(i).

   A public hearing will be held to receive comments on the RACT plan and ERC approval on July 7, at 10 a.m. at the Department of Environmental Protection Allegheny Conference Room, 400 Waterfront Drive, Pittsburgh. Deadline to register to speak is July 6, 1998.

Allegheny Ludlum Corporation (Allegheny)

   Allegheny chose a case-by-case approach to meeting the requirements of 25 Pa. Code § 129.92 for the electric arc furnaces, two annealing furnaces and the batch pickling operation. Allegheny proposes no additional controls as they were determined to be not cost effective through a top-down analysis. Allegheny proposes to meet the presumptive RACT requirements of 25 Pa. Code § 129.93 for all other sources at this facility. The conditions of the RACT permit as proposed limit facility wide NOx emissions to 191.6 tons/year and facility wide VOC emissions to 4.5 tons/year.

   Allegheny has applied for ERC's for the reduction of 7.78 tons/year of NOx and 8.7 tons/year of VOC emissions generated through the shutdown of three electric are furnaces at the Washington Plant as provided for in 25 Pa. Code § 127.207(5)(i).

   A public hearing will be held to receive comments on the RACT plan and ERC approval on July 7, 10 a.m. for Allegheny Ludlum at the Department of Environmental Protection Allegheny Conference Room, 500 Waterfront Drive, Pittsburgh. Deadline to register to speak:  July 6.

   A 30-day comment period from the date of publication will exist for the submission of written comments on both facilities.

This incinerator will perform with an efficiency adequate to reduce the VOCs emitted from the coating materials employed to a level meeting the requirement of 25 Pa. Code § 129.52. Based upon information supplied by United Coaters and Department's analysis of that information, current work practices in clean-up and paint mixing areas limit solvent emissions to a level for which further environmental benefit will require expenditures beyond the RACT guidelines.

   RACT Operating Permit 03-000-182 to Carnegie Natural Gas (Fisher Compressor Station) located in Redbank Township, Armstrong County. This facility uses two (2) engines to operate in compressing natural gas produced in Armstrong, Indiana, and Jefferson Counties. RACT for this station has been the installation of an AJAX Original Equipment Manufacture (OEM) lean combustion retrofit modification on the AJAX 600 DPC engine and implementation of Presumptive RACT on the Cooper GMVH-6 (1,350 BHP) engine. Comments should be addressed to Francis D. Condrick, air pollution control engineer.

   RACT Operating Permit 32-000-200 to Indiana University of Pennsylvania (Cogeneration Facility) located in Indiana, Indiana County. This facility provides both electric and thermal energy to the main university campus. RACT for this facility has been determined to be the installation of Cooper-Bessemer Cleanburn Combustion systems on the four dual fuel reciprocating engines and presumptive RACT on two coal fired boilers.    RACT Operating Permit 11-000-318 to Ebensburg Power Company (Cogeneration Plant) located in Cambria Township, Cambria County. This RACT Operating Permit will establish final RACT emission limitations and permit conditions. This RACT Operating Permit will be submitted to the United States Environmental Protection Agency as a revision to Pennsylvania's State Implementation Plan (SIP). The proposed revision to the SIP does not adopt any new state of Pennsylvania Regulations. Comments should be addressed to Noor Nahar, air pollution control engineer.

   RACT Plan Approval to Anchor Glass Container for Plant No. 5 located in Connellsville, Fayette County. RACT for this facility has been determined to be the immediate implementation of manual control of Air-to-Fuel ratios on Furnaces No. 1, No. 2, and No. 3 for a 15% reduction in NOx emissions. Additionally, Anchor shall install Combustion Staging on Furnaces No. 1 and No. 2 to reduce NOx emissions to 5.5 lbs. per ton of glass pulled. RACT for all sources at this facility will include their operation and maintenance in accordance with manufacturer's recommendations, and accepted air pollution control practices.
