SEWAGE FACILITIES ACT
PLAN APPROVAL


Plan approval granted under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).

   Regional Office: Water Management Program Manager, Southcentral Region, 909 Elmerton Avenue, Harrisburg, PA 17110.

   Location: Conestoga Township, Lancaster County, P. O. Box 98, Conestoga, PA 17516.

   The approved plan amendment modified new land development procedures in Township areas having elevated nitrate contamination in the groundwater. Specifically, it provides for the use of Component 1, new land development procedures in specific areas of the Township not demonstrating characteristics found in § 71.62 and provide for the use of de-nitrification technology for individual residential OLDS systems. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The following final reports were submitted to the Department of Environmental Protection under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act require the Department of Environmental Protection to publish in the Pennsylvania Bulletin a notice of submission of any final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

   For further information concerning the final report, please contact the Environmental Cleanup Program in the Department of Environmental Protection Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the Community Relations Coordinator at the appropriate regional office listed. To construct and maintain a 6-inch PVC sanitary sewer line crossing a de minimis amount of wetlands (PFO) and 10 L. F. of an unnamed tributary to Valley Creek (EV) located approximately 2,000 feet southeast of the intersection of U. S. Route 30 and S. R. 352 (Malvern, PA Quadrangle N: 6.5 inches; W: 7.5 inches) in East Whiteland Township, Chester County.

   E46-798.  Encroachment. PA Department of Transportation, 200 Radnor-Chester Road, St. Davids, PA 19087-5178. To remove an existing deteriorated single-span reinforced concrete slab bridge and to install and maintain a 47-foot long twin-cell precast concrete box culvert. Each cell will have a 12-foot span and an underclearance of 9 feet. The culvert invert will be depressed one foot and a one foot weir will be placed in the south cell. This stream crossing is located along Schoolhouse Run (TSF) at a point near the intersection of Gravel Pike (S. R. 0029, Section M02) and Schoolhouse Road (Collegeville, PA Quadrangle N: 15.9 inches; W: 10.9 inches) in Perkiomen Township, Montgomery County.

   E01-186.  Encroachment. New Oxford Municipal Authority, Earl Mummert, 409 Water Works Road, New Oxford, PA 17350. To relocate 540 feet of stream channel of an unnamed tributary to South Branch Conewago Creek by means of constructing and maintaining a 48-inch diameter by 698-foot long reinforced concrete pipe (RCP) enclosure in order to construct additional facilities at the existing waste water treatment plant located about 3,000 feet northwest of New Oxford Borough (McSherrystown, PA Quadrangle N: 21.0 inches; W: 9.3 inches) in Oxford Township, Adams County. This permit also includes 401 Water Quality Certification.

   E05-256.  Encroachment. Bedford County Development Association, Bette Slayton, 203 S. Juliana Street, Bedford, PA 15522. To construct and maintain a corrugated structural plate, arch pipe, 189-foot long stream enclosure having a span of 15.83 feet and a rise of 9.83 feet in Brush Run and to place fill in 0.16 acre of associated wetlands for a public access road into Bedford County Business Park located about 200 feet east of old US Route 220 about 2.4 miles north of PA Turnpike Interchange 11 (Bedford, PA Quadrangle N: 14.88 inches; W: 2.95 inches) in Bedford Township, Bedford County. The permittee is required to provide a minimum of 0.40 acre of replacement wetlands. This permit also includes 401 Water Quality Certification.

   E06-503.  Encroachment. Kutztown Borough, Keith Hill, 45 Railroad Street, Kutztown, PA 19530. To construct settling tanks at the Kutztown Borough Sewage Treatment Plant in the floodplain of Sacony Creek at a point approximately 400 feet downstream of Route 222 (Kutztown, PA Quadrangle N: 5.0 inches; W: 4.65 inches) in Maxatawny Township, Berks County. This permit was issued under § 105.13(e) ''small projects.'' This permit also includes 401 Water Quality Certification.

   E44-090.  Encroachment. PA Department of Transportation, Engineering District 2-0, Kim Bartoo, 1924-30 Daisy Street, P. O. Box 342, Clearfield, PA 16830. To remove an existing bridge and to construct and maintain a single cell reinforced concrete box culvert having a span of 7.11 meters and a rise of 2.370 meters in Little Kishacoquillas Creek located on SR 0655, Section A01, Segment 150, Offset 297 in the center of Belleville (Belleville, PA Quadrangle N: 14.1 inches; W: 19.1 inches) in Union Township, Mifflin County. This permit also includes 401 Water Quality Certification.

   E60-131.  Encroachment. Union County Commissioners, 103 S. 2nd St., Lewisburg, PA 17837. To remove the existing structure and to construct and maintain a 2 span prestressed concrete bridge with a clear span of 153 feet and minimum underclearance of 7 feet across Penns Creek located on RT 304 just north of Thomas Dam Road (Beavertown, PA Quadrangle N: 19.7 inches; W: 17.3 inches) in Hartley Township, Union County. Estimated stream disturbance is 150 feet of stream with 0.003 acres of permanent wetland impacts and 0.02 acres of temporary wetland impact; stream classification is HQ-CWF.

   E02-1010.  Encroachment. The Lane Construction Company, 965 East Main Street, Meriden, CT 06450-6006. To reissue and amend Permit No. E02-1010 to construct and maintain a 800 foot long barge docking facility consisting of embedded barges and maintain fill in 0.29 acres of wetlands (PFO) in and along the right bank of the Allegheny River (WWF), to perform slope restoration along the right bank of Riddle Run (WWF) from its confluence with the Allegheny River, upstream approximately 300 feet for the purpose of unloading gravel. The project is located near River Mile 17.0 New Kensington West, PA Quadrangle N: 7.0 inches; W: 3.0 inches) in Springdale Borough, Allegheny County. Permittee has fulfilled wetland replacement requirements by contributing to the Wetland Replacement Project.

   E02-1216.  Encroachment. Foltz Development Corporation, P. O. Box 401, Bridgeville, PA 15017. To place and maintain fill in approximately 0.08 acre of wetlands adjacent to an unnamed tributary to Chartiers Creek for the purpose of constructing the Ridgewood Condominium development. The project is located at the intersection of Boyce Road and Hunting Ridge Trail (Bridgeville, PA Quadrangle N: 14.1 inches; W: 17.4 inches) in South Fayette Township, Allegheny County. The permittee has met their wetland replacement obligation by contributing to the Wetland Replacement Project.

   E02-1223.  Encroachment. Chatfield Properties, LP, South Pittsburgh Technology Park, 3117 Washington Pike, Bridgeville, PA 15017-1496. To construct and maintain a 118 feet long by 11 feet high concrete gabion wall along the right bank of Coal Run (WWF). The project is located on the south side of Bursca Drive near its intersection with Washington Pike Road (S. R. 0519) Bridgeville, PA Quadrangle N: 17.8 inches; W: 15.6 inches) in South Fayette Township, Allegheny County. To remove the existing structure and to construct and maintain a single span bridge having a normal span of 16.0 feet and an underclearance of 6.3 feet across an unnamed tributary to Jacks Run for the purpose of improving transportation safety and roadway standards. The project is located on Bothwell Road (Greensburg, PA Quadrangle N: 13.7 inches; W: 3.7 inches) in Hempfield Township, Westmoreland County. This permit was issued under § 105.13(e) ''small projects.'' This permit also includes 401 Water Quality Certification.

   E65-689.  Encroachment. Hempfield Township Supervisors, R. R. 6, Box 500, Woodward Drive, Greensburg, PA 15601-9310. To remove the existing structure and to construct and maintain a single span bridge having a normal span of 12.0 feet and an underclearance of 5.5 feet across an unnamed tributary to Brush Creek for the purpose of improving transportation safety and roadway standards. The project is located on Old Route 66, approximately 0.25 mile north of its intersection with Route 66 (Greensburg, PA Quadrangle N: 17.0 inches; W: 8.5 inches) in Hempfield Township, Westmoreland County. This permit was issued under § 105.13(e) ''small projects.'' This permit also includes 401 water Quality Certification.

WATER QUALITY CERTIFICATION


Final actions under Section 401 of the Federal Water Pollution Control Act.

   The Department of Environmental Protection has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

   These actions of the Department may be appealed to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483, by any aggrieved person under The Environmental Hearing Board Act (35 P. S. § 7514); 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law). Appeals must be filed with the Environmental Hearing Board within 30 days from the date of this issue of the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Department's regulations governing practice and procedure before the Board may be obtained from the Board.

   The Port of Philadelphia & Camden, Inc., 3460 N. Delaware Avenue--Room 207, Philadelphia, PA 19134. The project involves the discharge of supernatant from the Ft. Mifflin Dredge Disposal Basin. The supernatant will be generated through the disposal of approximately 20,000 cubic yards of sediment dredged from the Delaware River at Pier 2 of the Philadelphia Naval Shipyard. 102/NPDES/Stormwater Construction Activities

   The Department of Environmental Protection (Department) Water Management Program will be holding a fact finding hearing on the following Stormwater NPDES permit application: David P. Spencer, Spencer Subdivision, PAS10-G319.

   The hearing is scheduled for June 30, 1998 at 1:30 p.m. at Chester County Conservation District Office, Government Services Center, Conference Room 380, 610 Westtown Road, West Chester, PA 19382-4519, Chester County. The hearing is being held to solicit pertinent comments on this application. The application is for stormwater construction activities, with a discharge to the White Clay Creek Watershed. A copy of this application is available for review in the Southeast Regional Office's Record Management Section. Telephone number (610) 832-6268. Comments should be kept brief and, depending on the number of speakers, may be limited to 10 minutes per speaker.
