Notice of De Minimis Settlement under the Hazardous Sites Cleanup Act
Mangan Property Site
Moore Township, Northampton CountyThe Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1305) (HSCA), has entered into a consent order and agreement for de minimis settlement with Keith Tamborelli (Tamborelli). The settlement is in regards to the Department's costs incurred at the Mangan Property Site (site). The site is located off East Beersville Road in Moore Township, Northampton County, PA.
The site formerly consisted, in part, of a storage shed attached to a barn where hazardous substances, including pesticides and herbicides, were stored. The structure, approximately 10 feet by 15 feet in size, contained residue from the storage of these materials. The wood flooring and side walls of the shed were contaminated with hazardous substances prior to the purchase of the property by Tamborelli. Tamborelli purchased the parcel of property which contained the storage shed, on August 20, 1998.
The site also consisted of two parcels of property, owned by Patrick J. Mangan (Mangan), which are located off of East Beersville Road. On September 3 and 4, 1998, the Department conducted a response action at the portion of the site which was owned by Mangan. During the response the Department and its contractor identified the areas on the two parcels owned by Mangan where hazardous substances had been dumped, collected samples for analysis and excavated and removed from the site the wastes and contaminated soils. The Department removed for proper disposal five rolloff containers of contaminated materials and one 55 gallon drum containing smaller containers of chemicals. The Department began the removal and subsequent disposal of additional contaminated soil and materials on October 26, 1998, and completed this second phase of the response on November 2, 1998.
On September 22, 1998, the Department met with its contractor to plan the removal and safe disposal of the materials contaminated with hazardous substances in and below the storage shed attached to the barn. This work was completed on November 2, 1998.
During the response action the Department identified the following hazardous substances and contaminants in the soil collected from the site: fonofos (dyfonate), hexachlorocyclohexane (lindane), toxaphene and alachlor.
On May 5, 1999, the Department collected soil samples from the area where the shed had been located. Analytical results of those samples demonstrated that soil which had been left on the site had concentrations of site-related contaminants below cleanup standards as promulgated by the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908). Under the proposed consent order and agreement the Department will receive a total of $1,000 from Tamborelli.
This notice is being provided under sections 1113 of HSCA. The proposed consent order and agreement is subject to final approval by the Department following the receipt and review of comments submitted by the public. The proposed consent order and agreement that contains the specific terms of the settlement is available for public review and comment. The proposed consent order and agreement can be examined from 8 a.m. to 4 p.m. at the Department's Bethlehem District Office at 4530 Bath Pike (Route 512) in Hanover Township, Northampton County. A public comment period on the proposed consent order and agreement will extend until November 10, 1999. Persons may submit written comments regarding the proposed consent order and agreement to the Department by sending them to James Kunkle, DEP Project Officer, at the DEP Bethlehem Office at 4530 Bath Pike (Route 512) in Hanover Township, Northampton County or by delivering them to that office in person.

The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908) and Chapter 250 Administration of Land Recycling Program.
Provisions of 25 Pa. Code § 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediation Standards Act (act). Plans and reports required by provisions of the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of reuse of the property, and in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Tarro, Environmental Manager, Pennsylvania Air National Guard, 62 Olmstead Boulevard, Middletown, PA 17057, has submitted a Final Report concerning the remediation of site soil contaminated with BTEX, PHCs and PAHs. The Final Report demonstrated attainment of the Statewide health standard and was approved by the Department on July 8, 1999.
Lock Haven University of Pennsylvania--Former KCSD Vocational Agriculture Center and Athletic Fields, City of Lock Haven, Clinton County. Converse Consultants on behalf of their client Lock Haven University of Pennsylvania, has submitted a Final Report concerning the remediation of soil contaminated with heavy metals. The Final Report demonstrated attainment of the background standard and was approved by the Department on July 7, 1999.
Stroehmann Bakeries Roll Plant, Old Lycoming Township, Lycoming County. Converse Consultants on behalf of their client Stroehmann Bakeries, P. O. Box 976, Horsham, PA 19044, has submitted a Final Report concerning the remediation of site soil and groundwater contaminated with solvents, BTEX and PHCs.
