SEWAGE FACILITIES ACT
PLAN APPROVAL


Actions under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).

   Southeast Regional Office:  Sewage Planning Specialist Supervisor, Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428.

   The Plan Approval is granted for a revision to the Official Sewage Facilities Plan of Newtown Township, Delaware County. This revision provides for adequate sewage facilities planning to permit the development of a 41,200 square foot office building and 372 age restricted apartment units with community center/recreation facility on 41.3 acres. This project is located on the east side of Route 252, 0.7 mile south of Route 3, in Newtown Township, Delaware County. In addition, 8 homes of Dogwood Place and the two former Benson office buildings will be connected to the proposed treatment facility. This project will generate 85,000 gallons of sewage per day treated at a new wastewater treatment facility with a discharge to Hunters Run. The treatment facility will be owned and operated by Little Washington Wastewater Company, a subsidiary of Philadelphia Suburban Corporation as a Public Utility Commission regulated facility. A Water Quality Part II permit is required for the facility.


Plan revision approval granted under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20) Act 537 Plan, Special Study, Sewer Renovation 3, Borough of Marion Center and East Mahoning Township, Indiana County.

   Regional Office:  Water Management Program Manager, Southwest Region, 400 Waterfront Drive, Pittsburgh, PA 15222-4745, (412) 442-4000.

   Location:  The Marion Center Sewage Treatment Plant will be located in East Mahoning Township approximately 700 feet west of the Marion Center Borough municipal boundary on the eastern side of S. R. 0119 and 1,300 feet south of the intersection of S. R. 0119 and S. R. 0403. Discharge from the sewage treatment plant will be to Pine Run in East Mahoning Township, Indiana County.

   Project:  Approval of an Official Sewage Facilities Plan Update for Marion Center Borough and East Mahoning Township, Indiana County. Project involves construction of a 0.090 mgd sewage treatment facility in East Mahoning Township with collection and conveyance facilities to serve Marion Center Borough and a portion of East Mahoning Township. The treatment facility will discharge to Pine Run.

   The Department's review of the sewage facilities update revision has not identified any significant impacts resulting from this proposal.

   Location:  The Armagh Sewage Treatment Plant will be located approximately 3,000 feet north of the municipality's boundary of Armagh Borough and East Wheatfield Township on the east side of S. R. 0056. This plant location is approximately 3,400 north of the intersection of S. R. 0056 and S. R. 0022. Discharge from the sewage treatment plant will be to Mardis Run in East Wheatfield Township, Indiana County.

   Project:  Approval of an Official Sewage Facilities Plan Update, Armagh Borough and East Wheatfield Township, Indiana County. Project involves construction of a 0.110 mgd sewage treatment facility in East Wheatfield Township with collection and conveyance facilities to serve Armagh Borough and a portion of East Wheatfield Township. The treatment facility will discharge to Mardis Run.

   The Department's review of the sewage facilities update revision has not identified any significant impacts resulting from this proposal.

   Location:  The Heilwood Sewage Treatment Plant will be located along the south side of T. R. 663 approximately 200 feet west of the intersection of T. R. 633 and S. R. 0403 in Pine Township, Indiana County. The discharge from the sewage treatment plant will be to Yellow Creek in Pine Township, Indiana County.

   Project:  Approval of an Official Sewage Facilities Plan Update for Pine Township, Indiana County. Project involves construction of a 0.040 mgd sewage treatment facility in Pine Township, Indiana County, with collection and conveyance facilities to serve the Village of Heilwood. The treatment facility will discharge to Yellow Creek.

   The Department's review of the sewage facilities update revision has not identified any significant impacts resulting from this proposal.

SAFE DRINKING WATER


Actions taken under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1--721.17).

   Southeast Regional Office:  Sanitarian Regional Manager, Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428-2233, (610) 832-6130.

   Permit No. 1500506. Public Water Supply, Woods at Rock Raymond, 1518 Meadowbrook Lane, West Chester, PA 19380. A permit has been issued to Woods at Rock Raymond for the construction of a booster pump station to serve the Woods at Rock Raymond Subdivision. The station will consist of two service pumps and one jockey pump in Caln Township, Chester County. Type of Facility: Public Water Supply System. Consulting Engineer: Evans Mill Environmental, Inc., 101 Fellowship Road, Uwchland, PA 19480. Permit to Construct Issued: September 15, 2000.

   Permit No. 5100501. Public Water Supply, Philadelphia Water Department, 1101 Market Street, Philadel-phia, PA 19107. A permit has been issued to the City of Philadelphia for the construction of an oxidant feed system for the Belmont Water Treatment Plant and the Queen Lane Water Treatment Plant. The Belmont Water Treatment Plant project includes construction of a chemical feed building and two 20,000 gallon concrete potassium permanganate solution storage tanks. The Queen Lane Water Treatment Plant project includes construction of a chemical feed building and conversion of two existing 40,000 gallon chemical storage tanks to solution storage tanks in the City of Philadelphia, Philadelphia County. Type of Facility: Public Water Supply System. Consulting Engineer: BCM Engineers, Inc., 920 Germantown Pike, Suite 200, Plymouth Meeting, PA 19462. Permit to Construct Issued: September 21, 2000

   Regional Office:  Northcentral Field Operations, Environmental Program Manager, 208 West Third Street, Suite 101, Williamsport, PA 17701.

   Permit No. 5500503. The Department issued a construction permit to Middleburg Municipal Authority, 13 North Main Street, Middleburg, PA 17842, Middleburg Borough, Snyder County. This permit authorizes construction of a third traveling bridge filter unit, changes to the piping in the clarifier building and changes and additions to the plant operation monitoring equipment.

   Permit No.6214. The Department cancelled an Operation Permit to Middleburg Borough Water Authority, 13 North Main Street, Middleburg, PA 17842, Middleburg Township, Snyder County. The permit was found to be active but their approved facilities are no longer in use, so therefore, the permit has been cancelled.

   Permit No. 5584502. The Department cancelled an Operating Permit to Middleburg Borough Water Authority, 13 North Main Street, Middleburg, PA 17842, Middleburg Township, Snyder County. The permit was found to be active but their approved facilities are no longer in use, so therefore, the permit has been cancelled.

   Permit No. 8699. The Department cancelled an Operation Permit to Middleburg Borough Water Authority, 13 North Main Street, Middleburg, PA 17842, Middleburg Township, Snyder County. The permit was found to be active but their approved facilities are no longer in use, so therefore, the permit has been cancelled.

HAZARDOUS SITES CLEAN-UP

Under the Act of October 18, 1988

Settlement Under the Hazardous Sites Cleanup Act

Chester County

   The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) (42 U.S.C.A. §§ 9601--9675), has entered into a settlement relating to the cleanup of the National Precision Casting HSCA Site located at 175 Ravine Road, East Whiteland Township, Chester County, PA (Site). The settlement involves a Consent Order and Agreement between the Department and Ravine Road, L.P. and J. V. D'Ascenzo Construction Company (Settlor), who are potentially responsible parties as current owners of the Site. Settlor did not cause or contribute to the release or threatened release of hazardous substances at the Site.

   The Site is a former foundry that was used for casting ferrous and nonferrous molds. Beginning in 1994, the Department conducted an investigation of the Site which revealed contamination of soils at the Site with substances including beryllium, chromium, copper, nickel, lead, zinc, antimony, magnesium, and manganese. In addition, installation and sampling of groundwater monitoring wells at the Site revealed contamination of groundwater with trichloroethylene (TCE). Beginning in November of 1995 through March, 1996, the Department implemented a prompt interim response at the Site. The interim response was carried out at the Site in a manner not inconsistent with the National Contingency Plan (NCP), 40 CFR Part 300, requirements for CERCLA removal actions. As of the date of the Consent Order and Agreement, groundwater contamination remains at the Site at levels above the Maximum Contaminant Level (MCL) for TCE in residential wells. Under the terms of the proposed Consent Order and Agreement, Settlor will make an immediate payment of $9,000 for response costs incurred or to be incurred by the Department in connection with the Site.

   This notice is provided under section 1113 of HSCA (35 P. S. § 6020.1113). The Department will provide for a 60-day public comment period on the proposed Consent Order and Agreement from the date of publication of this Notice. The proposed Consent Order and Agreement may be examined from 8 a.m. to 4 p.m. at the Department's office at Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428, by contacting David Minsker at (610) 832-6193 or Paul Rettinger at (610) 832-6300 during normal business hours. Persons may submit written comments to David Minsker at the above address. The Department will provide a response to all significant written comments received during the public comment period, and the proposed Consent Order and Agreement authorizes the Department to withhold or withdraw its consent in the event that the Department determines, based on comments received during the public comment period, that the Consent Order and Agreement is inappropriate, improper or not in the public interest.

Notice of Interim Response

Milford Township, Bucks County

Mount Milford Site

   The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1304) (HSCA) has initiated a prompt interim response at the Mount Milford Site in Milford Township, Bucks County, PA. This response has been undertaken under sections 501(a) and 505(b) of HSCA.

   The Mount Milford Site is located at 1940 Upper Ridge Road, Milford Township, Bucks County. The Site consists of an abandoned home and a construction-type trailer located behind the home. The trailer was found to contain about 160 five-gallon pails that were labeled ''hazardous'' and ''flammable'' during an inspection of a complaint by the Department's Waste Management Program. The site was subsequently referred to the HSCA program. The HSCA Program with the assistance of the Emergency Response Team, conducted an entry in the trailer in order to obtain samples from the pails. UVIR and Flashpoint sampling analyses were performed on the samples collected during this entry.

   The results of the Flashpoint analysis by the Department's Bureau of Labs determined that the contents of the buckets are considered to be hazardous wastes (Ignitibility) as defined by 25 PA Code § 261.21. The trailer in which the pails were located became contaminated by waste leakages from the containers. The total volume for the 160 pails is estimated at 800 gallons.

   The Department considered two alternatives:  1)  No action, which would allow the pails to remain at their present location, and 2)  The removal and proper disposal of the pails. The Department determined that the no action alternative would not be protective of public health or safety or the environment. Deterioration of the pails and the trailer which would have resulted in the release of the pails' contents posed an ignition hazard and would have resulted in soil contamination, potential groundwater contamination and a direct contact threat to persons exposed to the drums' contents.

   The Department bulked and secured the pails during September 11--21, 2000. This action was taken prior to the development of the Administrative Record to be protective of human health and safety and the environment.

   The Department is providing this notice under sections 505(b) and 506(b) of HSCA, and the publication of this notice starts the Administrative Record public comment period under HSCA. The Administrative Record which contains information about this site and which supports the Department's decision to perform this action at the site is available for public review and comment. The Administrative Record can be examined from 8 a.m. to 4 p.m. at the Department's Southeastern Regional Office located at Lee Park, 555 North Lane, Suite 6010, Conshohocken, PA 19428, by contacting Robert Zang at (610) 832-6152 for an appointment. The Administrative Record may also be reviewed at the Milford Township Building, 2100 Krammes Road, (215) 536-2090.

   The Administrative Record will be open for comment from the date of publication of this notice in the Pennsylvania Bulletin and will remain open for 90 days. Persons may submit written comments regarding this action to the Department until January 13, 2001, by mailing them to Robert Zang at the Pennsylvania Department of Environmental Protection, 555 North Lane, Suite 6010, Conshohocken, PA 19428.

   The public will have an opportunity to present oral comments at a public hearing regarding the action taken. The hearing has been scheduled for Tuesday, November 28, 2000, at 7 p.m. at the Milford Township Building, 2100 Krammes Road, P. O. Box 86, Spinnerstown, PA 18968. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

   For further information concerning the final report, contact the Environmental Cleanup Program Manager in the Department Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate regional office listed. The report is intended to document remediation of the site to the Statewide health standard.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908) and Chapter 250 Administration of Land Recycling Program.

   Provisions of 25 Pa. Code § 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediations Standards Act (Act). Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report, and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of reuse of the property, and in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

   Former Recycle Metals Corp., Parcel ''A'', Proposed Lankford Autoplex, Plymouth Township, Montgomery County. Christopher G. Barricklow, Enco Tech Midwest, Inc., 39255 Country Club Drive, Suite B40, Farmington Hills, MI 48331, has submitted a Final Report concerning remediation of site soil contaminated with PCBs and lead. The report demonstrated attainment of the Statewide health standard and was approved by the Department on August 28, 2000.

   Former Braun Iron Works, Upper Moreland Township, Montgomery County. Laura L. Peck, Law Office of Janet S. Kole, 900 Haddon Avenue, Suite 412, Collingswood, NJ 08108, has submitted a Final Report concerning remediation of site soil contaminated with lead. The report demonstrated attainment of the Statewide health standard and was approved by the Department on August 29, 2000.

   Transit America, Inc., City of Philadelphia, Philadelphia County. Robert S. Hyams, Transit America, Inc., One Red Lion Road, Philadelphia, PA 19115, has submitted a supplemental Final Report concerning remediation of site groundwater contaminated with solvents and BTEX and a Final Report concerning remediation of site soils contaminated with PCBs, heavy metals, solvents, BTEX, petroleum hydrocarbons and polycyclic aromatic hydrocarbons. The reports demonstrated attainment of the site-specific standard for groundwater and the Statewide health and site-specific standards for soils and were approved by the Department on September 8, 2000.

   Sunoco, Former No. 3 Tank Farm, Bethel Township, Delaware County. James Mulry, Mulry & Cresswell Environmental Inc., 1691 Horseshoe Pike, Suite 1, Glenmoore, PA 19343, has submitted a Final Report concerning remediation of site soil and groundwater contaminated with BTEX, petroleum hydrocarbons and polycyclic aromatic hydrocarbons. The report demonstrated attainment of the Statewide health standard and was approved by the Department on September 11, 2000.

   St. Alban's Circle Project, Newtown Township, Delaware County. L. Sherrerd Steele, ePhase Inc., P. O. Box 44, West Chester, PA 19381-0044, has submitted a Final Report concerning remediation of site soil contaminated with polycyclic aromatic hydrocarbons. Michael Gonshor, P.G., Roux Associates, Inc., 1222 Forest Parkway, Suite 190, West Deptford, NJ 08066, has submitted a Final Report concerning remediation of site soil contaminated with PCBs, lead, heavy metals, solvents, BTEX, petroleum hydrocarbons and polycyclic aromatic hydrocarbons. The report demonstrated attainment of the Statewide health standard and was approved by the Department on September 11, 2000.

   Chester Waterfront Redevelopment Project Site, City of Chester, Delaware County. Robin A. Hoy, PECO Energy Company, 2301 Market Street, P. O. Box 8699, Philadelphia, PA 19101-8699, has submitted a Remedial Investigation/Risk Assessment/Remedial Alternatives Analysis Report, concerning remediation of site soil contaminated with PCBs, lead, heavy metals, pesticides, solvents, BTEX, petroleum hydrocarbons and polycyclic aromatic hydrocarbons and groundwater contaminated with lead, heavy metals, pesticides, solvents, BTEX, petroleum hydrocarbons, and polycyclic aromatic hydrocarbons. The report was approved by the Department on September 11, 2000.

   Former Metro Container Corp., Inc., Trainer Borough, Delaware County. Carl J. Bones, Pennoni Associates, Inc., 3001 Market Street, Philadelphia, PA 19104, has submitted a Remedial Investigation and Risk Assessment Report, concerning remediation of site soil and groundwater contaminated with PCBs, lead, heavy metals, solvents, BTEX and polycyclic aromatic hydrocarbons. The report was found deficient and disapproved by the Department on September 14, 2000.

   Wending Creek Farms, Sweden Township, Potter County. Environmental Remediation & Recovery, Inc., on behalf of its client Agway Insurance Company, P. O. Box 4851, Syracuse, NY 13221, has submitted a Final Report concerning the remediation of site soil contaminated with BTEX, PHCs and PAHs. The Final Report demonstrated attainment of the Statewide Health Standard and was approved by the Department on September 20, 2000.

The Title V facility's air emission sources include 14 mixers, six mills, 21 mixing and storage tanks, two dispensing units, one transfer operation, one 2.5 MMBTU/hr natural gas-fired boiler, one 1.49 MMBTU/hr natural gas-fired air handling unit and one 1.44 MMBTU/hr natural gas-fired air handling unit. The facility's air emission control devices include three dust collectors.

   96-047:  House of Corrections (8001 State Road, Philadelphia, PA 19136) issued a Title V Operating Permit on September 15, 2000, for operation of a correctional institution that houses inmates in the City of Philadelphia, Philadelphia County. The Title V facility's air emission sources include 37 boilers and hot water heaters that burn natural gas or #2 fuel oil; 32 units have a heat input less than 10 MMBTU/hr, five units have a heat input between 10 and 12 MMBTU/hr. Other air emission sources include 12 emergency generators and one perchloroethylene dry-to-dry machine and ancillary equipment.

   95-030:  Inolex Chemical Co. (Jackson and Swanson Streets, Philadelphia, PA 19148) issued a Title V Operating Permit on September 25, 2000, for operation of a chemical manufacturing facility. The facility's air emission sources include a 52 MMBTU/hr boiler (limited to 49 MMBTU/hr), a 12.5 MMBTU/hr boiler, a 6.5 MMBTU/hr boiler, 7 reactors, a reactor tank, a vent condenser and an adipic silo. The facility's air emission control devices include three scrubbers and two baghouses.

   95-012:  Philadelphian Condominiums (2401 Pennsylvania Avenue, Philadelphia, PA 19130) issued a Title V Operating Permit on September 25, 2000, for operation of a condominium building. The facility's air emission sources include a 2200 HP engine, two 600 HP boilers and two 200 HP boilers.
