FINAL ACTIONS TAKEN UNDER THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

DISCHARGE OF CONTROLLED INDUSTRIAL WASTE AND SEWERAGE WASTEWATER

(Part I Permits)

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications and requests for plan approval and has issued the following significant orders.

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decisional law.

SEWAGE FACILITIES ACT
PLAN APPROVAL


Plan approval granted under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).

   Northeast Regional Office:  Water Management Program Manager, 2 Public Square, Wilkes-Barre, PA 18711-0790, (570) 826-2511.

   Stroud Township, Monroe County. The Department has completed its review of the Official Act 537 Sewage Facilities Plan Update Revision (Plan) for the Bartonsville Sewer Extension and Areas of Possible Sewer Extensions for Stroud Township, Monroe County, dated September 29, 2000. The Department has found that the Plan is acceptable and granted planning approval on November 3, 2000.

   The Plan approves planning for the proposed State Route 611 Bartonsville Sewer Extension which includes a sewage collection and conveyance line, a sewage force main, and sewage pumping station. The proposed sewer extension will serve the facilities that are served by the Stroud Township WWTP (when it is removed from service) and other existing Commercial and Residential Properties.

   The Department's review of the Plan has not identified any significant environmental impacts resulting from the proposals. In accordance with the provisions of the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.12(a)) (Act 537), and 25 Pa. Code Chapter 71, the Department will hold the Township responsible for the complete and timely implementation of the chosen alternative, as stated in the Plan's Schedule of Implementation, located in the Plan Summary.

SAFE DRINKING WATER


Actions taken under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1--721.17).

   Permit 5499503. Public Water Supply. Eagle Rock Utility Corporation, Randy Grace, 3500 Maple Ave., Suite 1400, Dallas, TX 75206-4146. This proposal involves the approving of a 200 gpm well, a sodium hypochlorite disinfection facility with control building, a 200,000 gallon glass lined-steel storage tank, and extensions of the existing distribution piping. It is located in Hazle Township, Luzerne County. Permit issued on January 6, 2000.

   Permit 3900503. Public Water Supply. Colonial Crest Water System, Bernard A. Rodgers, Twp. Manager, 5500 Camp Meeting Rd., Center Valley, PA 18034. This proposal involves a new well pump of increased capacity, new chlorination system and equipment to feed a phosphate chemical for corrosion control not associated with the lead copper rule. It is located in Upper Saucon Twp., Lehigh County. Permit issued on October 24, 2000.

   Permit 4800503. Public Water Supply. Hellertown Borough Authority, David Reigel, Authority Secretary, 501 Durham Street, Hellertown, PA 18055. This proposal involves construction of a new well source with associated wellhouses providing chemical disinfection. A 550 foot, 24 inch diameter water line will be constructed to obtain the required chlorine contact time. It is located in Hellertown Borough, Northampton County. Permit issued on October 24, 2000.

HAZARDOUS SITES CLEAN-UP

Public Notice of Proposed Consent Order and Agreement

R. O. Murphy and Langner/Murphy Sites

Allegheny Township, Butler County and Pine Township, Mercer County

   Under section 1113 of the Hazardous Sites Cleanup Act (35 P. S. § 6020.1113) (HSCA), notice is hereby provided that the Department of Environmental Protection (Department) has agreed to a Consent Order and Agreement (CO&A) with David B. Murphy and Langner Enterprises, Inc., (LEI) concerning the resolution of their liability forthe R. O. Murphy Site, and the Langner and Murphy Site (collectively, the ''Sites''). The R. O. Murphy Site is located adjacent to, and north of, Route 58, approximately 2.75 miles east of the village of Six Points, in Allegheny Township, Butler County, Pennsylvania. The Langner and Murphy Site is located at the northeast corner of the intersection of Township Road 878 (Diamond Road) and Route 208, in Pine Township, Mercer County, Pennsylvania.

   In the past, hazardous substances were disposed at the Sites and these substances contaminated the environment at the Sites. The Department has incurred more than $223,000 in response costs at the R. O. Murphy Site. The Department estimates that it will expend additional funds to abate the release and threatened release of hazardous substances at the Langner and Murphy Site. As an owner and operator of the Sites during the time of the release and threatened release of hazardous substances at the Sites, David B. Murphy and LEI are each a ''responsible person'' as defined in section 103 of HSCA (35 P. S. § 6020.103).

   Based upon Mr. Murphy and LEI's available assets and their certification concerning their financial condition, the Department has determined that Mr. Murphy and LEI cannot pay for all or any substantial portion of the response costs at the Sites. Accordingly, to resolve the foregoing matters without litigation, the Department and Mr. Murphy and LEI have agreed to enter into this inability to pay settlement. Under the terms of the CO&A, Mr. Murphy and LEI shall, among other things, pay a total of $32,433 to the Hazardous Sites Cleanup Fund, and Mr. Murphy will also convey title to the Langner and Murphy Sites to a nonprofit entity designated by the Department.

   A prompt interim response action was completed at the R. O. Murphy Site in 1999. The Department anticipates that the response action may be conducted at the Langner and Murphy Site during the 2001 construction season. This response will help mitigate the threat to human health and the environment posed by the hazardous substances there.

   The specific terms of this settlement are set forth in the CO&A between the Department and Mr. Murphy and LEI. The Department will receive and consider comments relating to the CO&A for 60 days from the date of this Public Notice. The Department has the right to withdraw its consent to the CO&A if the comments concerning the CO&A disclose facts or considerations which indicate that the CO&A is inappropriate, improper, or not in the public interest. After the public comment period, the Department's settlement with Mr. Murphy and LEI shall be effective upon the date that the Department notifies Mr. Murphy and LEI, in writing, that this Consent Order and Agreement is final and effective in its present form, and that the Department has filed a response to significant written comments to the CO&A, or that no such comments were received.
