FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)).

   Except as otherwise noted, the Department certifies that the construction and operation herein described will comply with the applicable provisions of Sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317), and that the construction will not violate applicable Federal and State Water Quality Standards.

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to Administrative Agency Law), to the Environmental Hearing Board (Board), Second Floor, Rachel Carson State Office Building, P. O.    To perform the following activities associated with the restoration of the Springford Country Club Reservoir:

   1.  To construct and maintain a forebay area where the creek enters the reservoir by installing an approximately 6-feet high gabion wall.

   2.  To install and maintain an approximately 3-feet high gabion wall associated with stabilization of the existing eroded banks along portion of the west shoreline.

   This work also includes the removal of the accumulated sediment from the reservoir located within an unnamed tributary to Mingo Creek (WWF) in order to maintain the original impoundment capacity of the reservoir. The applicant also proposes to remove the former footbridge foundation pilings from the middle of the reservoir. The site is located approximately 1,500 feet northeast of the intersection of Royersford Road and Reifsnyder Road (Phoenixville, PA USGS Quadrangle N: 13.8 inches; W:  4.4 inches).

   To place fill in 0.21 acre of wetlands for the purpose of constructing an 18-hole golf course. The project includes three road crossings of wetlands (Crossing A-1: three 24-inch culverts, Crossing A-2: 24-inch culverts, and Crossing C: an 8-feet x 2.5-feet concrete box culvert) along access roads, and four single-span bridge crossings of wetlands along golf cart paths. The permittee is required to provide 0.25 acre of replacement wetlands. The site is located immediately south of the intersection of S.R. 4026 (Railroad Road) and S.R. 4014 (Church Road) (Slatedale, PA Quadrangle N: 15.1 inches; W: 7.6 inches).

   E39-393. LaFarge Corporation, 5160 Main Street, Whitehall, PA 18052-1827. Whitehall Township, Lehigh County, Army Corps of Engineers Philadelphia District.

   To modify and maintain an existing intake structure along the Lehigh River, with work consisting of constructing a steel bar screen against the face of the intake house. The intake opening is approximately 6 feet high by 5 feet wide. The project includes removal of stone fill, within an area of approximately 25 feet by 15 feet, which had been placed in the river during an emergency to facilitate clearing of the intake opening. The project is located along the west bank of the Lehigh River, approximately 300 feet south of the S.R. 329 (Main Street) bridge (Cementon, PA Quadrangle N: 11.7 inches; W: 0.5 inch).

   E54-281, Wesley J. Levan II, 145 North Tulpehocken Street, Pine Grove, PA 17963, Pine Grove Borough, Schuylkill County, ACOE Philadelphia District.

   To construct and maintain an approximate 30-feet x 26-feet wooden deck attached to an existing residential dwelling within the floodway of Swatara Creek. The project is located along Tulpehocken Street approximately 500 feet south east of the intersection of Tulpehocken Street and Outwood Road, (Pine Grove, PA Quadrangle N: 10.6 inches).

   To construct and maintain a 48-inch diameter outfall and its associated structures along the right bank of Goods Run (TSF) located immediately downstream of Baumgardner Road bridge (LR 36027) (Conestoga, PA Quadrangle N:  5.2 inches; W:  4.6 inches).

   E67-688. Kinard Truck, Incorporated, 310 N. Zarfoss Road, York, PA 17404 in West Manchester Township, York County, ACOE Baltimore District.

   To realign 1,400 linear feet of an unnamed tributary to the Codorus Creek (WWF) within a 6-feet bottom width turf matting lined trapezoidal channel and to construct two rail-line spur crossing with 90 linear feet of 6-feet by 2-feet diameter reinforced concrete box culverts at each crossing of the reconstructed channel located along the York railroad line between North Zarfoss Road and east side of SR 30. The permit also authorizes removal of an existing culvert and construction of a new 58-inches by 36-inches pipe arch culvert under North Zarfoss Road. The project is for the proposed 138,600 SF additional expansion of the Kinard Trucking Warehouse building (West York, PA Quadrangle N:  11.8 inches; W:  6.7 inches).

   E14-385. Craig and Kathleen Kissell, 2041 Cato Avenue, State College, PA 16801. Kissell Crossing, in Harris Township, Centre County, ACOE Baltimore District (State College, PA Quadrangle N: 5.6 inches; W: 0.5 inch).

   To remove the existing three cell structure which consists of a 24 inches, 36 inches and 42 inches culvert and to construct, operate and maintain a three cell culvert crossing containing a 42 inches culvert and two 36 inches relief culverts measuring 25 lineal feet in length. The 42 inch culvert shall be depressed 6 inches to convey the natural stream bed and aquatic habitat. This project is located .5 mile east on SR 322 from the intersection with SR 2001 (State College, PA Quadrangle, N: 5.6 inches, W: .5 inch) State College Borough, Centre County. This permit was issued under Section 105.13(e), Small Projects. This permit also includes 401 Water Quality Certification.

   E19-209. Pennsylvania Department of Transportation, Engineering District 3-0, P. O. Box 218, Montoursville, PA 17754. Bridge SR 2054, Sect. 02M, in Benton Township, Columbia County, ACOE Baltimore District.

   To maintain a 14.0 feet by 6.5 feet by 45.2 feet long cast-in place reinforced concrete box culvert on a 45 degree left ahead skew, depressed 1.0 foot into the streambed with an effective waterway opening of 14.0 feet by 5.5 feet and to maintain riprap along the northern bank of Colley Run. The bridge is located on SR 254 at Segment 380, offset 0000 over Cully Run approximately 1,000 feet south of the intersection of SR 487 with SR 0254 in Benton Township, Columbia County. This permit was issued under Section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

CERTIFIED EMISSION REDUCTION CREDITS IN PENNSYLVANIA'S ERC REGISTRY

   Emission reduction credits (ERCs) are surplus, permanent, quantified and Federally enforceable emission reductions used to offset emission increases of oxides of nitrogen (NOx), volatile organic compounds (VOCs) and the following criteria pollutants: carbon monoxide (CO), lead (Pb), oxides of sulfur (SOx), particulate matter (PM), PM-10 and PM-10 precursors.

   The Department of Environmental Protection (Department) maintains an ERC registry in accordance with the requirements of 25 Pa. Code § 127.209. The ERC registry system provides for the tracking of the creation, transfer and use of ERCs. Prior to registration of the credits, ERC Registry Applications are reviewed and approved by the Department to confirm that the ERCs meet the requirements of 25 Pa. Code §§ 127.206--208. Registration of the credits in the ERC registry system constitutes certification that the ERCs satisfy applicable requirements and that the credits are available for use. The following registered, and certified ERCs in the ERC Registry are currently available for use as follows:

   (1)  To satisfy new source review (NSR) emission offset ratio requirements;

   (2)  To ''net-out'' of NSR at ERC-generating facilities;

   (3)  To sell or trade the ERCs for use as emission offsets at new or modified facilities.

   The certified ERCs shown, expressed in tons per year (tpy), satisfy the applicable ERC requirements contained in 25 Pa. Code §§ 127.206--127.208. ERCs created from the curtailment or shutdown of a source or facility expire for use as offsets 10 years after the emission reduction occurs. ERCs generated by the over control of emissions by an existing facility do not expire for use as offsets. However, credits in the registry, which are not used in a plan approval, will be discounted if new air quality requirements are adopted by the Department or United States Environmental Protection Agency (EPA).
