FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications and requests for Environmental Assessment approval and requests for Water Quality Certification have been received by the Department of Environmental Protection. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)), requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA 33 U.S.C.A. §§ 1311--1313, 1316 and 1317 as well as relevant State requirements. Initial requests for 401 Water Quality Certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between the hours of 8 a.m. and 4 p.m. on each working day at the office noted above the application.

   Persons with a disability who wish to attend the hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings, should contact the specified program. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

   To remove an existing simple span steel truss bridge superstructure and to construct and maintain, in its place, a single span steel truss bridge superstructure across Manayunk Canal (WWF-MF). The proposed structure will have a clear span of 80 feet and an underclearance of 14.9 feet. The existing pier and north abutment substructure units will be reused during this project. This project is associated with the bridge superstructure replacement and roadway improvements for Fountain Street and will serve as a secondary access to Venice Island.

   The site is located approximately 400 feet southwest of the intersection of Umbria Street and Fountain Street (Germantown, PA-NJ USGS Quadrangle N:  5.6 inches; W:  15.1 inches).

   To authorize fill and excavation that has impacted approximately .50 acre of wetlands for the construction of the embankment and reservoir area associated with a nonjurisdictional dam. The project includes the conversion of approximately 0.25 acre of previously existing open water to wetlands as part of the wetland mitigation plan. The project is located along the south side of S. R. 1049 (Outlet Road), approximately 1.5 miles northwest of the intersection of S. R. 1049 and S. R. 0118.    To construct and maintain a single span bridge having a clear span of 15.0 feet and an underclearance of about 3.5 feet across an unnamed tributary to Sherman Creek (WWF) to access private property located along the south side of Fox Hollow Road (T-303) about 3.1 miles west of its intersection with SR 0034 (Shermans Dale, PA Quadrangle N:  8.8 inches; W:  11.9 inches).

   E67-698.  York County Commissioners, One West Marketway, York, PA 17401 in Hellam Township, York County, ACOE Baltimore District.

   To remove the existing structure, construct and maintain County Bridge No. 69 having a 40-foot clear span pre-stressed concrete box beam structure with a concrete deck having a 5-foot underclearance across Kreutz Creek (WWF) on Valley Aces Road (T-787) (Red Lion, PA Quadrangle N:  21.6 inches; W:  15.3 inches).

   E67-699.  Felton Borough, 88 Main Street, Felton, PA 17322 in Felton Borough, York County, ACOE Baltimore District.

   To construct and maintain two sanitary pump stations located within the 100-year floodplain of the North Branch Muddy Creek as part of the Felton Borough sanitary sewer system connected to a proposed wastewater treatment plant to be located on Water Street. The Beaver Street pump station is located on the west side of Beaver Street and the Water Street pump station along the east side of Water Street (Stewartstown, PA Quadrangle N:  18.65 inches; W:  8.8 inches.

   E14-395.  Robert C. Hall, 966 Ulrich Road, Julian, PA 16844. New secondary driveway culvert in Huston Township, Centre County, ACOE Baltimore District (Julian, PA Quadrangle N:  2.7 inches; W:  11.2 inches).

   1) To place and maintain a 48-inch diameter by 20-foot long plastic culvert pipe; 2) To construct and maintain 150 feet of flagstone streambank retaining walls; in an unnamed tributary to Laurel Run located 0.8 mile east-northeast from the intersection of SR 3030 and SR 3032 in Huston Township, Centre County. The project proposes to permanently impact 150 feet of the unnamed tributary to Laurel Run that is in an Exceptional Value Watershed.

   E14-396.  Ray Decker, Haines Township Supervisors, P. O. Box 244, Aaronsburg, PA 16820-0244. Replacing three road culverts pipes for Applebutter Road, in Haines Township, Centre County, ACOE Baltimore District (Millheim, PA Quadrangle N:  6.0 inches; W:  1.9 inches).

   1) To remove an existing culvert and then to place and maintain two 42-inch by 27-inch by 24-foot arch corrugated metal pipes with concrete headwalls and a waterway opening of 12.6 square feet; 2) to remove an existing culvert and then to place and maintain two 57-inch by 38-inch by 21-foot arch corrugated metal pipes with concrete headwalls and a waterway opening of 23.2 square feet; 3) to remove an existing culvert and then to place and maintain two 42-inch by 27-inch by 20-foot arch corrugated metal pipes with concrete headwalls and a waterway opening of 12.6 square feet; in an unnamed tributary of Pine Creek located 1,110 feet north on Applebutter Road from the intersection of SR 0045 in Haines Township, Centre County. The project proposes to permanently impact 65 linear feet of an unnamed tributary of Pine Creek that is an Exceptional Value watershed without impacting wetlands.

   E17-356.  Huston Township Sewer Authority, P. O. Box 121. Penfield, PA 15840-0121, in Huston Township, Clearfield County, ACOE Baltimore River Basin District (Penfield, PA Quadrangle N:  16.5 inches; W:  8.6 inches).

   To install, operate and maintain a 2-inch diameter polyethylene pipe crossing Eric Hollow Run, Mill Run, Moose Run, Tyler Run, four unnamed tributaries to Bennetts Branch-Sinnemahoning Creek and eight wetlands for the collection, conveyance and treatment of municipal wastewater. All waterways crossed by the collection system are designated as Cold Water Fisheries; the wetland associated to Wilson Run is designated an Exceptional Value, due to the wild trout resources of Wilson Run. All utility lines crossing beneath waterways shall encased in concrete. The project will impact .50-acre of wetland and 350-feet of waterway. The project is located along SR 0255 approximately 2.5-miles north of SR 0153 and SR 0255 intersection. This also authorizes the construction, operation and maintenance of an outfall structure to treated wastewater effluent to an existing abandon mine pool. All wetland impacts associated to the collection and conveyance system shall be temporary, as the permittee will not need to mitigate with replacement wetlands.

   E49-247.  John Ferrara, PA DCNR, Shikellamy State Park, Bridge Avenue, Sunbury, PA 17801. Floodway Construction, in Upper Augusta Township, Northumberland County, ACOE Baltimore District (Northumberland, PA Quadrangle N:  2.0 inches; W:  12.0 inches).

   1) To remove 900 feet of an existing park entrance road; 2) to reconstruct and maintain 900 feet of an existing park entrance road with a low point elevation of 432.77 feet; 3) to construct and maintain a 392-foot long concrete floodwall with a maximum elevation of 437.3 feet; 4) to reconstruct and maintain a 12-inch, 18-inch and a 24-inch storm pipes with their respective inlets and outfalls, relocate and maintain an existing underground electrical line, replace and maintain a portion of a sanitary sewer force main pipe and to construct and maintain a small stormwater pump station; all of which are in the left floodway of the Susquehanna River located on the Main Entrance Road to Shikellamy State Park 1,000 feet from SR 0147 intersection. The project should have no direct impacts to the Susquehanna River that is classified as a Warm Water Fishery.

   E53-359.  Christopher A. Beaver, PA DCNR, Bureau of Forestry, P. O. Box 673, Coudersport, PA 16915-0673. Replacing two Forestry culverts and installing a new cross drain outfall in Eulalia Township, Potter County, ACOE Baltimore District (Short Run, PA Quadrangle N:  18.6 inches; W:  10.6 inches).

   1)  To remove an existing culvert and then to construct and maintain a 60-inch diameter 40-foot long metal culvert with end sections that would have a waterway opening of 18.61 square feet after being depressed 6 inches into the stream bed of Little Lyman Run located 0.8 mile south on Horton Run Road from Junction Road; 2) to remove an existing culvert and then to construct and maintain a 57-inch by 36-inch by 40-foot long metal arch culvert with end sections that would have a waterway opening of approximately 10 square feet after being depressed 6 inches into the stream bed of Little Lyman Run located 1.02 miles south on Horton Run Road from Junction Road; 3) to construct and maintain a limestone riprap outlet apron for a 18-inch diameter cross-drain culvert located 50 feet upstream of the above mentioned proposed arch culvert. The project proposes to permanently impact approximately 125 linear feet of Little Lyman Run that is designated an Exceptional Value Watershed. No wetlands are predicted to be impacted.

   E55-180.  Jeffrey W. Goff, 88 Old Colony Road, Selinsgrove, PA 17870. Bridge Construction, in Penn Township, Snyder County, ACOE Baltimore District (Freeburg, PA Quadrangle N:  22.75 inches; W:  17.20 inches).

   1)  To construct and maintain a 20-foot by 7.33-foot by 54.3-foot long structural plate arch culvert with concrete wingwalls located on the north side of Old Colony Road 0.5 mile west of the SR 0204 intersection; 2) to construct and temporarily maintain a cofferdam during construction of the bridge; in an unnamed tributary of Penns Creek located on the north side of Old Colony Road 0.5 mile west of SR 0204 in Penn Township, Snyder County. The project proposes to permanently impact 55 feet of an unnamed tributary to Penns Creek that is classified as a Cold Water Fishery.

   E59-417.  James Kendter, PA Department of Transportation, Engineering District 3-0, 715 Jordan Avenue, Montoursville, PA 17754. SR 0328, Sect. 020 Bridge Replacement across Hammond Creek in Jackson Township, Tioga County, ACOE Baltimore District (Miller, PA Quadrangle N:  17.1 inches; W:  11.1 inches).

   1)  To construct and maintain a temporary bridge with a minimum normal span of 33.0 feet, a low chord elevation no lower than 1,241.0 feet and a waterway opening of 208 square feet located 100 feet upstream of the SR 0328, Sect. 020 bridge; 2) to construct and maintain a temporary cofferdam of plastic lined concrete barriers to facilitate demolition and construction in the dry; 3) to remove an existing bridge and to then construct and maintain a single span concrete deck steel I-beam bridge on a 35° skew with a normal span of 55.0 feet, an underclearance of 7.0 feet, a waterway opening of 354 square feet to cross Hammond Creek located approximately 1,100 feet northbound on SR 0328 from the SR 1020 intersection in Jackson Township, Tioga County. This project proposes to permanently impact 50 linear feet of Hammond Creek that is designated a Warm Water Fishery. Wetlands should not be impacted by this project.

   E59-418.  North Penn Gas Co., R. R. 3, Box 404A, Port Allegany, PA 16743. Pipeline Replacement, in Charleston Township, Tioga County, ACOE Baltimore District (Crooked Creek, PA Quadrangle N:  11 inches; W:  8.5 inches).

   The permit is submitted as an after-the-fact permit application for a gas pipeline replacement. The 2-inch steel distribution line was replaced under an emergency permit due leakage in the line. The permit application proposes to replace 3,300 feet of 2-inch distribution line, which crosses two unnamed tributaries to Tauscher Pond which are Warm Water Fisheries and will impact 740 lineal feet of wetlands.

   Southwest Region: Water Management Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   E02-1345.  White Oak Borough, 2280 Lincoln Way, White Oak, PA 15131. White Oak Borough, Allegheny County, ACOE Pittsburgh District.

   To construct and maintain a 48-inch diameter outfall structure on the right bank of an unnamed tributary to the Monongahela River (WWF) for the purpose of improving stormwater discharge. The project is located on the south side of Pennsylvania Avenue, approximately 270 feet west from the intersection of Capital Avenue and Pennsylvania Avenue (McKeesport, PA Quadrangle N:  18.6 inches; W:  10.0 inches).

   E02-1346.  High Performance Builders, GP, 210 Wittengale Road, Oakdale, PA 15071. North Fayette Township, Allegheny County, ACOE Pittsburgh District.

   To construct and maintain a bridge having a span of 27.0 feet with an underclearance of 8 feet across the channel of North Branch Robinson Run (WWF) for the purpose of providing access to applicants property located on the south side of North Branch Road, approximately 300 feet southwest from the intersection of North Branch Road and Seabright Road (Oakdale, PA Quadrangle N:  4.7 inches; W:  17.0 inches).

   E26-285.  Fayette City Borough, R. D. 1, Box 544, 2nd and Cook Streets, Fayette City, PA 15438. Borough of Fayette City, Fayette County, ACOE Pittsburgh District.

   To construct and maintain a gabion stream bank protection for a length of 550 feet along the west bank of Downers Run (WWF) for the purpose of providing access to vehicles. The project is located along Brightwell Drive at a point approximately .4 mile north of the intersection of S.R. 201 and S.R. 4044 (Fayette City, PA Quadrangle N:  19.15 inches; W:  12.2 inches).

   E65-782.  Cook Township, R. D. 1, Box 230, Stahlstown, PA 15687. Cook Township, Westmoreland County, ACOE Pittsburgh District.

   To remove the existing culvert and to construct and maintain a 1.0-foot depressed 77-inch x 52-inch pipe arch culvert in an unnamed tributary to Fourmile Run (TSF) for the purpose of improving transportation safety and roadway standards. The project is located on Stom Road (Stahlstown, PA Quadrangle N:  13.29 inches; W:  7.75 inches).

   Northwest Region: Water Management Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

   E10-201, Dimension Development Corporation, 120 Third Degree Road, Pittsburgh, PA 15237. Hunters Creek Phase IV, in Cranberry Township, Butler County, ACOE Pittsburgh District (Baden, PA Quadrangle N:  16.0 inches; W:  1.5 inches).

   To construct and maintain approximately 80 linear feet of a 16 1/2 foot by 11-inch corrugated metal pipe arch culvert in a perennial unnamed tributary to Brush Creek (WWF) for the purpose of extending Hunter Drive and creating access to 15 residential lots associated with Phase IV of Hunter's Creek Residential Development, located at the terminus of Hunter Drive. The proposed activity was approved under a permit issued September 1995 that expired due to project delays.

   E10-337, Keith G. and Linda M. Kotchey, 2830 Clearview Road, Allison Park, PA 15101. Kotchey Bridge Across Yellow Creek, in Lancaster Township, Butler County, ACOE Pittsburgh District (Prospect, PA Quadrangle N:  0.3 inch; W:  13.6 inches).

   1.  Excavate the stream channel to allow adequate capacity for the stream flows.
