MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to the applications will also address the applicable permitting requirements of the following statutes:  the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District Mining Office indicated before each application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.

   Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment and informal conferences).

   Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the previous, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the previously-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

   Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications and requests for Environmental Assessment approval and requests for Water Quality Certification have been received by the Department of Environmental Protection. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)), requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Initial requests for 401 Water Quality Certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between the hours of 8 a.m. and 4 p.m. on each working day at the office noted before the application.

The project, known as County Culvert No. 17007, is located along T-672, approximately 500 feet south of the intersection of T-672 and S.R. 4028.    To construct a pedestrian bridge across Crooked Creek (WWF) and to construct a pond within the floodway of the Juniata River (WWF) at a point at the junction of Crooked Creek and the Juniata River (Huntingdon, PA Quadrangle N:  19.7 inches; W:  2.3 inches).

   To construct and maintain a pump station in the floodplain of an unnamed tributary to Carlisle UNT (HQ-CWF) at a point approximately 1,300 feet downstream of Route 103 (Belleville, PA Quadrangle N:  0.4 inch; W:  8.6 inches).

   E12-126. Bennett Branch Watershed Association, P. O. Box 99, Benezette, PA 15821. Bennett Branch Restoration-Moser/Beers Property, in Gibson Township, Cameron County, ACOE Baltimore District (Driftwood, PA Quadrangle N:  18.5 inches; W:  12.7 inches).

   To realign the stream channel and construct, operate and maintain six in-stream grade control structures for the restoration of 1,000-feet of Bennett Branch-Sinnemahoning Creek (Cold Water Fishery). The realignment of Bennett Branch shall be conducted to establish a stream channel with a pattern, profile and geometry of a stable form reference reach. The grade control structures shall be constructed with rock in stream flow conditions ample to determine thalweg locations. The project will not impact wetlands while impacting 1,000-feet of waterway that is location along the eastern right-of-way of SR 0555 approximately 1.7-miles east of Hicks Run Road and SR 0555 intersection. This permit also authorizes the construction, operation, maintenance and removal of temporary construction access roads, channel diversions and stockpiles. All temporary facilities used for project construction shall be removed from floodplain areas upon project completion and all areas disturbance shall be restored and/or stabilized.

   E14-364. Centre Regional Recreation Authority, 131 South Fraser Street, State College, PA 16801. Millbrook Marsh Nature Center Boardwalk and Marsh Nature Center, in College Township, Centre County, ACOE Baltimore District (State College, PA Quadrangle N:  12.0 inches; W:  12.0 inches).

   To construct and maintain:  1) 1,200 linear feet of wooden boardwalk fill in wetlands that include a wooden bank-to-bank bridge with a 25-foot span and a 4-foot underclearance across Thompson Run, a wooden bank-to-bank bridge with a 25-foot span and a 4-foot underclearance across Slab Cabin Run and a wooden bank-to-bank bridge with a span of 5-foot and a 0.5 foot underclearance across Bathgate Spring Run; 2) 300 linear feet of wooden bikeway fill in wetlands that includes a wooden bank-to-bank bridge with a span of 5-foot and a 0.5 foot underclearance across an unnamed tributary to Bathgate Spring Run; 3) a 2-inch intake structure in the right bank of Bathgate Spring Run for a 0.33 acre shallow marsh with a 4.0 maximum depth to be built outside of the regulated floodway; all of which are located within 600 feet of the confluence of Thompson Run with Slab Cabin Run. This project proposes to permanently impact 1,500 linear feet of wetlands and 8 linear feet of an unnamed tributary of Bathgate Spring Run, 8 linear feet of Bathgate Spring Run, 8 linear feet of Thompson Run and 8 linear feet Slab Cabin Run that are all classified as Warm Water Fisheries.

   E41-483. Brady Township, 1986 Elimsport Road, Montgomery, PA 17752. Sewer System Upgrade, in Brady Township, Lycoming County, ACOE Baltimore District (Montoursville South, PA Quadrangle N:  9.61 inches; W:  8.26 inches).

   The applicant proposes to temporarily impact a wetland by constructing 1,400 linear feet of new sewer line and to construct a pump station within the 100-year floodplain of Black Hole Creek. Since the pump station is in the floodplain and a municipal government agency is applying for the permit, authorization is required from the department. This project is located in the Black Hole Creek watershed, which is designated as Trout Stock Fishery.

   E49-251. Revival Tabernacle, P. O. Box 118, West Milton, PA 17886. Culvert Crossing, in Delaware Township, Northumberland County, ACOE Baltimore District (Milton, PA Quadrangle N:  11.2 inches; W:  12.0 inches).

   To construct and maintain a 20 foot by 7.5 foot arch culvert in the main stream and a 6 foot diameter culvert in the tributary to the main stream on private property in unnamed tributaries to Muddy Run on the south side of SR 1007 approximately 400 feet west of the intersection of Rt. 147 with SR 1007 in Delaware Township, Northumberland County. The project will not impact wetlands while impacting approximately 100 feet of waterway. The unnamed tributaries to Muddy Run are Warm Water Fisheries Streams.

   E55-182. Pennsylvania Department of Transportation, Engineering District 3-0, P. O. Box 218, Montoursville, PA 17754-0218. SR 0522 Section 042M unnamed tributary to Middle Creek bridge replacement, in Beaver Township, Snyder County, ACOE Susquehanna River Basin District (Beavertown, PA Quadrangle N:  3.1 inches; W:  1.2 inches).

   To a) remove two existing structures b) construct and maintain a 20 foot by 6 foot reinforced concrete box culvert on a skew of 55° in a tributary to Middle Creek located 3.5 miles southwest of Middleburg along SR 0522, in Beaver Township, Snyder County. This project proposes to have a minimal impact on the unnamed tributary to Middle Creek, which is designated Cold Water Fishery. This project does not propose to impact any jurisdictional wetlands.

   To construct and maintain a 42" diameter RCCP culvert for a distance of approximately 450 feet with a 17.5 feet diameter stilling basin and 55 feet of R-4 rock lining energy dissipater with a tributary to Chartiers Creek (WWF). The proposed culvert is to provide additional developable area for the Cedar Ridge Business Park. The project is located on the southeast corner of the intersection of SR 60 (Steubenville Pike) and Haddock Drive (Pittsburgh West, PA Quadrangle N:  13.1 inches; W:  14.8 inches).

   To construct and maintain a three span curved steel multi-girder bridge having a total span of 376 feet and an underclearance of approximately 30 feet, to construct and maintain a reinforced concrete arch culvert having a span of 42 feet and underclearance of 20 feet for a distance of 330 feet, to construct and maintain a two span continuous composite steel bridge having a total span of 336 feet and an underclearance of approximately 70 feet, to construct and maintain an extension to an existing 7 foot diameter culvert for a distance of 12 feet, to place and maintain fill within the floodway for a distance of approximately 1,850 feet, to construct and maintain various outfall structures in and across Deer Creek (WWF), to place and maintain fill in 5.89 acres of wetlands (PEM/PSS) and to maintain fill already placed in 0.6 acre of wetlands. This work is being done as part of the construction of a mixed-use commercial center located on the north side of the intersection of State Route 28 and State Route 910 and to the south of the Pennsylvania Turnpike. To meet the wetland replacement requirements the applicant proposes to construct 5.42 acres of wetland replacements on site and 1.75 acres of off site replacement wetlands. To provide for mitigation for the stream encroachments the applicant proposes to construct and maintain bank stabilization in two areas by using native material revetment for a total distance of 575 feet and to plant and maintain 700 feet of riparian zone planting.
