FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)).

   Except as otherwise noted, the Department certifies that the construction and operation herein described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State Water Quality Standards.

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, P. O.    E36-705.  Hammer Creek Watershed Association, 21 Buch Mill Road, Lititz, PA 17543 in Ephrata and Warwick Townships, Lancaster County, ACOE Baltimore District.

   To construct and maintain a stream restoration project in Hammer Creek (TSF). The project's purpose is to stabilize stream banks, improve sediment transport, create additional floodplain wetlands, establish riparian buffers and improve aquatic habitat. The project will implement a natural stream channel design approach. Construction activities to be utilized include stream and floodway excavation, filling and grading and cross vane installation.

   The project consists of 800 lineal feet of stream restoration located immediately downstream of the Carpenter Road bridge (T-931), (Lititz, PA Quadrangle N: 10.35 inches; W: 1.55 inches (upstream limit) and N: 9:9 inches; W: 1.5 inches). During this project, a de minimis amount of palustrine emergent wetlands will be filled. It is anticipated that up to 0.2 acre of floodplain wetland will be created.

   To a) remove existing structure, b) construct and maintain a precast concrete arch structure with a clear span of 47 feet and a minimum underclearance of 10.5 feet in Spring Creek, c) temporarily construct and maintain a sand bag diversion dike at the existing bridge site, all of which is located 2.0 miles along Spring Creek Road, east of the intersection of SR 550 South and Spring Creek Road.    To replace the existing bituminous filled corrugated metal deck pan driving surface with a reinforced concrete deck driving surface on a bridge located over Potter Run. This project is located 1,000 feet east on T-633 (Lower Georges Valley Road) from the intersection with SR 0144. This permit was issued under § 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E18-313.  George M. Khoury, Pennsylvania Department of Transportation, Engineering District 2-0, P. O. Box 342, Clearfield, PA 16830. Bridge on SR 2004-- Fishing Creek in Lamar Township, Clinton County, ACOE Baltimore District (Mill Hall, PA Quadrangle N: 10.5 inches; W: 13.0 inches).

   To remove the existing two span, spandrel arch bridge with a 90 degree skew to roadway center line, a 44-foot span with an 840-square foot waterway opening and to construct and maintain a two span continuous composite prestressed concrete adjacent box beam bridge with two 55-foot spans and a 2.5-foot wide pier and a waterway opening of 1,114-square feet and to construct a temporary cofferdam to isolate the existing pier during demolition and construct the new pier on SR 2004 over Fishing Creek approximately 1,500-feet northwest of Mackeyville in Lamar Township, Clinton County. The project will impact less than 0.5 acre of wetlands while impacting approximately 100 feet of waterway. Fishing Creek is a High Quality--Cold Water fisheries stream. This permit was issued under § 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E53-358.  Stephen Jervis, R. R. 3, Box 3480, Factoryville, PA 18419. Jervis Minor Road Crossing South Woods Branch, in Homer Township, Potter County, ACOE Baltimore District (Austin, PA Quadrangle N: 12.75 inches; W: 5.0 inches).

   To construct, operate and maintain a minor road crossing South Woods Branch-First Fork, Sinnemahoning Creek (High Quality-Cold Water Fishery) to provide access to a single private dwelling. The minor road crossing shall be constructed with four plastic culvert pipes, clean rock fill and clean crushed rock wearing surfaces. The four plastic culvert pipes shall have a minimum diameter of 2-feet, length of 14-feet and depression into the streambed of 0.5-feet. The minor road crossing South Woods Branch shall be constructed in dry work conditions through the use of dams and pumping or fuming stream flow around work area. The project will not impact wetlands while impacting 20-feet of waterway is located along the eastern right-of way of SR 0872 approximately 1.9-miles south of South Woods Road and SR 0872 intersection.    E59-417.  Pa. Dept. of Transportation, 715 Jordan Avenue, Montoursville, PA 17754. Bridge Replacement, in Jackson Township, Tioga County, ACOE Baltimore District (Miller, PA Quadrangle N: 17.1 inches; W: 11.1 inches).

   1) To construct and maintain a temporary bridge with a minimum normal span of 33.0 feet, a low chord elevation no lower than the 1,241.0 feet elevation and a waterway opening of at least 208 square feet located 100 feet downstream of the SR 0328, Sect. 020 bridge; 2) to construct and maintain a temporary cofferdam of plastic-lined concrete barriers to facilitate demolition and construction in the dry; 3) to remove an existing severely deteriorated bridge, 4) to construct and maintain a single span concrete deck steel I-beam bridge on a 35° skew with a normal span of 55.0 feet, an underclearance of 7.0 feet, a waterway opening of 354 square feet to cross Hammond Creek located approximately 1,100 feet northbound on SR 0328 from the SR 1020 intersection, ACOE Baltimore District (Miller, PA Quadrangle N: 17.1 inches; W: 11.1 inches) in Jackson Township, Tioga County.

INTENT TO REISSUE PENNSYLVANIA GENERAL NPDES PERMIT FOR WASTEWATER DISCHARGES FROM STRIPPER OIL WELL FACILITIES

   In compliance with the provisions of the Federal Clean Water Act, The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and sections 1905-A, 1917-A and 1920-A of The Administrative Code of 1929 (71 P. S. §§ 510-5, 510-17 and 510-20), the Department of Environmental Protection (Department) by this notice announces its intent to review and reissue the Pennsylvania General NPDES Permit for Discharges from Stripper Oil Well Facilities (PAG31001) for a 5 year period. The general permit was initially issued on October 4, 1991, renewed on October 4, 1996 and is scheduled to expire on October 3, 2001. The current general permit is valid until revised and issued in final after reviewing and addressing comments from this public notice.

   The Department has reviewed and updated the general permit and related documents. Most of the changes were only minor editorial changes. The maximum flow for any outfall shall not exceed the amount specified on the ''Approval for Coverage.'' In response to comments from operators who desire to use the general permit, the maximum flow that will be considered for coverage under this general permit will be increased from 1,000 gpd to 2,000 gpd.
