APPROVALS TO USE NPDES AND/OR OTHER GENERAL PERMITS

   The following parties have submitted: (1) Notices of Intent (NOIs) for Coverage Under (1) General NPDES Permits to Discharge Wastewater into the Waters of the Commonwealth. The approval for coverage under these general NPDES permits is subject to applicable effluent limitations. Monitoring, reporting requirements and other conditions set forth in the general permit: (2) General Permits for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania; (3) General NPDES Permit Authorizing the Discharge of Stormwater Associated with Construction Activities to Waters of the Commonwealth; (4) Notification for First Use Application of Sewage Sludge.

   The approval of coverage for land application of sewage sludge or residential septage under these general permits is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. The Department of Environmental Protection approves the following coverage under the specific General Permit.

   The EPA Region III Administrator has waived the right to review or object to this permit action under the waiver provision 40 CFR 123.23(d).

   The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted.

   The Department of Environmental Protection (Department) has taken the following actions on applications received under the Safe Drinking Water Act for the construction, substantial modification or operation of a public water system.

   Persons aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Appeals must be filed with the Environmental Hearing Board within 30 days from the date of issue of the Pennsylvania Bulletin unless the appropriate statute provides a different time period.    Plan Description: The approved plan provides for an Official Plan revision consisting of the construction of a Small Flow Treatment Facility (SFTF) with discharge to a dry stream, an unnamed tributary of the West Branch of the Wallenpaupack Creek. The SFTF will be sized for a peak flow of 1500 GPD. The project is necessitated due to the malfunction of the existing on-lot sewage disposal system. After reviewing the condition of the existing system and the lack of available land area for a replacement on-lot system, the SFTF was selected as the only repair alternative. The proposed development is located at the southeastern corner of the intersection of T-342 and SR-0590 in Salem Township, Wayne County, PA. PUBLIC NOTICE OF PROPOSED CONSENT ORDER AND AGREEMENT

   Under section 1113 of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1305) (HSCA), notice is hereby provided that the Department of Environmental Protection (Department) has agreed to a de minimis settlement with the Lakeside Park Company, Robert R. Gillette, Bessie G. Gillette, Julie M. Widel, the Estate of Homer B. Widel (Julie M. Widel, Executrix) (collectively referred to as Lakeside) and the Sandy Creek Conservancy (Conservancy), to resolve Lakeside's liability for the Sandy Lake Asbestos Site (Site). The Site covers approximately 2 acres and is located on a 31.75-acre parcel owned by Lakeside and located between the former Penn Central Railroad Line and Route 845 in Stoneboro Borough, Mercer County, PA.

   In the past, asbestos wastes were disposed at the Site and this waste contaminated the environment at the Site. Asbestos is a ''hazardous substance'' as defined in section 103 of HSCA (35 P. S. § 6020.103). The Department has the Site and has removed the asbestos wastes for proper disposal off-Site. The Department has incurred approximately 1.1 million dollars in response Costs for the Site. As owners of the Site during the time of the release and threatened release of hazardous substances at the Site, the members of Lakeside are each a ''responsible person'' as defined in section 103 of HSCA. Under the terms of the settlement, through a conservation easement, Lakeside will sell (for $1) the development rights of the 31.75-acre parcel that contains the Site to the Conservancy for the public benefit in perpetuity.

   The specific terms of this settlement are set forth in the Consent Order and Agreement (Agreement) with Lakeside and the Conservancy. The Department will receive and consider comments relating to the Agreement for 60 days from the date of this public notice. The Department has the right to withdraw its consent to the Agreement if the comments concerning the Agreement disclose facts or considerations that indicate that the Agreement is inappropriate, improper or not in the public interest.

   After the public comment period, the Department's settlement with Lakeside and the Conservancy shall be effective upon the date that the Department notifies Lakeside and the Conservancy, in writing, that this Agreement is final and effective in its present form and that the Department has filed a response to significant written comments to the Agreement or that no comments were received.

   The Agreement is available for inspection and copying at the Department's office at 230 Chestnut Street, Meadville, PA. Comments may be submitted, in writing, to James W. The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site where one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected.

Borrelli, Manko, Gold & Katcher, LLP, Suite 500, 401 City Ave., Bala Cynwyd, PA 19004, on behalf of Jupiter Property Management, LLC, 11401 Roosevelt Blvd., Philadelphia, PA 19154-2197, has submitted a Final Report concerning remediation of site soil and groundwater contaminated with lead, heavy metals, BTEX, petroleum hydrocarbons and polycyclic aromatic hydrocarbons. The report is intended to document remediation of the site to meet Statewide Health and Site-specific Standards.

   Upper Dublin Township, Fort Washington Borough and Upper Dublin Township, Montgomery County. Christopher Orzechowski, RT Environmental Services, Inc., 215 W. Church Rd., King of Prussia, PA 19406, on behalf of Upper Dublin Township, 801 Loch Alsh Ave., Fort Washington, PA 19034, has submitted a Final Report concerning remediation of site groundwater contaminated with BTEX and polycyclic aromatic hydrocarbons. The report is intended to document remediation of the site to meet Site-specific Standards.

   Northcentral Region: Environmental Cleanup Program Manager, 208 West Third Street, Williamsport, PA 17701.

   Atherton Hotel, State College Borough, Centre County. Cocciardi and Associates, Inc., on behalf of its client, Atherton Hotel, 125 South Atherton Street, State College, PA 16801, has submitted a Final Report concerning remediation of site soil contaminated with mercury. The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of 25 Pa. Code § 250.8, Administration of the Land Recycling and Environmental Remediation Standards Act (Act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Act. Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Borrelli, Manko, Gold & Katcher, LLP, 401 City Ave., Suite 500, Bala Cynwyd, PA 19004, on behalf of PA Industrial & Commercial Development Authority, 2600 Centre Square West, 1500 Market St., Philadelphia, PA has submitted a Final Report concerning the remediation of site soil contaminated with lead, heavy metals, BTEX and polycyclic aromatic hydrocarbons and site groundwater contaminated with solvents. The report demonstrated attainment of a combination of the Statewide Health and Site-specific Standards and was approved by the Department on September 7, 2001.

   Lord Corporation, Erie Facility North Parking Lot, 1635 W. 12Th Street, Erie, PA, City of Erie, Erie County, had submitted a Final report concerning remediation of the ground water. The site had been found to be contaminated with Solvents. The report was approved by the Department and did demonstrate attainment of the Background Standard.

HAZARDOUS WASTE TRANSPORTER LICENSE
