   This permit was issued under a Project XL agreement between the Department and the EPA. Project XL is the EPA's program to test innovative approaches to environmental protection using regulatory flexibility to achieve superior environmental performance. Under Project XL, a Consent Order and Agreement (COA) between King Coal Sales, Inc. and the Department was executed on November 27, 2002. The purpose of this agreement is to improve water quality in Emigh Run (Clearfield County) through encouraging remining and acid mine drainage abatement measures. The agreement will base compliance on in-stream water quality and the implementation of best management practices, instead of numeric effluent limitations measured at individual discharge points. The agreement applies only to this surface mining permit. Emigh Run is one of up to eight acid mine drainage impacted watersheds where this approach under Project XL will be evaluated. FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)).

   Except as otherwise noted, the Department certifies that the construction and operation herein described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State Water Quality Standards.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984.    3.  Two four span continuous composite prestressed concrete I-beam bridges with a minimum underclearance of 28 feet 1.75 inches, named Structure 109 northbound at Sta. 466+46.55 to 470+60.55 and Structure 110 southbound at Sta. 467+20 to 470+24, over Blue Springs Hollow Run located 2,000 feet upstream from Bald Eagle Creek.

   4.  Two 36-inch diameter 62-foot long corrugated metal pipes at Sta. 467+50 Rt., named temporary stream crossing #2, across Blue Springs Hollow Run for construction vehicle stream crossing.

   5.  Six-foot by 6-foot 221-foot long precast concrete box culvert, Structure 104, located 1,100 feet downstream of the SR 0350 at Sta. 132+91.94 to allow an unnamed tributary to Bald Eagle Creek to flow under I-99.

   6.  Two 30-inch diameter 345-foot long corrugated metal pipes at Sta. 133+25, named temporary stream crossing #1, as required for dewatering and construction vehicle stream crossing for Structure 104.

   The total stream impacts are 22,635 linear feet and include: 547 linear feet bridged; 4,525 linear feet culverted; and 14,721 linear feet diverted and filled (of which 385 linear feet will be realigned). In addition, there will be 499 linear feet of temporary stream crossing impacts and 2,842 linear feet of waived culvert crossing impacts. With respect to wetlands, there will be 8.816 acres of direct impact (0.037 acre of which is to be temporary impact) and 2.007 acres of indirect impacts for a total of 10.823 acres. The wetlands that lie along the floodplain of Blue Springs Hollow Run are Exceptional Value due to the presence of an endemic wild trout fishery. Consequently, there will be 1.89 acres of Exceptional Value wetlands impacted (1.639 acres direct, 0.251 acre indirect) in this area resulting from bridge construction and channel relocation. A Federal jurisdictional determination has already been made for wetland resources project wide.

   E41-514. Neil F. Dunkle, P. O. Box 334, Jersey Shore, PA 17740-0334. Water Obstruction and Encroachment Permit Application, in Mifflin Township, Lycoming County, ACOE Susquehanna River Basin District (Waterville, PA Quadrangle N:  5.16 inches; W:  0.46 inch).

   To remove an existing timber frame bridge and construct and maintain a single span steel frame bridge having a span of 16 feet and a minimum underclearance of 6.5 feet; maintain a single span steel frame bridge having a span of 24.75 feet and a minimum underclearance of 6.5 feet; a single span steel frame walk bridge having a span of 22 feet and a width of 4 feet and a minimum underclearance of 4.6 feet; as well as a steel frame walk bridge having a span of 50 feet, a width of 4 feet and a minimum underclearance of 5.5 feet all of which are located over the First Fork of Larry's Creek. The site is located along First Fork Road in Mifflin Township, Lycoming County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E53-382. Galeton Borough Authority, 4 Sherman Street, Galeton, PA 16922. Galeton Wastewater Treatment Facility Upgrade, in Galeton Borough, Potter County, ACOE Baltimore District (Galeton, PA Quadrangle N:   20.5 inches; W:  1.4 inches).

   To modify, operate and maintain an existing wastewater treatment facility, located within the 100-year floodway of Pine Creek for the treatment of municipal wastewater. Modification work of the treatment facility shall consist of constructing a 15-foot by 20-foot bar screening building, an 8-foot by 25-foot chlorine contact tank and an 8-foot by 13-foot dechlorination building within the 100-year floodway of the Pine Creek. This permit does not authorize any construction activities in or along the channel of Pine Creek and all construction activities shall be limited to the 100-year floodway and flood fringe areas. The project is located along the southern right-of-way of SR 0006 approximately 350 feet south of SR 1022 and SR 0006 intersection.

   To construct and maintain a timber deck bridge having a structure length of 38 feet and an underclearance of approximately 7.5 feet across Deer Creek on an existing private driveway extending west from T-410 Soap Fat Road approximately 1.2 miles north of SR 322.

To modify, operate and maintain, the Akeley Swamp Dam located across a tributary to Conewango Creek (CWF), directly impacting a de minimis area of wetland (PEM) equal to 0.03 acre and indirectly impacting approximately 231.0 acres of wetland (PEM, PSS) by seasonal and annual flooding. The project will involve modifying the three outlet structures to regulate the water levels in Akeley Swamp (Russell, PA Quadrangle N:  20.2 inches; W:  1.8 inches) in Pine Grove Township, Warren County.
