SPECIAL NOTICES

SETTLEMENT UNDER THE COMPREHENSIVE ENVIRONMENTAL RESPONSE, COMPENSATION AND LIABILITY ACT AND THE HAZARDOUS SITES CLEANUP ACT

Reading Industrial Scrap Company Site, Berks County

The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) (42 U.S.C.A. §§ 9601--9675), has entered into a proposed settlement with certain De Minimis Responsible Parties (Settlor).

The proposed settlement resolves claims of the Department with the Settlor under the HSCA, CERCLA and other applicable law for potential repose costs for remediation of the former Reading Industrial Scrap Company Site (Site) located in the City of Reading and Muhlenberg Township, Berks County. The Settlor purchased the property in the spring of 2002. Prior to the Settlor acquiring the Site, solid waste, including waste alleged to include ''hazardous substances'' within the meaning of section 101(14) of CERCLA (42 U.S.C.A. § 9601(14)) and section 103 of the HSCA (35 P. S. § 6020.103), were disposed at the Site.

The proposed settlement obligates the Settlor to remit $500 to the Department. The Department believes that the proposed settlement is fair, reasonable, practicable, in the public interest and in furtherance of the statutory goals of the HSCA and CERCLA.

For a period of 60 days, beginning with the December 21, 2002, publication date of this notice in the Pennsylvania Bulletin, the public is invited to review the Consent Order and Agreement (COA) memorializing the settlement, Monday through Friday, from 8 a.m. to 4 p.m. at the Department's Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA 17110 by contacting Pamela Trowbridge at (717) 705-4706. The COA can also be reviewed at the Southcentral Region's Reading District Office, 1005 Cross Roads Boulevard, Reading, PA 19605, (610) 916-0100.

After review, the public may submit written comments on the COA before February 18, 2003, by mailing them to Pamela Trowbridge at the Department's Harrisburg Office at the previous address. A person adversely affected by the settlement may also file an appeal from the COA to the Environmental Hearing Board.

Questions concerning this notice should be directed to Pamela Trowbridge at the address and telephone number previously noted.

Public Meeting and Request For Comment for the Proposed Total Maximum Daily Load (TMDL) for the Limestone Run and Huskins Run Watersheds in Armstrong County

The Department of Environmental Protection (Department) will hold a public meeting to discuss and accept comments on proposed TMDLs for the Huskins Run and Limestone Run Watersheds in Armstrong County. The meeting will be held on January 8, 2003, at 6 p.m. in Room 103 of the Armsdale Building along Rt. 85 east of Kittanning, PA. Individuals who plan to make a presentation at the public meeting should contact Ron Horansky, Watershed Manager, Greensburg District Mining Office, (724) 925-5500 by 4 p.m. on Thursday, January 2, 2003. The Department will consider all comments in developing the final TMDLs for the Huskins Run and Limestone Run Watersheds, which will be submitted to the EPA for approval.

The proposed TMDLs for the Huskins Run and Limestone Run Watersheds were established in accordance with the requirements of section 303(d) of the Clean Water Act. One stream segment in each of the Huskins Run and the Limestone Run Watersheds has been identified as impaired on the 1996, 1998 and draft 2002 Pennsylvania 303(d) lists due to depressed pH and/or high concentrations of metals or sulfates. The listed segment and miles degraded are shown in the following table:

Stream Code Stream Name Miles Degraded
47018 Huskins Run 2.77
47105 Limestone Run 5.6

The proposed plan provides calculations of the stream's total capacity to accept metals (aluminum, iron, manganese and acidity), pH and maintain levels below water quality criteria. The applicable water quality criteria are as follows:

Parameter Criterion value (mg/l) Total Recoverable/Dissolved
Aluminum 0.75
Total Recoverable
Iron 1.5
0.3
Total Recoverable
Dissolved
Manganese 1.00
Total Recoverable
pH 6.0--9.0
N/A

The primary pollutant source for the watershed is abandoned mine workings. These watersheds were heavily mined for coal in the late 19th through 20th centuries. The effects of this are still present. All of the allocations made in the TMDLs are load allocations (LA), which are made to nonpoint sources of pollution.

The proposed TMDLs were developed using Monte Carlo Simulation (MCS) to determine long-term average concentrations that each stream segment could accept and still meet water quality criteria 99% of the time. MCS allows for the expansion of a data set based on its statistical makeup. Since there was no critical flow condition where criteria were exceeded, the Department used the average flow to express the loading values in the proposed TMDLs. The proposed TMDLs for the Huskins Run and Limestone Run Watersheds set allowable loading rates for metals and acidity at specified points in the watersheds. Field data collected over the past 10 years was used to establish the proposed TMDLs for the Huskins Run and Limestone Run Watersheds. The data and all supporting information used to develop the proposed TMDLs are available from the Department.

The Department will accept written comments on the proposed TMDLs for the Huskins Run and Limestone Run Watersheds. Written comments must be postmarked by February 19, 2003, and sent to Ron Horansky, Watershed Manager, Department of Environmental Protection, Greensburg District Mining Office, R. D. 2, Box 603C, Armbrust Professional Center, Greensburg, PA 15601, (724) 925-5500, rhoransky@state.pa.us.

To request a copy of the proposed TMDL and associated information sheet or to obtain directions to the Armsdale Building, contact Ron Horansky at the previous phone number or e-mail address.

The proposed TMDLs for the Huskins Run and Limestone Run Watersheds can be accessed through the Department's website (http://www.dep.state.pa.us) by typing ''TMDL'' in the direct link field and clicking ''GO.'' Persons with a disability who require accommodations to attend this meeting should contact the Department at (814) 472-1900 or the Pennsylvania AT&T Relay Service at (800) 654-5984 (TDD users) or (800) 654-5988 (voice users) to discuss how the Department may accommodate their needs.
