LAND RECYCLING AND ENVIRONMENTAL REMEDIATION
UNDER ACT 2, 1995
PREAMBLE 1
Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Sections 302--305 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the Background Standard, Statewide Health Standard, the Site-Specific Standard or who intend to remediate a site as a special industrial area must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one, a combination of the cleanup standards or who receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a Site-Specific Standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified, proposed for remediation to a Site-Specific Standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period, the municipality may request that the person identified, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.
For further information concerning the content of a Notice of Intent to Remediate, contact the environmental cleanup program manager in the Department regional office after which the notice appears. If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office. PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS
NEW SOURCES AND MODIFICATIONS The Department of Environmental Protection (Department) has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.
The Department has received applications for plan approvals and/or operating permits from the following facilities.
Copies of the applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the regional office identified in this notice. Persons interested in reviewing the application files should contact the appropriate regional office to schedule an appointment.
Persons wishing to receive a copy of a proposed plan approval or operating permit must indicate their interest to the Department regional office within 30 days of the date of this notice and must file protests or comments on a proposed plan approval or operating permit within 30 days of the Department providing a copy of the proposed document to that person or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that a hearing be held concerning the proposed plan approval and operating permit. Comments or protests filed with the Department regional offices must include a concise statement of the objections to the issuance of the Plan approval or operating permit and relevant facts which serve as the basis for the objections. If the Department schedules a hearing, a notice will be published in the Pennsylvania Bulletin at least 30 days prior the date of the hearing.

The modification involves the construction of a roll coater as part of the coating line. The modification will not result in any changes in the emissions from the line. The facility is subject to 40 CFR Part 63, Subpart TTTT--National Emission Standards for Hazardous Air Pollutants from Leather Coating. The plan approval will include limits on the VOC content in the various coatings and the annual emission of VOC. The approval will include monitoring, recordkeeping, work practices and reporting requirements designed to keep the source operating within all applicable air quality requirements. The facility is presently covered by Operating Permit No. 06-05014. The plan approval will be incorporated into this permit in accordance with 25 Pa. Code § 127.450.
21-05047: Naval Support Activity (5450 Carlisle Pike, Mechanicsburg, PA 17055) for operation of two emergency generators and a spray paint booth in Hampden Township, Cumberland County. This modification will have the potential to increase the facility's NOx emissions by 22 tons and VOC emissions by less than 1 ton. Conditions in the permit will limit the VOC content of the coatings in accordance with 25 Pa. Code § 129.52 and the allowable operating hours for each of the emergency generators. The Plan Approval and Operating Permit will contain additional operating restrictions, recordkeeping, monitoring, work practices standards and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

(3649 Hempland Road, Lancaster, PA 17601) for construction of a vacuum pleater oven controlled by a catalytic oxidizer at their plant in West Hempfield Township, Lancaster County. This modification will effectively decrease the facility's overall emissions of VOCs. Conditions in the permit will limit the VOC content of the coatings in accordance with 25 Pa. Code § 129.52. The Plan Approval and Operating Permit will contain additional recordkeeping, monitoring, work practices standards and operating restrictions designed to keep the facility operating within all applicable air quality requirements.
67-05045A: Glen Gery, Corp. (1090 East Boundary Avenue, York, PA 17405) for removal of a fabric filter controlling particulate matter emissions from tunnel kiln no. 2 at their facility in Spring Garden Township, York County. This modification is expected to increase the facility's overall emissions of particulate matter by 9 tpy. The Plan Approval and Operating Permit will contain additional recordkeeping, work practice standards and reporting requirements to keep the facility operating within all applicable air quality requirements.

8-310-004: Glenn O. Hawbaker, Inc. (711 East College Avenue, Bellefonte, PA 16823) for construction of a sand and gravel processing plant (Canton Aggregate Facility) containing various pieces of crushing, screening and conveying equipment on Route 14 in Canton Township, Bradford County.
Fugitive PM from the crushing, screening and conveying equipment will be controlled by a water spray dust suppression system. The resultant PM10 emissions are expected to be no greater than 36.05 tons per year.
The Department's review of the information contained in the application indicates that the sand and gravel processing plant will comply with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants, including 25 Pa. Code § 123.1, the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12 and the requirements of Subpart 000 of the Federal Standards of Performance for New Stationary Sources, 40 CFR 60.670--60.676.
The following is a summary of the conditions the Department plans to place in the plan approval to be issued to ensure compliance with all applicable regulatory requirements:
1. The fugitive PM emissions from the sand and gravel processing plant shall be controlled by a water spray dust suppression system which shall, at a minimum, contain an in-line strainer and spray nozzles at the specific locations identified in the application. More nozzles may be installed without obtaining plan approval, but none of those identified in the application may be omitted.
2. The water spray dust suppression system shall be connected to an on-demand water source capable of delivering an adequate supply of water at any time. If the water spray dust suppression system is inoperable or is unable to provide an adequate supply of water due to freezing weather or any other reason, the sand and gravel processing plant shall not be operated.
3. A water truck equipped with a pressurized spray mechanism shall be kept onsite and used, as needed, for the control of fugitive particulate matter from plant roadways, stockpile areas, and the like.
4. All loaded permittee-owned or operated trucks exiting the facility via a public road shall be tarped or have their loads sufficiently wetted so as to prevent fugitive PM from becoming airborne. Additionally, a highly visible sign requiring the tarping/wetting of all trucks shall be posted.
5. If, at any time, the sand and gravel processing plant, or any piece of equipment incorporated in the plant, is determined by the Department to be causing the emission of fugitive PM in excess of the limitations specified in any applicable rule or regulation or in excess of the level which the Department considers to be the ''minimum attainable through the use of the best available technology,'' the permittee shall, upon notification by the Department, immediately install additional water spray dust suppression equipment or take other measures as are needed to reduce the level of emissions to within the level deemed acceptable by the Department.
6. The primary and secondary processing operation shall not be used to process more than 2.628 million tons of material in any 12 consecutive month period. The portable screening unit shall not be used to process more than 2.19 million tons of material in any 12 consecutive month period.
7. Records shall be maintained of the amount of material processed through the primary and secondary processing operation each month as well as of the amount of material processed through the portable screening unit each month. All of these records shall be retained for at least 5 years and shall be made available to the Department upon request.
8. This plan approval does not authorize the construction, installation or operation of any generator, engines or engine/generator sets except that the portable screening unit may incorporate a diesel engine provided that the respective engine is rated at less than 100 horsepower.
49-00012A: Eldorado Properties Corp.--Petroleum Products Corp. (P. O. Box 2621, Harrisburg, PA 17105) for construction of two gasoline/distillate storage tanks 35 and 36 to be associated with the Northumberland Terminal on Route 11 in Point Township, Northumberland County.
Each of the two tanks will have a capacity of 3,981,040 gallons and will be equipped with a suspended internal floating roof with primary and secondary seals. The resultant VOC and hazardous air contaminant emissions from each of the two tanks will be no greater than 7.34 and 1.22 tons, respectively, in any 12 consecutive month period.
The Department has determined that the proposed tanks will comply with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants, including 25 Pa. Code § 129.56, the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12 and the requirements of Subpart Kb of the Federal Standards of Performance for New Stationary Sources, 40 CFR 60.110b--60.117b. The Department consequently intends to approve the application and issue plan approval for the construction of the two proposed tanks.
The following is a summary of the conditions the Department plans to place in the plan approval to be issued to ensure compliance with all applicable regulatory requirements:
1. Each of the two storage tanks shall be equipped with a suspended internal floating roof incorporating primary and secondary seals. Additionally, all openings in the internal floating roofs other then the stub drains shall be equipped with a cover, lid or seal.
2. The product throughput of each of the two tanks shall not exceed 178,416,000 gallons in any 12 consecutive month period.
3. The VOC and HAP emissions from each of the two tanks, excluding the emissions occurring as a result of internal floating roof landings, shall not exceed 2.34 tons and .39 ton, respectively, in any 12 consecutive month period.
4. The VOC and HAP emissions from each of the two tanks occurring as a result of internal floating roof landings shall not exceed 5.0 tons and .83 ton, respectively, in any 12 consecutive month period.
5. Annual inspections of the suspended internal floating roofs and associated seals shall be performed and the results recorded. All of these records shall be retained for at least 5 years and shall be made available to the Department upon request.
6. Records shall be maintained of the type of product stored in each tank, the monthly product throughput of each tank and the maximum true vapor pressure of the product in storage. All of these records shall be retained for at least 5 years and shall be made available to the Department upon request.
7. Records shall be maintained of the amount of VOCs and HAPs emitted from each tank during each month other than as a result of internal floating roof landings as well as the amount of VOCs and HAPs emitted from each tank during each month as a result of internal floating roof landings. All of these records shall be retained for at least 5 years and shall be made available to the Department upon request.
