FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA or to the issuance of a Dam Permit, Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit comments, suggestions or objections within 30 days of the date of this notice, as well as questions, to the regional office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Individuals will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on each working day at the regional office noted before the application.

   Persons with a disability who wish to attend a hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings should contact the specified program. TDD users should contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.


Applications received under the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27) and section 302 of the Flood Plain Management Act (32 P. S. § 679.302) and requests for certification under section 401 of the FWPCA (33 U.S.C.A. § 1341(a)).

WATER OBSTRUCTIONS AND ENCROACHMENTS

   Southeast Region: Water Management Program Manager, 2 East Main Street, Norristown, PA 19401.

   E09-874. Lower Makefield Township, 1100 Edgewood Road, Yardley, PA 19067, Lower Makefield Township, Bucks County, ACOE Philadelphia District.

   To stabilize and maintain a 1,200 linear foot reach of Brock Creek (WWF-MF) stream bank at Yardley Meadows by regrading the stream banks; providing vegetative plantings, J-hook vanes, root-wads and rock cross-vane structures. Temporary cofferdams, temporary dewatering of the stream and temporary stream crossings will be utilized to facilitate construction at the site. The site is approximately 1,200 feet north of the intersection of Heacock Road and Oxford Valley Road (Trenton West, NJ-PA USGS Quadrangle N:  15.5 inches; W:  15.5 inches).

   E15-717. Department of Transportation, 7000 Geerdes Boulevard, King of Prussia, PA 19406, West Bradford Township, Chester County, ACOE Philadelphia District.

   To remove an existing single span stone masonry arch bridge and to construct and maintain in its place, a single span precast concrete arch bridge across Broad Run (EV) impacting 0.062 acre of wetlands (PEM). The proposed bridge will have a clear span of 48.0 feet and a minimum underclearance of approximately 12.0 feet. This work also includes placement and maintenance of associated riprap protection at the abutments and temporary stream crossings. The site is just southwest of the intersection of Broad Run Road and Telegraph Road (SR 0162) (Unionville, PA USGS Quadrangle N:  12.7 inches; W:  11.0 inches).

   Northeast Region: Water Management Program Manager, 2 Public Square, Wilkes-Barre, PA 18711-0790.

   E48-344. Columbia Gas Transmission Corporation, 1700 MacCorkle Avenue, S. E., Charleston, WV 25314 in Forks Township, Northampton County, U. S. Army Corps of Engineers, Philadelphia District.

   To remove the existing 14-inch diameter natural gas transmission line and to construct and maintain 44 utility line wetland crossings temporarily impacting approximately 10.6 acres of wetlands and 27 utility line stream crossings, including cathodic protection measures, associated with the installation of a 20-inch natural gas transmission line along a 13.7-mile segment of existing pipeline 1,278 right-of-way. The purpose of the project is to upgrade the aged and deteriorated existing 14-inch diameter transmission line and work will occur in the existing 50-foot right-of-way with the possibility of an additional 25-foot right-of-way, resulting in a 75-foot construction right-of-way. The project begins just south of an existing compressor station in Forks Township and continues north to the Northampton County/Monroe County boundary (Bangor, PA-NJ Quadrangle N:  2.9 inches; W:  13.7 inches).

   E45-465. Columbia Gas Transmission Corporation, 1700 MacCorkle Avenue, S. E., Charleston, WV 25314 in Monroe County, U. S. Army Corps of Engineers, Philadelphia District.

   To remove the existing 14-inch diameter natural gas transmission line and to construct and maintain 27 utility line wetland crossings temporarily impacting approximately 4.0 acres of wetlands and 27 utility line stream crossings, including cathodic protection measures, associated with the installation of a 20-inch natural gas transmission line along a 13.4-mile segment of existing pipeline 1,278 right-of-way. The purpose of the project is to upgrade the aged and deteriorated existing 14-inch diameter transmission line and work will occur in the existing 50-foot right-of-way with the possibility of an additional 25-foot right-of-way, resulting in a 75-foot construction right-of-way. The project begins at the Northampton County/Monroe County boundary and continues north to the Monroe County/Pike County boundary (Stroudsburg, PA-NJ Quadrangle N:  13.3 inches; W:  4.4 inches).

   E52-196. Columbia Gas Transmission Corporation, 1700 MacCorkle Avenue, S. E., Charleston, WV 25314 in Pike County, U. S. Army Corps of Engineers, Philadelphia District.

   To remove the existing 14-inch diameter natural gas transmission line and to construct and maintain 53 utility line wetland crossings temporarily impacting approximately 13.3 acres of wetlands and 29 utility line stream crossings, including cathodic protection measures, associated with the installation of a 20-inch natural gas transmission line along a 13.3-mile segment of existing pipeline 1,278 right-of-way. The purpose of the project is to upgrade the aged and deteriorated existing 14-inch diameter transmission line and work will occur in the existing 50-foot right-of-way with the possibility of an additional 25-foot right-of-way, resulting in a 75-foot construction right-of-way. The project begins at the Monroe County/Pike County boundary and ends at Weber Road in Dingmans Township (Bushkill, PA-NJ Quadrangle N:  15.1 inches; W:  4.3 inches).

   Southwest Region: Water Management Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   E03-423. Department of Transportation, P. O. Box 429, Indiana, PA 15701. East Brady bridge replacement in Brady's Bend Township, Armstrong County and East Brady Borough in Clarion County, Pittsburgh ACOE District. The applicant proposes to remove the existing structures and: (1) to construct and maintain a continuous composite multigirder steel bridge having four spans at 78.0 meters, 96.0 meters, 78.0 meters and 63.0 meters and an underclearance of 9.74 meters over the Allegheny River (WWF). The bridge is at the navigation pool above dock and dam no. 9 and tow of the new bridge piers will be within the normal pool (East Brady, PA Quadrangle N:  21.0 inches; W:  15.7 inches) (Latitude: 40° 59` 26"--Longitude: 79° 36` 50") in Brady Bend Township, Armstrong County and East Brady Borough, Clarion County; and (2) to construct and maintain a prestressed concrete spread box beam bridge having a normal span of 17.16 meters and an underclearance of 7.79 meters over Sugar Creek (WWF). The bridge is on SR 0068 approximately 600 feet west of the Allegheny River (East Brady, PA Quadrangle N:  21.2 inches; W:  16.1 inches) (Latitude: 40° 59` 30"--Longitude: 79° 36` 60") in Brady's Bend Township, Armstrong County. The project proposes to directly offset, through bridge construction, 150 linear feet of river and stream. No vegetated wetlands will be impacted.

   E04-303. Rochester Borough, 300 West Park, Rochester, PA 15074. Rochester Borough Riverfront Park in Rochester Borough, Beaver County, Pittsburgh ACOE District. The applicant proposes to construct and maintain a boat dock along the left bank side of the Beaver River (WWF) (Beaver, PA Quadrangle N:  14.7 inches; W:  5.6 inches; Latitude: 40° 42` 21"--Longitude: 80° 17` 25") and a 28-foot wide by 80-foot long pole building in the left bank floodway of the Beaver River (Beaver, PA Quadrangle N:  14.8 inches; W:  5.6 inches; Latitude: 40° 42` 23"--Longitude: 80° 17` 25"). The boat dock and pole building are on the west side of Water Street between the Bridgewater and Route 68/51 bridges. The applicant also proposes to construct and maintain a 40-foot by 40-foot stage along the right bank floodway of the Ohio River (WWF) (Beaver, PA Quadrangle N:  13.3 inches; W:  4.6 inches; Latitude: 40° 41` 54"--Longitude: 80° 16` 59"). The stage is near River Mile 25.3 on the east side of the Monaca/Rochester Bridge. All three sites are in Rochester Borough, Beaver County. The total stream impact is 300 square feet to the Beaver River for the boat docks, 28 feet by 80 feet of fill in the floodway of the Beaver River for the pole building and 40 feet by 40 feet of fill in the floodway of the Ohio River for the stage.

THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

FINAL ACTIONS TAKEN FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS

   The Department of Environmental Protection (Department) has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and Notices of Intent (NOI) for coverage under general permits. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

   Sections I--VI contain actions related to industrial, animal or sewage wastes discharges, discharges to groundwater and discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities and concentrated animal feeding operations (CAFOs). Section VII contains notices for parties who have submitted NOIs for coverage under general NPDES permits. The approval for coverage under general NPDES permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions set forth in each general permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. Permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

   For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

   Description of Proposed Action/Activity: Authorization to discharge to Susquehanna River in Watershed 7-G.

   Northcentral Region: Water Management Program Manager, 208 West Third Street, Williamsport, PA 17701.

   PA0228729, CAFO, Hostetter Management Company, P. O. Box 526, Ephrata, PA 17522. This existing facility is in Cleveland Township, Columbia County.

   Description of Existing Activity: The farm comprises 725 sows housed in a swine confinement barn, with liquid manure temporarily collected in shallow pits beneath the barn's slatted floors and periodically released to an outside, HDPE-lined manure storage, with approximately 750,000 gallons of storage. All manure is typically land applied on the James Mack farm acreage (owner of property), with some occasionally exported to a neighboring farm. Animals onsite include sows with litter, nursery pigs and boars. Total AEUs is 362.9.

   The receiving stream, unnamed tributary to South Branch Roaring Creek, is in the State Water Plan watershed 6B and is classified for HQ-CWF.

   The proposed effluent limits for the operation/activity include: Except for the chronic or catastrophic rainfall events defined as over the 25-year/24-hour rain storms, the CAFO permit is a nondischarge NPDES permit. Where applicable, compliance with 40 CFR Federal effluent limitation guidelines is required. The permit requires no other numeric effluent limitations and compliance with Pennsylvania Nutrient Management Act and The Clean Streams Law constitutes compliance with the State narrative water quality standards.

   PAS804803, Industrial Stormwater SIC 4922, Dominion Transmission, Inc., 1001 Pleasant Valley Road, Harrison Valley, PA 16927. This existing facility is in Harrison Township, Potter County.

   Description of Proposed Activity: This proposed action is for issuance of an NPDES permit for an existing discharge of industrial stormwater.

   The receiving stream, North Branch Cowanesque River, is in the State Water Plan Lycoming watershed 10-A and is classified for CWF. The nearest downstream public water supply intake is the PA/NY border. The proposed effluent limits are based on Best Management Practices.

   Other Conditions: Monitoring for ethylene glycol.
