THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

FINAL ACTIONS TAKEN FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS

   The Department of Environmental Protection (Department) has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and Notices of Intent (NOI) for coverage under general permits. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

   Sections I--VI contain actions related to industrial, animal or sewage wastes discharges, discharges to groundwater and discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities and concentrated animal feeding operations (CAFOs). Section VII contains notices for parties who have submitted NOIs for coverage under general NPDES permits. The approval for coverage under general NPDES permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions set forth in each general permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. Permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

   For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

   Important legal rights are at stake, however, so individuals should show this notice to a lawyer at once. Persons who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at (717) 787-3483 for more information.

   PA0027171, Sewerage SIC, 4952, The Municipal Authority of the Town of Bloomsburg, 301 East Second Street, Bloomsburg, PA 17815. This existing facility is located in Town of Bloomsburg, Columbia County.

   Description of Proposed Activity: This proposed action is for renewal of an NPDES permit for an existing discharge of treated sewage wastewater.

   The receiving stream, the Susquehanna River, is in the State Water Plan watershed 5D and classified for: WWF. The nearest downstream public water supply intake for Danville Municipal Water Authority is located on the Susquehanna River 10 miles below the point of discharge.

   The proposed effluent limits for Outfall 001 based on a design flow of 4.29 mgd.

   Description of Action/Activity: Construction and operation of a pump station.

   WQM Permit No. 1503409 Amendment No. 2, Sewerage, East Fallowfield Township, 2264 Strasburg Road, East Fallowfield, PA 19320. This proposed facility is located in East Fallowfield Township, Chester County.

   Description of Action/Activity: Increased operating capacity of Robins Cove PS No. 2 from 52,775 gpd to 139,401 gpd.

   WQM Permit No. 4605407, Sewerage, Franconia Township Sewer Authority, 671 Allentown Road, P. O. Box 128, Franconia, PA 18924. This proposed facility is located in Franconia Township, Montgomery County.

   Description of Action/Activity: Construction and operation of a sanitary pump station and force main to serve a 10 lot subdivision.

   WQM Permit No. 0905407, Sewerage, Warrington Township, 1585 Turk Road, Warrington, PA 18976. This proposed facility is located in Warrington Township, Bucks County.

   Description of Action/Activity: Construction and operation of a sewage pump station and gravity main for land development.

   Description of Action/Activity: Construction and operation of a sewage pump station and force main.

   Description of Action/Activity: Construction and operation of a raw sewage pumping station and a 6" diameter force main.

   WQM Permit No. 4600414 Amendment No. 1, Sewerage, Hatfield Township Municipal Authority, 3200 Advance Lane, Colmar, PA 18915. This proposed facility is located in Hatfield Township, Montgomery County.

   Description of Action/Activity: A rerate of the permitted organic loading rate, from 12,870 lbs/day of BOD to 22,300 lbs/day of BOD.

   WQM Permit No. 4699404 Amendment No. 1, Sewerage, Montgomery Township Municipal Sewer Authority, 1001 Stump Road, Montgomeryville, PA 18936. This proposed facility is located in Montgomery Township, Montgomery County.

   Description of Action/Activity: This amendment approves the construction and operation of sewerage facilities consisting of 1 pump station and associated force main.

   WQM Permit No. 2305403, Sewerage, Upper Providence Township Sewer Authority, 935 N. Providence Road, Media, PA 19063-1403. This proposed facility is located in Upper Providence Township, Delaware County.

   Description of Action/Activity: Construction and operation of a sewage pump station for a development of 11 single family homes.

   WQM Permit NO. 4605401, Sewerage, Pottstown Borough Authority, 100 East High Street, Pottstown, PA 19464. This proposed facility is located in Borough of Pottstown, Montgomery County.

   Description of Action/Activity: Sludge dewatering and drying.

   WQM Permit No. 0980438 Amendment No. 1, Sewerage, Melody Lakes Estates, 1045 North West End Boulevard, Lot 600, Quakertown, PA 18951. This proposed facility is located in Richland Township, Bucks County.

   Description of Action/Activity: Replacement of an existing equalization tank.

   WQM Permit No. 1502419 Amendment No. 1, Sewerage, Pennsylvania American Water, 100 Cheshire Court, Suite 204, Coatesville, PA 19320. This proposed facility is located in City of Coatesville, Chester County.

   Description of Action/Activity: Modifications of sewerage facilities consisting of construction and operation of a 10" force main and a 15" gravity sewer.

   WQM Permit No. 0905409, Sewerage, Falls Township Water and Sewer Department, 188 Lincoln Highway, Suite 100, Fairless Hills, PA 19030. This proposed facility is located in Falls Township, Bucks County.

   Description of Action/Activity: Abandonment of existing ''can'' type pump station and the construction of a new submersible pump station.

   WQM Permit NO. 1505410, Sewerage, East Fallowfield Township, 2264 Strasburg Road, East Fallowfield, PA 19320. This proposed facility is located in East Fallowfield Township, Chester County.

   Description of Action/Activity: Construction and operation of a sewage pump station and 4" force main for 21 single family residents.

   WQM Permit NO. 1505411, Sewerage, Uwchlan Township, 715 North Ship Road, Exton, PA 19341-1940. This proposed facility is located in Uwchlan Township, Chester County.

   Description of Action/Activity: Construction and operation of a low pressure sanitary sewer system.
