   The Department of Environmental Protection has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1--721.17) for the construction, substantial modification or operation of a public water system.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

   For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

   Plan Description:  The approved plan provides for a change in the method of sewage service for the Lockport Village sewage service area from a new sewage treatment plant to a pump station and force main tributary to the existing Strodes Mills sewage treatment plant. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal.

HAZARDOUS SITES CLEANUP UNDER THE ACT OF OCTOBER 18, 1988

Amendment to Consent Order and Agreement

Honeywell International, Inc., Former Bendix Flight Systems Montrose Plant, Bridgewater Township, Susquehanna County

   Bendix Flight Systems, formerly a unit of Allied Signal Inc., now Honeywell International, Inc. (Honeywell) has petitioned the Department of Environmental Protection (Department) for revisions to the November 30, 1987, Consent Order and Agreement (CO&A), as amended on June 1, 1995. The CO&A covers a Water Supply Agreement providing for the furnishing of alternative water supplies to certain residences or commercial establishments and the sampling of water supplies in offsite residential wells in South Montrose, PA.

   The proposed amendment to the CO&A deals with revisions to several technical issues and not to the overall intent of the CO&A. The proposed revisions to the CO&A are as follows:

   1.  A reduction in sampling frequency from semi-annually (two times a year) to annually (one time a year) for residential wells.

   2.  A reduction in sampling frequency from annually to once every 3 years for residential wells that have unfiltered water.

   3.  A change in the analytical method, from EPA SW-846, Method 8021 to EPA SW-846, Method 8021B.

   4.  A termination of filtration units at selected filtered water supplies where sampling has indicated untreated well water is acceptable for drinking water purposes.

   This public notice is being published in the Pennsylvania Bulletin and the Scranton Times newspaper by the Department and Honeywell. Written comments concerning the proposed revisions to the CO&A as contained in the Amendment to the Consent Order and Agreement will be accepted in person, if delivered, or by mail, if postmarked within 60 days of publication of this public notice. All written comments are to be sent to the attention of Woodrow R. Cole, Project Officer, Department of Environmental Protection, Environmental Cleanup Program, 2 Public Square, Wilkes-Barre, PA 18771. Copies of the Amendment to the Consent Order and Agreement and the 1987 Consent Order and Agreement will be on file for public review at the following locations: 1) Department of Environmental Protection, 2 Public Square, Wilkes-Barre, PA; and 2) Susquehanna County Planning Commission, 31 Public Ave., Montrose, PA. These documents will be available for public inspection Monday through Friday, 8 a.m. to 4 p.m., at the previously mentioned locations.

Prompt Interim Response

Eastmont Dry Cleaner Site, Monroeville Borough, Allegheny County

   The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305), has initiated a prompt interim response at the Eastmont Dry Cleaner Site (Site), 4137 William Penn Highway, Borough of Monroeville, Allegheny County. This response has been initiated under sections 501(a) and 505(b) of the HSCA (35 P. S. §§ 6020.501(a) and 6020.505(b)).

   The property has been the location of dry cleaning operations dating to 1970. Analytical data generated by Walnut Capital, a prospective buyer for the Site, indicates that groundwater onsite and offsite in the area of Kenmar Drive is contaminated with tetrachloroethene (PCE), trichloroethene (TCE) and other chlorinated hydrocarbons.

   Due to concerns of vapor intrusion into residences located on Kenmar Drive, the Department conducted an investigation in the area in May 2004. Indoor air samples were taken at eight homes along Kenmar Drive. The results of the indoor air analyses indicated that PCE was present in seven of the eight homes sampled. In addition, the levels of PCE detected exceeded the ACT 2 indoor air standard in three of the eight homes sampled.

   To protect the affected residents on Kenmar Drive against the inhalation of hazardous contaminants, the Department initiated a prompt interim response. The Department hired Shaw Environmental & Infrastructure, Inc. to install ''reverse flow'' radon remediation systems to address the indoor air problems at eight residences on Kenmar Drive. Installation of the systems took place in August of 2004. Follow up sampling of the residences will be conducted to ensure that the systems are functioning as anticipated.

   This notice is being provided under sections 505(b) and 506(b) of the HSCA. The administrative record, which contains the information that forms the basis and documents the selection of this response action is available for public review and comment Monday through Friday from 8 a.m. to 4 p.m. at the Department of Environmental Protection, 400 Waterfront Drive, Pittsburgh, PA.

   The administrative record will be open for comments from January 29, 2005, until April 30, 2005. Persons may submit written comments into the record, during this time only, by sending them to Paul Vogel, Department of Environmental Protection, 400 Waterfront Drive, Pittsburgh, PA 15222 or by delivering them to this office in person.

   In addition, persons may present oral comments, for inclusion in the administrative record, at a public hearing call on March 10, 2005, at 7 p.m. at the Monroeville Municipal Building, 2700 Monroeville Boulevard. Settlement under the Hazardous Sites Cleanup Act and Comprehensive Environmental Response, Compensation and Liability Act

   The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) (42 U.S.C.A. §§ 9601--9675), has entered into a proposed settlement with Berkley Products Company (Settlor).

   The proposed settlement resolves claims of the Department with the Settlor under the HSCA, CERCLA and other applicable law for response costs that have been expended and will be incurred by the Department at the Berkley Products Company (Site) located in West Earl Township, Lancaster County, PA.

   The proposed settlement obligates the Settlor to remit $1,000 to the Department. The Department believes that the proposed settlement is fair, reasonable, practicable, in the public interest and in furtherance of the statutory goals of the HSCA and CERCLA. This settlement is based primarily on the Department's determination that the Settlor lacked the ability to pay a higher settlement amount.

   For a period of 60 days beginning with the January 29, 2005, publication date of this notice, the public is invited to review the Consent Order and Agreement, Monday through Friday, from 8 a.m. to 4 p.m., at the Department's Southcentral Region Office located at 909 Elmerton Avenue, Harrisburg, PA 17110 by contacting Jeff Silar at (717) 705-4842.

   After review, the public may submit written comments on the Consent Order and Agreement before March 30 2005, by mailing them to Jeff Silar at the Department's Harrisburg Office at the previous address. A person adversely affected by the settlement may also file an appeal from the Consent Order and Agreement to the Environmental Hearing Board.
