FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

   Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483.    E41-573. Wal-Mart Stores, Inc., 2001 SE 10th Street, Bentonville, AK 72716. Water Obstruction and Encroachment Permit, Floodway Improvement Project, in Muncy Township, Lycoming County, ACOE Susquehanna River Basin District (Muncy, PA Quadrangle N:  17 inches; W:  4 inches).

   To construct and maintain approximately 900 linear feet of floodway and floodplain improvements, to include floodway excavation, within the Margaret Run (WWF) watershed in Muncy Township, Lycoming County. This project proposes to have minimal impacts to the floodway of Margaret Run. This permit also includes 401 Water Quality Certification. This project does not propose to impact any jurisdictional wetlands.

WATER OBSTRUCTIONS AND ENCROACHMENTS

   Southwest Region:  Watershed Management Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   E02-1310. Sports and Exhibition Authority of Pittsburgh and Allegheny County, 425 Sixth Avenue, Suite 2750, Pittsburgh, PA 15219. To amend Permit No. E02-1310 description as follows in the City of Pittsburgh, Allegheny County, Pittsburgh ACOE District. Permit No. E02-1310 originally authorized the removal of existing structures and to construct and maintain a new waterfront park on the North Shore of the Ohio River (WWF) and Allegheny River (WWF). The project consisted of a sheet pile wall for the entire length of the project (3,025 feet), 700 feet of rip-rap bank stabilization, 10,370 cy of river dredging, to decrease 2.29 acres of shallow water mitigation area by dredging and placing 7,720 cy of rip-rap and approximately 1,100, 2-foot diameter boulders, an observation pier, two pile supported overlooks, a pile supported causeway (316 ft.), two commercial passenger ferry ramps, a mooring facility for the Delta Queen, a fountain/waterfall and six outfalls. The project is bounded on the north by North Shore Drive; on the south by the Allegheny and Ohio Rivers; on the east by PNC Park and on the west by the Carnegie Science Center. This project excluded PNC Park Waterfront improvements (Pittsburgh West, PA Quadrangle project begins N:  12.7 inches; WZ: 2.5 inches and project ends N:  12.8 inches; W:  1.0 inches). In 2002, the permit was amended to include the construction and maintenance of a public park to be known as the Great Lawn. The project consists of filling the floodplains, sidewalks, a Law Enforcement Officer Memorial and a Belvedere on the old Manchester Bridge Pier (Pittsburgh West PA Quadrangle N:  12.7 inches; W:  1.6 inches). In 2005, the permit was amended to eliminate the proposed sheet pile bulk head wall (approximately 850 feet), located in front of the Science Center to the Steelers Stadium West Quay. The construction and maintenance of a 120 ft. long extension to the new bulk head retaining wall starting at the downstream end of the Steelers Stadium West Quay. The construction and maintenance of a walkway and amphitheater and their associated fill and rip-rap bank stabilization along the right bank of the Ohio River (Pittsburgh West PA Quadrangle N:  12.6 inches; W:  2.4 inches). We hereby amend Permit E02-1310 to include the construction and maintenance of a pile supported walkway, streambed associated with environmental mitigation (The environmental mitigation is now 1.65 acres of shallow water habit created by the placement of rip-rap stone mixture and two-foot diameter boulders), 3 pipe piles for ice flow break-up; approximately 120 feet of manufactured revetment, to replace a like amount of existing rip-rap, and a relocated causeway (Pittsburgh West, PA Quadrangle, project begins N:  12.7 inches; W:  2.4 inches, project ends N:  12.7 inches; W:  1.8 inches). This amendment also includes the construction and maintenance of the Fred Rodgers Children's Memorial and belvedere in the old Manchester Bridge Pier (Pittsburgh West PA Quadrangle N:  12.7 inches; W:  1.6 inches) in the City of Pittsburgh, Allegheny County.

   E02-1527. Irongate Ventures, LLC, 210 Bird Park Road, Pittsburgh, PA 15228. To fill wetland and construct an arch culvert in North Fayette Township, Allegheny County, Pittsburgh ACOE District. (Oakdale, PA Quadrangle N:  9.6 inches; W:  13.8 inches; Latitude: 40° 25` 26"; Longitude: 80° 13` 25") To place and maintain fill in 0.16 acre of wetlands; to temporarily impact 0.03 acre of wetlands; construct and maintain an arch culvert 64-feet long, having a span of 14.0 feet with an underclearance of 4.0-feet in a UNT to North Branch Robinson Run (WWF) and associated wetlands located under Irongate Drive, approximately 650.0 feet east from the intersection of Irongate Drive and Englewood Circle, to construct and maintain twin 48-inch diameter culverts (depressed 1.0-foot below the natural stream bed) 248-feet long in a UNT to North Branch Robinson Run (WWF) located under Brierwood Drive, located approximately 500.0 feet east from the intersection of Brierwood Driveand Sandstone Circle, to construct and maintain a 48-inch diameter culvert (depressed 1.0-foot below the natural stream bed) 174-feet long in a UNT to North Branch Robinson Run (WWF) and associated wetlands located under Irongate Drive located approximately 1,900.0 -feet north from the intersection of Irongate Drive and Brierwood Drive; to place and maintain fill for 30 feet in a UNT to North Branch Robinson Run (WWP) located under Irongate Drive approximately 1,500-feet North from the intersection of Irongate Drive and Brierwood Drive; and to remove the existing culvert and restore the stream channel in a UNT to North Branch Robinson Run (WWF) located between Wetlands 1 and 2, to provide access to the proposed Irongate residential development located on the west side of Bateman Road (SR 978) approximately 4,000.0 feet northwest from the intersection of Bateman Road (SR 978) and North Branch Road. To compensate for the wetland impacts, the applicant will construct 0.26 acre of replacement wetlandsand to compensate for the stream impacts, the applicant will provide plantings for approximately 1,000 feet along a UNT to North Branch Robinson Run and place conservation easements on this stream and others within the development.

   E02-1540. Montour Trail Council, P. O. Box 11866, Pittsburgh, PA 15228-0866. To construct a pedestrian bridge in South Park Township, Allegheny County, Pittsburgh ACOE District. (Glassport, PA Quadrangle N:  5.6 inches; W:  15.4 inches and Latitude: 40° 16` 51"--Longitude: 79° 59' 07"). To construct and maintain a pedestrian bridge with a span of 110 feet and an underclearance of 14.16 feet, including approaches created by placing fill located along and across Piney Fork Creek (TSF), place and maintain riprap for bank stabilization at the exiting vehicle bridge crossing said stream; place and maintain approximately 130-ft. of bank stabilization and place and maintain fill in a scour hole in the bed of said stream; to remove an existing railroad bridge across said stream and to place and maintain fill in a deminimus wetland (0.035 acre) and to temporarily impact and restore 0.012 acre of wetlands for the purpose of constructing a pedestrian trail. The project is located approximately 300 feet south-southwest of the intersection of Piney Fork Road and Triphammer Road.

   E63-584. 84 Lumber Company (Pierce Hardy LP), 1019 Route 519, Building 5, Eighty Four, PA 15330. To place and maintain fill in 290 linear feet of Little Chartiers Creek in North Strabane Township, Washington County, Pittsburgh ACOE District. (Washington East, PA Quadrangle N:  11.6 inches; W:  0.7 inch and Latitude: 40° 11` 20"--Longitude: 80° 07` 48"). To place and maintain fill in approximately 290 linear feet of a UNT to Little Chartiers Creek (HQ-WWF) (UNT No. 1); to relocate and maintain this channel approximately 294 linear feet and to construct and maintain this channel in a 134-foot long stream enclosure; and fill in approximately 0.011 acre of associated wetlands (PEM), to place and maintain fill in approximately 830 linear feet of a UNT to Little Chartiers Creek (HQ-WWF) (UNT #2) and approximately 0.113 acre of associated PEM wetlands and to place and maintain fill in approximately 258 linear feet of a UNT to Little Chariters Creek (HQ-WWF) (UNT #3) and approximately 0.010 acre of associated PEM wetlands for the purpose of expanding the existing 84 Lumber Company headquarters. The project is located on the east side of Thomas Road (SR 519), just southeast from the intersection of Thomas Road (SR 519) and Christy Road. This project will impact 1,378 linear feet of stream channel and 0.158 acre of wetlands. To compensate for the stream and wetland impacts, the applicant will construct 0.158 acre of replacement wetlands, restore 1,097 linear feet of stream channel and provide 4,229 feet of construction easements on Little Chartiers Creek and tributaries to Little Chartiers Creek.

   E65-894. St. Vincent College, St. Vincent Archabbey, 300 Fraser Purchase Road, Latrobe, PA 15650. To construct a twin box culvert in Monastery Run in Unity Township, Westmoreland County, Pittsburgh ACOE District. (Latrobe, PA Quadrangle N:  7.4 inches; W:  3.4 inches and Latitude: 40° 17` 27"--Longitude: 79° 23` 53"). To construct and maintain an 86 LF long, twin box culvert with two 16-ft. wide by 10-ft. clearance cells depressed 1 ft. in Monastery Run (WWF), with a drainage area of 2.97 square miles; construct and maintain stormwater outfalls; and fill and maintain a total of 0.13 acre of adjacent PEM/PSS wetlands. One culvert cell will have an additional 1 ft. of streambed material placed to foster normal stream flows to be conveyed by the other cell. The applicant also proposes to construct and maintain a 105-ft. long, 60-inch diameter RCP culvert depressed 1-ft; a 65-ft. long, 48-inch diameter RCP culvert depressed 6 inches; and 213 ft. of stream relocation in adjoining drainage areas of less than 100 acres. Construction and maintenance of a total of 2.27 acres of PEM and PFO replacement wetlands will be part of Permit No. E65-896 associated with the nearby road improvement and SR 1045, St. Vincent Drive relocation projects. This project is located on the St. Vincent College campus in Unity Township, Westmoreland County.

   E65-896. Department of Transportation, Engineering District 12-0, 825 North Gallatin Avenue Extension, Uniontown, PA 15401. To construct a stream enclosure in Monastery Run in Unity Township, Westmoreland County, Pittsburgh ACOE District. (Latrobe, PA Quadrangle N:  7.4 inches; W:  3.2 inches and Latitude: 40° 17 17"--Longitude: 79° 24` 00"). To construct and maintain a 200 LF long, twin box culvert with two 16-ft. wide by 10 ft. clearance cells depressed 1 ft. in Monastery Run (WWF) with a drainage area of 2.97 square miles; construct and maintain stormwater outfalls; and fill and maintain a total of 1.0 acre of adjacent PEM/PSS wetlands. One culvert cell will have an additional 1 ft. of streambed material placed to foster normal stream flows to be conveyed by the other cell. The applicant also proposes to construct and maintain a 160-ft long, 48-inch diameter RCP culvert depressed 6-inches; a 128-ft. long, 60-inch diameter RCP culvert depressed 6-inches; a 28-ft. long 30-inch diameter RCP culvert depressed 6-inches; a 108-ft. long 48-inch diameter RCP culvert depressed 6-inches and 280-ft. of stream relocation in adjoining and nearby UNTs to Monastery Run. Construction and maintenance of a total of 2.27 acres of PEM and PFO replacement wetlands and stream restoration to mitigate impacts associated with this project and the nearby coordinated Department of Transportation, Westmoreland County and St. Vincent College road improvement and relocation projects. This project is associated with the 0.75 mile long relocation of SR 1045 also known as St. Vincent Drive (from approximately Latitude: 40° 17` 08"--Longitude: 79° 24` 15" to Latitude: 40° 17` 44" and Longitude: 79° 23` 51") located substantially on the St. Vincent College Campus. Total impacts are approximately 1,384 ft, of stream channel which will be mitigated offsite and 0.64 acre of wetland and 0.54 acre of temporary wetland impacts.

   Northwest Region:  Watershed Management Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

   E10-419, Cranberry Township, 2525 Rochester Road, Suite 400, Cranberry Township, PA 16066. Graham Park, in Cranberry Township, Butler County, ACOE Pittsburgh District (Baden, PA Quadrangle N:  40° 42` 34"; W:  80° 07` 52").

   To conduct activities associated with the construction of Graham Park, a municipal recreational, athletic facility on a 112-acre site, north of Rochester Road and east of Powell Road:

   1.  Impact .665 acre of four existing wetlands (PEM/PSS/PFO) for grading of the ball fields and other impacts.

   2.  Construct and maintain a 37.3-foot long Con/Span precast concrete arch culvert, having a span of 42-feet and a rise of 11-feet across Brush Creek for construction of Graham Park Drive.

   3.  To construct and maintain a 76-foot long aluminum box culvert, having a span of 13-feet and a rise of 3-feet across a tributary to Brush Creek (Tributary 4) on Graham Park Drive.

   4.  To construct and maintain a 580-foot long, 36-inch diameter stream enclosure in a tributary to Brush Creek (Tributary 5) having a drainage of less than 100 acres for construction of a sports field.

   5.  To construct and maintain a 63.5-foot long aluminum box culvert, having a span of 17.75-feet and a rise of 3.8-feet in a tributary to Brush Creek (Tributary 6) on Graham Park Drive.

   6.  To construct and maintain a 47-foot long, 30-inch diameter HDPE pipe culvert in a tributary to Brush Creek (Tributary 4) for a pedestrian trail.

   7.  To construct and maintain twin 43-foot long, 42-inch diameter HDPE pipe culverts in a tributary to Brush Creek (Tributary 6) for a pedestrian trail.

   8.  To conduct fill and grading within the 100-year floodplain and floodway involving a total of approximately 6,000-foot reach of Brush Creek and tributaries for construction of athletic fields, roadways, pedestrian trail and an off-stream pond.

   9.  Construct and maintain a total of 18 utility line crossings of Brush Creek, tributaries to Brush Creek and various wetlands.

   10.  Construct and maintain six stormwater outfalls to Brush Creek and tributary to Brush Creek (Tributary 4).

   This project proposes the following measures and/or activities as onsite mitigation for the project impacts:

   1.  To construct and maintain a total of 650 linear feet of streambank stabilization/restoration at two locations along Brush Creek.

   2.  Construction of 0.80-acre replacement wetland adjacent to an existing wetland (Wetland 7).

   3.  Conduct approximately 150 linear feet of stream enhancement along Brush Creek.

   4.  Conduct approximately 400 linear feet of stream enhancement along a tributary to Brush Creek (Tributary 4).

   5.  Establish approximately 9,000 linear feet of Conservation Easement along the undisturbed corridor of Brush Creek.

   6.  Establish approximately 5,020 linear feet of Conservation Easements on the undisturbed corridors of tributaries to Brush Creek.

DRINKING WATER STATE REVOLVING FUND SPECIAL NOTICE

   Project Description:  The Pennsylvania Infrastructure Investment Authority, which administers the Commonwealth's State Revolving Fund, is intended to be the funding source for this project. The Houtzdale Municipal Authority proposes construction of Well Th-14, surface water intake, raw water pumping station, transmission line, treatment plant modifications, Henderson booster pump station and storage tank. The Department's review of the project and the information received in the Environmental Report for the project has not identified any significant, adverse environmental impact resulting from this proposal. The Department hereby approves the Environmental Assessment.

Bureau of Mine Safety
Approval of Request for Variance

   The Department of Environmental Protection, Bureau of Mine Safety (BMS) has approved AMFIRE Mining Company LLC's request for a variance from the requirements of section 242(c) of the Pennsylvania Bituminous Coal Mine Act at the Gillhouser Run Mine. This notification contains a summary of this request and the basis for the Department's approval.    Summary of the Request:  AMFIRE Mining Company LLC requested a variance from Section 242(c) of the Pennsylvania Bituminous Coal Mine Act to allow for the common ventilation of belt conveyor entry with other entries at the Gillhouser Run Mine. The proposal accords protections to persons and property substantially equal to or greater than the requirements set forth in the Pennsylvania Bituminous Coal Mine Act.

   The basis for the Bureau's approval is summarized as follows:

   1.  The Pyott-Boone 9500 CO Monitoring System will provide advance warning of a developing mine fire originating in the conveyor belt entry. When maintained and operating correctly, this system provides warnings much earlier than the point type heat sensors.

   2.  Common entries would permit the larger section mantrip and scoops access to belt entry for transportation of personnel and supplies.

   3.  The operator will maintain a separate isolated intake escapeway that is at a higher air pressure than the belt and common entries.

   4.  The plan provides for the common entries to serve as an alternate intake escapeway. There will be a total of three separate, isolated escape routes.

   This approval is limited to a variance from the requirements in section 242(c) requiring that the belt entry is isolated from other entries. All other terms and requirements of section 242(c) shall remain in effect. Continued authorization for operation under the approval is contingent upon compliance with the measures described in the plan and the following conditions:

   1.  All mine employees shall be task trained in the Pyott-Boone 9500 CO monitoring system alert and alarm response procedures. These procedures shall also be included in the 8-hour annual retraining.

   2.  As part of the requirements of section 228, all belt entries, common entries and unfenced roadways shall be preshifted in their entirety.

   3.  Designated areas (DA) shall be established a strategic locations along the belt entry and common entry to determine whether the air is traveling in the proper course and normal volume. This air reading shall be taken by a scientific means (anemometer, chemical smoke tube, velometer).
