Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

   Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483.    To modify and maintain an existing pile supported boat dock and boat house structure in Harveys Lake (HQ-CWF) with work consisting of the construction of a 740 S.F. addition to the existing boat house and a new pile supported dock extending approximately 16 feet off the north and west sides of the boat house. The project is located on the northeast side of the lake at Pole No. 55 (Harveys Lake, PA Quadrangle N:  22.0 inches; W:  4.0 inches). (Subbasin: 5B)

   E48-367. Green & White Youth Association, 435 West Main Street, Pen Argyl, PA 18072. Pen Argyl Borough, Northampton County, Army Corps of Engineers Philadelphia District.

   To place fill in a de minimis area of PEM wetlands equal to 0.04 acre and to construct and maintain two stream enclosures in tributaries to Waltz Creek (HQ-CWF) as follows: 1) A proposed 92-foot long extension of an existing 60-inch diameter R.C.P. stream enclosure resulting in a length of approximately 200 feet; and 2) A 48-inch diameter R.C.P. stream enclosure having a length of approximately 360 feet. This work is associated with the proposed construction of the Green & White Youth Association athletic fields located on the south side of SR 1024 (West Main Street) (Wind Gap, PA Quadrangle N:  20.25 inches; W:  1.5 inches). (Subbasin: 1F)

   E17-430. Emigh Run Lakeside Watershed Association, P. O. Box 204, Morrisdale, PA 16858. Emigh Run No. 8 Acid Mine Drainage Treatment Project in Morris Township, Clearfield County, ACOE Baltimore District (Wallaceton, PA Quadrangle; Latitude: 40° 56` 54.94"; Longitude 78° 16` 6.82").

   The applicant proposes to construct, operate and maintain a passive treatment acid mine drainage abatement system resulting in 0.03 acre of temporary PFO/PEM wetland impacts associated with Emigh Run (CWF). The proposed wetland impacts will result from the placement of treatment-train piping through the wetland. Onsite wetlands are classified as ''other wetlands'' by the Department. No wetland replacement is necessary due to the temporary nature of the wetland impacts. The project site is approximately 1 mile southeast of Wallaceton, in the headwaters of Emigh Run.

   E41-575. Brian Winn Ice Cream, 606 Hasting Street, South Williamsport, PA 17702-7607. Small Projects Water Obstruction and Encroachment Joint Permit, in Muncy Creek Township, Lycoming County, ACOE Susquehanna River Basin District (Muncy, PA Quadrangle N:  41° 12` 43"; W:  76° 47` 12").

   To construct and maintain two industrial freezers, each measuring 6 feet wide by 8 feet deep by 7 feet high atop concrete pads within the floodway of the Muncy Creek located at 420 Main Street, west of Muncy Borough in Muncy Creek Township, Lycoming County. This project does not propose to impact any wetlands. This permit was issued under Section 105.13(e) ''Small Projects.''

   Southwest Region: Watershed Management Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   E02-1498. DENIED--Walnut Street Partners Development, 3285 Jacks Run Road, White Oak, PA 15131. Denial of Permit to construct an extension of an existing stream enclosure in the City of McKeesport, Allegheny County, Pittsburgh ACOE District (McKeesport, PA Quadrangle N:  13.4 inches; W:  12.4 inches, Latitude: 40° 19` 25"; Longitude: 79° 50` 21"). To deny the construction and extension of an existing stream enclosure with an approximately 250 feet long, 15 feet by 22 feet reinforced concrete box culvert, and it's associated fill in Long Run (TSF) and a borrow area for the proposed fill in the City of McKeesport. This permit is also associated with Application No. PAI050205003 for an Individual National Pollutant Discharge Elimination System for discharges associated with construction activities which will also be denied.

   E02-1551. Pleasant Hills Municipal Authority, 610 Old Clairton Road, Pittsburgh, PA 15236. To construct a gabion wall in South Park Township, Allegheny County, Pittsburgh ACOE District (Glassport, PA Quadrangle N:  9.85 inches; W:  13.9 inches, Latitude: 40° 18` 15"; Longitude: 79° 58` 30"). To construct and maintain a gabion wall 18.0 feet in height and 105.0 feet in length in the channel and along the right bank of Lick Run (TSF) for the purpose of preventing erosion and landslides at the applicant's screw pump building. The project is located approximately 600 feet northwest from the intersection of Wallace and Cochrans Mill Roads and will impact 145.0 linear feet of stream channel. This permit also authorizes the construction and maintenance of a temporary road crossing consisting of two 6.0 foot diameter culverts each 145.0 feet in length.

   Northwest Region: Watershed Management Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

   E10-426, Robert Ferree, Bottled Lightning, LP, 4848 Route 8, Allison Park, PA 15101. Brush Creek Commons Project, in Cranberry Township, Butler County, ACOE Pittsburgh District (Mars, PA Quadrangle N:  40° 40` 32"; W:  80° 06` 04").

   To place and maintain fill at a depth up to 6-feet within the regulated floodway along the left bank of a tributary to Brush Creek (WWF) for a length of approximately 380 feet for the construction of an office building, parking lots, and the like The site is west of Emeryville Drive and east of the Turnpike I-76, approximately 630 feet north of the Allegheny County line. An area of 0.08 acre wetland was filled during prior construction and will be mitigated onsite as part of this project.

   E10-427, Department of Transportation, District 10-0, 2550 Oakland Avenue, Indiana, PA. SR 0356, Section 0250, Across Connoquenessing Creek, in Butler, Butler County, ACOE Pittsburgh District (Butler, PA Quadrangle N:  19.4 inches; W:   2.5 inches).

   To remove the existing structure and to construct and maintain either a five-span steel girder bridge having clear spans of 67`, 106`, 110`, 141`, 133` and an underclearance of 56` on a 90° skew or a five-span prestressed concrete girder bridge having clear spans of 61` 3", 112` 9", 122` 6", 123` and 135` 9" and an underclearance of 56` on a 90° skew across Connoquenessing Creek (CWF) on SR 0356, Section 0250.

   E20-552, D&L Energy, Inc., 2761 Salt Springs Road, Youngstown, OH 44509. CCPI Well 3, in Vernon Township, Crawford County, ACOE Pittsburgh District (Meadville, PA Quadrangle N:  5.10 inches; W:  5.72 inches).

   The applicant proposes to construct and maintain a natural gas well, 2-inch diameter steel natural gas distribution line and 300-foot long access road within the FEMA floodway of French Creek (Meadville, PA Quadrangle N:  5.10 inches; W:  5.72 inches) approximately 0.3 mile west of the west bank of French Creek and approximately 0.3 mile NE of the intersection of Dunham and Rodgers Ferry Roads in Vernon Township, Crawford County. French Creek is a perennial stream classified as a WWF.

   Project proposes to expand an existing pond by constructing a non-jurisdictional dam downstream of the current dam. The dam will be constructed across a tributary to Pequea Creek (HQ-CWF) for recreational purposes. The project will impact approximately 80 feet of stream channel. Availability of Final Total Maximum Daily Loads (TMDLs)

   The Department of Environmental Protection (Department) has developed Total Maximum Daily Loads (TMDLs) for the watershed listed as follows. The TMDL sets the pollutant loading amounts for impaired waters that are allocated among the sources in the watershed. This TMDL has been approved by the Environmental Protection Agency and satisfies the Department's obligations under section 303(d) of the Federal Clean Water Act.
